HomeMy Public PortalAbout2014.224 (12-16-14)RESOLUTION NO. 2014.224 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING AN AGREEMENT WITH TETRA TECH FOR ENVIRONMENTAL CONSULTING SERVICES RELATED TO THE ALAMEDA TRIANGLE AND OTHER ENVIRONMENTALLY CHALLENGED AREAS OF THE CITY FOR A NOT TO EXCEED AMOUNT OF $25,000 AND AN APPROPRIATION FROM THE UNAPPROPRIATED GENERAL FUND BALANCE TO COVER COST OF SAID AGREEMENT WHEREAS, the City desires to utilize the services of Tetra Tech ( "Consultant ") as an independent contractor to provide consulting services to the City as set forth in "Exhibit A" to the attached proposed Agreement and including but not limited to services provided. in connection with the Alameda Triangle Project Area for the completion of a Remedial Action Plan (RAP); and WHEREAS, the work is being completed pursuant to the Polanco Redevelopment Act and the guidelines set forth in the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Accordingly, the City plans to recover such response costs under a Polanco Cost Recovery Action; and WHEREAS, Tetra Tech represents that it is fully qualified to perform such consulting services by virtue of -its experience and the training, education and expertise of its principals and employees; and WHEREAS, Employees Of Tetra Tech have been providing like services to the City commencing approximately in January 2010 and are uniquely qualified to provide said services to the City in part due to contractor's in depth knowledge of environmental conditions within the Project Area around the Alameda Triangle Project as well as the Alameda Triangle Project itself; and WHEREAS, Tetra Tech is part of an environmental team that has been actively engaged in cost recovery efforts under the Polanco Redevelopment Act in efforts to recover response costs incurred by the City in relation to the Alameda Triangle Project; and WHEREAS, based on history and intimate knowledge of the City's environmental challenges, it is recommended that the City enter into an agreement with Tetra Tech to complete the RAP review with DTSC and to further assist the City with the. current environmental issues the City is faced with; and WHEREAS, a vote of a 415 majority will be required to by -pass the RFP process and the historical knowledge and experience of the Tetra Tech team provides a unique situation that is both economically feasible and more efficient than the process of engaging potential new consultants to assist the City on projects that have taken years to develop; and WHEREAS, -in an effort to proceed with the completion of -the RAP for the Alameda Triangle Project Area, funds are requested herein in the amount of $25,000 to provide the needed resource to complete the RAP; and WHEREAS, the completion of the RAP is critical for the continuance of the remediation of the Alameda Triangle and therefore agreement for said services is in order. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City herby authorizes the appropriation of $25,000 from the General Fund's unappropriated fund balance for environmental consulting services provided in connection with the Alameda Triangle Project Area for the completion of the draft Remedial Action Plan and general environmental consulting services citywide under the attached Agreement with Tetra Tech. Section 2. The City Council hereby authorizes the City Manager or his designee to take necessary steps, including the execution of agreements and other related documents with Tetra Tech to undertake the implementation of all related services under the attached Agreement and Scope of Work. Section 3. This Resolution shall become effective immediately upon its adoption. PASSED, APPROVED and ADOPTED this 16th day of December, 2014.
