APPROVING THE RENEWAL OF PLENARY RETAIL CONSUMPTION
LIQUOR LICENSE NO. 1201 -33 -043 -003 FOR THE 2018 -2019 LICENSE TER:17,
IN ITS INACTIVE STATE, PURSUANT TO A SPECIAL RULING GRANTING
N.J.S.A. 33:1-12.39 RELIEF
WHEREAS. a Verified Petition was filed the Ne1N Jersey Division of Alcoholic
Beverage Control for a Special Ruling pursuant to the provisions of N.J.S.A. 33: 1 -12.39
requesting authorization for the Borough of Carteret Alcoholic BeN erage Control Board
("ABC Board"). the local issuing authorit\. to consider the renewal of Plenary Retail
Consumption Liquor License No. 1201 -33- 043 -003 ("License") for the 2018 -2019
license terra. in its inacti\e state. pursuant to N.J.S.A. ' 33: 1 -12.39 relief being requested
by v. of application for a Special Ruling regarding the same: and
WHEREAS. according to the Director's Special Ruling. dated Ma 23. 2018. the ABC
Board has also been authorized to consider the application for a new license for the above
License upon the failure to file timely renews firr the 2017 -2018 license term. and
thereupon to grant or deny said application in the reasonable exercise of its discretion. all
in accordance with the provisions of N.J.S.A. 33: 1- 13.18: and
WHEREAS. further. in accordance with the Director's Special Ruling. relief was so
granted pursuant to N.J.S.A. 33:1 - 12.39, authorizing the ABC Board to consider an
application for renewal of the subject License for the 3017 -3018. 2018 -2019 & 2019-
3020 license terms. in its inactive state. should the Borough act to approve the application
for a ne License pursuant to the relief granted by the Director under N.J.S.A. 33:1-
12.18.
WHEREAS, all of the requirements for the .ABC Board to proper]\ consider the above
actions. including the publication requirements set forth in N..I.A.C. 13:2 -1.5 with regard
to the application for the "new ' License as set forth in the Director's Special Ruling. have
been satisfied.
NOW, THEREFORE, BE IT RESOLVED b\ the Alcoholic Beverage Control Board
of the Borough of Carteret. County of Middlesex. State of New Jersey. as follows:
1. That the renewal of Plenar} Retail Consumption Liquor License
No. 1201 -33- 043 -003 is herebN approved for the 2018 -2019 license
renewal term. in its inactive state. in accordance with the N.J.S.A. 33:1-
1 2.39 relief provided for in the Director's Special Ruling of klay 23.2018.
2. That the ABC Board Clerk be and is hereb\ authorized and
directed to issue an A.B.C. License Renewal for Plenar\ Retail
Consumption Liquor License No. 1201 - - 043 - 003 for the 2018 - 2019
license tern. in its inactive state. Special Ruling relief having been so
granted therefore. and ABC Board having concurrently granted the
renewal of said license. by wa\ of the issuance of a new license therefore
for the 2017 -2018 license term in accordance with the N.J.S.A. 33: 1-
12.18 Special Ruling relief having similarly been so granted.
