Cc: Gregory Dunham; Rita Taylor Subject: Special Exception Floor Area Ratio -- remodel question Skip, I had a question about a previously approved home that was granted a special exception under GS Code Sec 70-72 Special Exception Floor Area Ratio (b) for an extra 300 square feet that exceeds the maximum permitted FAR that is covered and unenclosed. The owner/applicant wants to demolish part of the constructed covered, unenclosed area covered by the previously granted special exception and reconstruct it in a different area, covered and unenclosed and still exceeding the maximum permitted FAR — but not seeking any additional FAR that was not approved previously. The GS code reads as follows: (b) Roof projections. Up to 300 square feet of roof projections (covered, unenclosed floor areas) may exceed the maximum permissible FAR subject to the following: (1) Maximum floor area. The maximum floor area in excess of FAR is 300 square feet . One or more roof projections may be approved under this special ex ceptio n provided the total floor area of all projections does not exceed the maximum permitted FAR, by more than 300 square feet. (2) Specific standards for review. a. The roof projection(s) shall be compatible and complementary to the architecture of the structure and shall add appropriate architectural detail and relief to a facade. b. The roof projection(s) shall not make the structure look more massive. c. The total floor area of the roof projections shall not exceed the maximum permissible FAR by more than 300 square feet. d. For each one square foot of roof projection over the maximum permissible FAR, two square feet of roof projection must be provided that are within the maximum permissible FAR, and all shall remain forever unenclosed. e. Prior to the issuance of a certificate of occupancy or certificate of completion, the owner of the property shall prepare and record a deed restriction which, at a minimum, shall provide that all roof projection areas required to remain unenclosed as per approval of this special exception shall remain so for as long as the structure is in existence or exceeds the maximum permissible FAR. Because the code specifically provides for the new covered area to be "compatible and complimentary" to the architecture of the structure, and further must "not make the structure look more massive" I am of the opinion that adjusting the portions of the home that were covered by this special exception will require the same analysis to be 1 performed by its very nature, and the applicant would therefore need seek approval for this special exception again to perform this work . This question is important because if the application includes a special exception, it would be a level 3 with review done by the Town Commission as opposed to a Level 2, with review by the ARPB only .
