HomeMy Public PortalAboutResolution 2011-07-01 Approving the Application of U 9200 Entertainment, Inc., DBA Grand Park Bowl and Cinema, for a New Tavern LicenseTOWN OF FRASER RESOLUTION NO. 2011-07-01 A RESOLUTION OF THE FRASER BOARD OF TRUSTEES, ACTING AS THE LOCAL LIQUOR LICENSING AUTHORITY FOR THE TOWN OF FRASER, APPROVING THE APPLICATION OF U 9200 ENTERTAINMENT, INC., D /B /A GRAND PARK BOWL AND CINEMA, FOR A NEW TAVERN LICENSE FOR THE PREMISES AT 22 SECOND STREET, FRASER, COLORADO. WHEREAS, U 9200 Entertainment, Inc., d/b /a Grand Park Bowl and Cinema (the "Applicant filed an application with the Town of Fraser for a new tavern license to for the premises located at 22 Second Street, Fraser, Colorado; and WHEREAS, a public hearing on said application was held on July 6, 2011, following due and proper notice, in accordance with the Colorado Liquor Code, C.R.S. 12 -47 -101 et seq.; and WHEREAS, the Board of Trustees, as the Local Liquor Licensing Authority, has carefully considered said application and the evidence presented at the hearing, and hereby enters the following decision regarding the application. THE BOARD OF TRUSTEES MAKES THE FOLLOWING FINDINGS: 1. There has not been a denial of an application at the same location by either the State or the Local Licensing Authority within the two (2) years preceding the date of the application for the reason that the reasonable requirements of the neighborhood were satisfied by the existing outlets. 2. The Applicant has submitted evidence that it is or will be entitled to possession of the premises where the license is proposed to be exercised. 3. The premises are properly zoned for the activity which will occur therein, and the Town of Fraser has eliminated the 500 -foot minimum distance requirement for licensed premises separation from any public or parochial school or the principal campus of any college, university or seminary. 4. The Applicant has demonstrated by a preponderance of the evidence that the reasonable requirements of the neighborhood and the desires of the adult inhabitants of the neighborhood are not currently being met by existing outlets. BASED UPON THESE FINDINGS, THE BOARD OF TRUSTEES, AS THE LOCAL LICENSING AUTHORITY, HEREBY ORDERS that the application of U 9200 Entertainment, Inc., d/b /a Grand Park Bowl and Cinema, for a new tavern license for the premises at 22 Second Street, Fraser, Colorado, be and is hereby APPROVED, subject to, and conditioned upon the Town Clerk's receipt of a favorable report from the Colorado Bureau of Investigation on the Applicant's background.
