AT LARGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, The Town Commission hereby finds that in the event of a disaster occurring in the Town of Gulf Stream, a public health and safety threat may result from the generation of widespread debris throughout the Town, that such debris constitutes a hazardous environment for all modes of movement and transportation of the residents, as well as emergency aid and relief services, endangerment to all properties in the Town, an environment conducive to breeding disease and vermin, and greatly incre_,7Serl rick r)f firra and that it iC in 4— pub! : - in+.,, mss+ to ilcc4 _d _ . . -- .. - r- *_ .." -: � ti.. l,Vll'J l..l .' C7 UiJGJiCI debris from all properties whether public lands and public roads or private roads to eliminate an immediate threat to life, public health and safety, to reduce the threat of additional damage to improved property and to promote economic recovery of the community at large; and WHEREAS, it is the intent of this ordinance to promote the health, welfare and safety of the residents of the Town by providing for the collection and removal of disaster debris throughout the Town, including all public roads, public areas and private roads to eliminate an immediate threat to the life, public health and safety of the residents of the To%, -n NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The Town Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 18, Emergency Systems, to create a new Article III, titled Post Disaster Debris Recovery, to read as follows: 1 "ARTICLE III. Post Disaster Debris Recovery Sec. 18 -60. When a local state of emergency has been declared, either by declaration of the Governor or by the Mayor or by the Mayor's designee, the Town shall have the authority, in addition to its authority to clear public rights -of -way, to clear private roads in the Town of debris so as to protect the community at large and so as to promote economic recovery of the community at large. Sec. 8 -61. A declaration of emergency necessary to provide for the clearing of private roads as referenced herein shall be in the manner as provided by state law." Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. G-11 arr 1 i.. a e^ conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
