HomeMy Public PortalAbout040-2023 - MEMOOffice of the Mayor Memorandum TO: Richmond Common Council FROM: Mayor Dave Snow RE: Ordinance 40-2023 & Ordinance 41-2023 DATE: August 30, 2023 Ordinance 40-2023 is an ordinance that will give the City of Richmond the ability to create a Designated Outdoor Refreshment Area "DORA". A DORA is exempt from certain open container laws. Within a DORA, visitors can walk around local shops, restaurants, festivals, and other businesses with an alcoholic beverage as long as they are at least 21 years old, stay within the boundary of the DORA, and only consume beverages purchased from designated permittee or vendor within the DORA. The State of Indiana passed SENATE ENROLLED ACT No. 20 that allows Richmond to designate seven such areas for outdoor alcohol consumption Ordinance 41-2023 designates the Depot District as Richmond's first DORA. My office has been working with the executive committee of the Historic Depot Association since this spring to bring the DORA into existence. The ordinances presented tonight follow the regulations set forth in state code and also follow Indiana's Alcohol and Tobacco Commission's nonrule policy regarding Designated Outdoor Refreshment Areas. Simply put, within the DORA a person may Exit the premises of a designated permittee with up to two alcoholic beverages in a labeled DORA container Drink the beverage outside or in businesses that allow DORA beverages within the boundaries of the DORA The Depot DORA will be open and operational from 4:00 p.m. until 11:00 p.m. on Thursdays, Fridays, and Saturdays. The boundaries of the Depot DORA can be seen on the map along with the locations of businesses permitted to serve alcoholic beverages. The boundaries of the Depot DORA will be well -marked with signage explaining what the DORA is as well as signs warning people when they are about to leave the DORA. To participate in the DORA, merchants must have a permit to sell alcoholic beverages from the Indiana Alcohol and Tobacco Commission, complete an application and file it with the Richmond Department of Infrastructure & Development, and furnish annual certificates of insurance naming the City of Richmond as an additional insured, Thank you, Dave Snow Mayor of Richmond
