AN ORDINANCE OF THE TOWN
COMMISSION OF THE TOWN OF GULF
STREAM, PAL M BEACH COUNTY, FLORIDA,
AMENDING THE TOWN CODE OF
ORDINANCES AT CHAPTER 22,
NUISANCES; ARTICLE I, IN GENERAL;
SECTION 22-1 LITTER, TO PROHIBIT THE
PLACEMENT OF BULK OR VEGETATIVE
DEBRIS FOR COLLECTION EXCEPT FOR 24
HOURS PRIOR TO PICKUP AND TO
REQUIRE VEGETATIVE DEBRIS INCIDENT
TO LAWN MAINTENANCE BE REMOVED THE
SAME DAY IT IS CREATED OR
ACCUMULATED; PROVIDING FOR REPEAL
OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, the Town Commission of the Town of Gulf Stream contracts with a waste
hauling company that provides for back door/side door garbage collection, which makes
it unnecessary for Town residents to place their garbage cans curbside for collection; and
WHEREAS, an informal Town policy requires landscape maintenance companies and
others providing landscape services in the Town to haul away vegetative debris
generated by the landscape maintenance to a property; and
WHEREAS, the back door/side door garbage collection paired with the informal policy
requiring that landscape mainte nance companies haul away vegetative debris they
generate while working in Town combines to keep the streets of the Town clear of
obstacles to pedestrian and vehicle traffic, and contributes to the natural beauty of the
Town; and
WHEREAS, the Town's waste hauling company provides bulk trash pickup only one day
per week; and
WHEREAS, the Town has grown increasingly concerned about landscape maintenance
companies that leave piles of vegetative debris throughout the week until it is picked up
by the waste hauling company during its weekly pickup; and
WHEREAS, the proliferation of these piles of vegetative debris during the week detracts
from the Town's charm and beauty; and
WHEREAS, the Town Commission wishes to codify the informal Town policy that requires
landscape maintenance companies and others to haul away vegetation generated by the
landscape maintenance they perform to a property to further the objectives of safer and
more beautiful streets, while limiting the duration the same vegetative debris can be
placed for collection by persons or property owners residing in Town; and
WHEREAS, the Town Commission of the Town of Gulf Stream finds that enacting these
regulations will benefit the health, safety, and welfare of the Town and its Residents.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS
Section 1. The Code of Ordinances of the Town of Gulf Stream is her eby
amended at Chapter 22, Nuisances; Article I, in General; Section 22-1 — Litter, to read
as follows:
Sec. 22-1. - Litter.
(a) It shall be unlawful for any person to throw or discard from any
automobile or vehicle, or otherwise to discard, throw or deposit any refuse,
rubbish, trash, paper, bottles, cans, boxes or other containers, or any other
thing or substance whatever, on a street, road or highway in the town or on
the property adjoining such street, road or highway . This shall not apply to
persons or property owners residing in the Town when depositing trash or
rubbish in a proper place for collection.
(b) It shall be unlawful for any person to throw or discard any filth, dirt,
garbage, shells, trash or refuse or other thing in the waters of the
Intracoastal Waterway (ICWW), in any canal, or the Atlantic Ocean, or in
waters within the town limits or adjacent to the town limits. This section shall
apply to residents of the town, visitors or boaters.
(c) This section shall not apply to per sons or property owners resid ing in
the to wn whe n depositing trash or rubbish in a proper place for collection.
Trash for bulk pickup, including vegetative debris generated by the person
or property owner residing in the Town, may be placed on the public right-
of-way, adjacent to the property from which it came, not more than one day
prior to the scheduled day of collection.
(d) It shall be the responsibility of all individuals and business entities who
engage in the business of lawn or garden care for hire within the Town to
remove from the Town all accumulations of grass, tree or shrubbery cuttings
and all other vegetative debris incident to their maintenance of lawns,
shrubberies and tre es on the same calendar day that said waste is created
or accumulated.
Section 2. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 3. Codification.
This O rdinance shall be codified and made a part of the official Code of Ordinances
of the Town of Gulf Stream.

Section 4. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law .
