APPROVING THE RENEWAL OF PLENARY RETAIL CONSUMPTiON
LIQUOR LICENSE NO. 1201 -33 -043 -003 FOR THE 2017 -2018 LICENSE TERM
PURSUANT TO A SPECIAL RULING GRANTING N.J.S.A. 33:1-12.18 & 12.39
RELIEF
WHEREAS. a Verified Petition was filed the Ne\N Jersey Division of Alcoholic
Be erage Control for a Special Ruling pursuant to the provision's of N..I.S.A. 33: 1 -12.18
requesting authorization for the Borough of Carteret Alcoholic Beverage Control Board
( "ABC Board "). the local issuing authority. to consider the renewal of Plenar\ Retail
Consumption Liquor License No. 1201 -33- 043 -003 ("License ") for the 2017 -2018
license term by way of the issuance of a " new" license therefore upon the failure to file
timer renewal applications for the aforesaid license terms. and further. for relief pursuant
to N.J.S.A. 33: 1 -12.39 to subsequently consider the renewal of the subject License for
the 2017- 2018.2018 -2019 & 2019 -2020 license terms in its inactive state: and
WHEREAS. according to the Director's Special Ruling. dated Ma\ 23. 2018. the .ABC
Board has been authorized to consider the application for a new license for the aboxe
License upon the failure to file timeh renews for the 2017 -2018 license term. and
thereupon to grant or den said application in the reasonable exercise of its discretion. all
in accordance with the provisions of N.J.S.A. 33: 1- 12.18: and
WHEREAS. further. in accordance with the Director's Special Ruling. relief was also
granted pursuant to N.J.S.A. 33:1 - 12.39. authorizing the ABC Board to subsequentl
consider an application for renewal of the subject License for the 2017 -2018. 2018 -2019
& 2019 -2020 license terms. in its inacti\ e state. should the Borough act to approve the
application for a new License pursuant to the relief granted b t he Director under
N.J.S.A. 33:1-12.18.
WHEREAS, all of the requirements for the .ABC Board to properh consider the above
actions. including the publication requirements set forth in N.J.A.C. 13:2 -1.5 with regard
to the application for the "new ` License as set forth in the Directors Special Ruling. have
been satisfied.
NOW, THEREFORE, BE IT RESOLVED b\ the Alcoholic BeN erage Control Board
of the Borough of Carteret. County of Middlesex. State of New JerseN. as follows:
1. That the rene\aal of Plenar\ Retail Consumption Liquor License
No. 1201 -33 -043 -003 is hereby appro\ed for the 2017 -2018 license
renewal tern hN way of the issuance of a "new" license therefore. as
authorized pursuant to the NJ.S.A. 33: 1 -12.18 Special Ruling relief
granted by the Director on May 23. 2018.
2. That. lurther. upon the renewal of Plenar\ Retail Consumption
Liquor License No. 1201 -33- 043 -003 for the 2017 -2018 license tern as
aforesaid. the renewal of the subject License for the 2017 -2018 license
term. in its inactiN e state. in hereby appro\ ed. in accordance with the
N.J.S.A. 33:1 -12.39 reliel'pro\ ided for in the Director's Special Ruling.
3. That the ABC Board Clerk he and is herebN authorized and
directed to issue an A.B.C. License Renewal fir PlenarN Retail
Consumption Liquor License No. 1201 -33- 043 - O03 for the 2017 -2018
license term bN wad of the issuance of a new License therefore. and to
issue the said renewal for the 2017 -2018 license term. in its inactive state.
