RESOLUTION NO. 2008-7, I NB IIII CFN 2008R0199286 OR Bk 26259 F9& 2935 -- 2937; (399s) RECORDED 03/11/2008 12:57:38 HARVEY RUVIWv CLERK OF COURT MIAMI-DADE COUNTY, FLORIDA A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING A VARIANCE OF DOCK SIZE FOR THE PROPERTY LOCATED AT 720 HARBOR DRIVE, KEY BISCAYNE, FLORIDA; PROVIDING FOR RECORDING; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Walter Defortuna and Claudia Batschauer, are the owners of the Property located at 720 Harbor Drive, Key Biscayne, FL and legally described as Lot 12, Block 19, Biscayne Key Estates as recorded in Plat Book 50, Page 61; and WHEREAS, the owners have applied for a variance from applicable Village of Key Biscayne Zoning Code regulations, to permit the construction of a boat dock extending 15 feet 2 inches into the adjacent waterway where 10 feet is permitted; and WHEREAS, the Village Council has held the properly noticed public hearing required under the Village of Key Biscayne Zoning and Land Development Regulations; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1,. Recitals Adopted. That the recitals as set forth above are hereby adopted and confirmed. ,Section 2. Variance Approval and Conditions. The variance is hereby granted, subject to the conditions outlined below: 1. The dock shall be constructed substantially in compliance with the dock as shown on that certain plan entitled De Fortuna Residence, 720 Harbor Drive, Key Biscayne, FL — Concrete & IPE Dock Extension (New Dock Plan) as prepared by Solver Structural Partnership, Inc. containing 1 page and dated June 26, 2003. The dock shall not be used until such time as the principal use (single family residence) is constructed on the property and a certificate of occupancy is issued for such residence. Section, 3. Recording. This Resolution shall promptly be recorded by the applicant at its expense, in the Public Records of Miami -Dade County. A copy of the proof of recordation shall be submitted to the Building, Zoning, and Planning Department. Section 4. Implementation. The Building, Planning, and Zoning Director is hereby directed to make the necessary notation on the maps and records of the Village of Key Biscayne Building, Zoning and Planning Department and to issue all permits in accordance with the conditions of this Resolution. A copy of this Resolution shall be attached to any building permit application documents. Section 5. Effective Date. That this Resolution shall be effective immediately upon its adoption.
