Brothers, Inc., in the amount of $55,230.00 for the Carteret Park Tennis & Basketball Court Repairs Project; and WHEREAS, the Borough's Director of Engineering has advised the Governing Body that a modification to the contract is reasonable and necessary and has recommended that the aforesaid contract be modified in accordance with Change Order #1, attached hereto; and WHEREAS, Change Order #1 includes additional crack repairs needed to complete the project and; WHEREAS, Change Order 41 provides for a net increase in the contract price in the amount of $1,812.52, resulting in a revised contract price of $57,042.52, including all change orders to date; and WHEREAS, the Borough's Director of Engineering, has advised that the above described changes and /or modifications to the project were unforeseen at the time of the award of the original contract. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Carteret, County of Middlesex, State of New Jersey as follows: 1. That Change Order #1, attached hereto and made a part hereof, providing for a net increase of $1,812.52 in the overall contract price, resulting in a revised total contract price of $57,042.52 including any modifications to the original contract price in accordance with any and all previously approved change orders, is hereby approved. 2. That the appropriate Borough officials are hereby authorized and directed to execute Change Order #1 (See Attached). 3. That a copy of this Resolution and a fully executed copy of Change Order #1 be forwarded to the Borough's Director of Engineering, the Borough's Purchasing Department and S. Brothers, Inc.
