HomeMy Public PortalAboutAddendum No. 1 to Contract No. 168-2023 - Code Enforcement - S&M Home Solutions - Clean Up - 118 North 17th Street • ADDENDUM THIS ADDENDUM, (NumbeT) to Contract No. 168-2023) is made and entered into this — day of IV/2' 20,4'3 by and between Richmond, Indiana, a municipal corporation acting through its Board of Public Works and Safety with its office at 50 North 5th Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and S&M Home Solutions, EEC, 124 South 9th Street, Richmond, Indiana, 47374 (hereinafter referred to as"Contractor"). WHEREAS, City and Contractor entered into Contract No. 168-2023 on October 12, 2023, which Agreement retains Contractor to provide services in connection with the cleanup of a premises previously deemed by the City of Richmond Unsafe Building Commission to be noncompliant, located at 118 North I 7th Street, in Richmond, Indiana("Project"); and WHEREAS, The Parties have agreed that due to continuous enforcement permitted by IC 36-7-9-1 et seq., E,..r1 d due to the need for additional emergency abatement permitted by IC 36-7-9-9, additional services should therefore he performed by Contractor. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: 1. The City and Contractor executed and entered into Contract No. 168-2023, on October 12, 2023, which Agreement is incorporated herein by reference, Pursuant to Contract No. 168-2023, Section XI (Miscellaneous), the Parties may alter or amend the Agreement in whole or in part at any time by filing with the Agreement a written instrument setting forth such changes signed by both Parties, 'I he Parties agree the that Contractor shall provide services of additional emergency demolition and cleanup of the garage premises locatc.1 at 1714 North "E" Street in accordance with the scope of said Agreement, clue to a fire which occurred at said garage and the resulting and anticipated collapse of the same. Said additional services shall be completed and performed in a manner consistent with Contract No. 168-2023, which is hereby incorporated by reference and made a part hereof.. Compensation paid to Contractor as described in accordance with Section III (Compensation) of said Agreement for said additional work shall be increased by an amount not to exceed One Thousand Seven Hundred Fifty Dollars and Zero Cents ($1,750.00) as listed in Contractor's supplemental quote attached hereto as Exhibit A. The new total amount to be paid to Contractor under the Agreement shall be an amount not tp exceed Two Thousand Eight Hundred Fifty Dollars and Zero Cents ($2,850.00) for satisfactory completion of the Agreement with the additional services as described herein. 2. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 168-2023, shall he applicable to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number I, in which case this Addeldum Number 1 shall be controlling. Addendum No. 1 to Contract No. 168-2023 Page I of 2 3, Both Parties hereby agree that with the exception of the additional emergency demolition of the garage and cleanup of the premises, and with the exception of the corresponding compensation increase, Contract No. 168-2023 shall remain intact and unchanged and in full force and effect. 4. Both Parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum.
