TOWN OF GULF STREAM, FLO RIDA, VACATING AND
ABANDONI NG A PORTION OF THE RIG HT-OF-WA Y
COMMONL Y KNOWN AS BANYAN ROA D AS SHOWN
ON THE PLAT OF POLO COVE, AS RECORDED IN
PLA T BOOK 24, PAGE 73 PUBLIC RECORDS OF PALM
BEACH COUNT Y, FLORIDA, AND AS MORE
PA RTICULARLY DESCRIBED HEREIN; AND FOR
OTHER PURPOSES.

WHEREAS, the o wner of the land abutting the pr operty h ereinafter described h as
petitioned the Town of Gulf Strea m ("Town") to abandon and vacate a portion of the
right-of-way commonly known as Banyan Road, o ver and across the lands more fully
hereinafter described; and
WHEREAS, a duly noticed public hearing wa s convened on Nov ember 13, 2020 for
the Town Commission to review the request to abandon and v ac ate said right-of-way;
a nd
WHEREA S, Petitioner ha s complied with a ll provisions and requirements of the
Town re la ting to the Petition for Abandonment; and
WHEREAS, the Town Commission of the To wn of Gulf Stream does hereby find and
determine that there is no t, nor will there be, a need for the use of the right-of-w ay
fo r any public purpose, tha t the aba ndonment does not, nor will not, prevent access
to a lot of record, and that the abandonment will not result in de triment to the
provision of a ccess to a djacent properties or the general area.
N OW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEA CH COUN TY, FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby ratified and confirmed.
Section 2. That portion of the right-of-wa y commo nly known as Banyan Roa d,
as shown on the Pla t of Polo Cove as reco rded in Plat Book 24, Page 73, more
particularly describe d below, be and the same is hereby va cated a nd abandoned.
