KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Chairman Smith called the meeting to order at 8:30 A.M. II. Minutes of the Regular Meeting and Public Hearing of 2-24-2022 Board Member Dockerty made a motion to approve the minutes of the February 24, 2022, meeting. Board Member Smith seconded the motion with all voting AYE at roll call. IV. Additions, withdrawals, deferrals, arrangement of agenda items There were none. V. Announcements. A. Meeting Dates 1. Chairman Smith called attention to the upcoming meeting dates. Board Member Smith noted that she would not be available for the May 26, 2022, meeting. VI. PUBLIC HEARING. A. Declaration of Ex-Parte Communication There was none. B. Administer Oaths Town Clerk Taylor swore in Mr. Tom Murphy, Mr. Mark Marsh, Mr. Cory Meyer, Mr. Scott Heynen, Mrs. Anne Marcus, Mr. Patrick O'Connell, Mr. Steve Streit, Mr. Dan Carter, and Mr. Ryan Howard. Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. C. Applications for Development Approval 1. An application submitted by T. N. Murphy, Esq., Agent for Hunter J. Smith, Trustee of the Fourth Amended and Restated Hunter J. Smith Living Trust U/A/P 12/29/16, the owners of property located at 1919 N. Ocean Blvd., Gulf Stream, Florida, which is legally described as Lot 1, William H. Evans Subdivision, Town of Gulf Stream, as Recorded in Plat Book 53, Page 48, Public Records in and for Palm Beach County, Florida. a. VARIANCE to permit installation below the 1978 Coastal Construction Control Line, of approximately 250 ft. of 5 ft. high, black aluminum picket perimeter fencing, for the existing two story, single-family residence. Mr. Mark Marsh, Architect, explained the location and what they were looking to do with fencing the area. He then turned it over to Mr. Tom Murphy who gave a legal description of why they felt they met the criteria for the variance. They both explained the major reason for the fencing was for security and the property was wide open to the golf club as well as the beach area. Chairman Smith asked if they were going to tie in to the Orthwein's fencing on the south side and if they were going to take down the white picket fencing that was already in place, to which Mr. Murphy answered in the affirmative to both questions. Board Member Dockerty asked if the sea grape was cut regularly, to which Mr. Murphy answered in the affirmative. Vice Chairman Murphy questioned the height if security was the main thrust, to which Mr. Marsh answered the fence would have spikes on the top and it was basically a deterrent and a sense of security for Mrs. Smith. Chairman Smith was concerned that it didn't meet all criteria for the variance and if it would set a precedent for other beachfront homeowners. Vice Chairman Murphy was concerned about number two in the criteria. Alternate Board Member Canfield was also concerned about setting a precedent and wondered if the board would begin seeing one of these types of applications every month because everyone on the beach could say they needed a fence for security reasons. Mr. Marsh reminded the board that a fence was allowed, but it would be right in the middle of the lawn, interrupting the serenity, thus the need for the variance. Mr. Murphy questioned why fences weren't included in the Code and thought it was inconsistent. Chairman Smith answered that it could have been an oversight, but he couldn't give an explanation as to why fences weren't included. Board Member Dockerty made a motion to recommend approval of a variance from the provisions in Section 70-74 and 70-187 (7) to allow the installation of approximately 250 ft. of 5 ft. high, black aluminum picket perimeter fencing on top of the existing seawall, which is east of the Coastal Construction Control Line. Vice Chairman Murphy seconded the motion with all voting AYE at roll call. 2. An application submitted by M. Mark Marsh of Bridges, E Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. Marsh & Associates as Agent for 3032 Gulf Stream Land Trust, the Owners of property located at 3032 Gulf Stream Road, Gulf Stream, Florida, which is legally described as Lot 18 Gulf Stream Properties, Palm Beach County, Florida. a. LEVEL 2 ARCHITECTURAL/SITE PLAN REVIEW to permit the addition of a single car garage & driveway to existing residence, a 15 sq. ft. foyer over front door and a replacement of asphalt roof with a slate tile roof. Mr. Mark Marsh, Architect, gave a detailed PowerPoint presentation representing Mr. and Mrs. Holding, wanting to add at least a single car garage to the existing house did not presently have one. He stated that the original survey was incorrect, and they found that they had an additional six feet on the east side to work with. Mr. Marsh added they would be adding a foyer over the front door and replacing the shingle roof with a slate the roof. Mr. Marsh stated they were replacing a ficus hedge with a clusia hedge and replacing a kidney -shaped pool in the back with a rectangular pool and adding a gazebo trellis -like structure. He added everything that was being done was just a refresher to this quaint cottage. Board Member Dockerty made a motion to approve a Level II Architectural/Site Plan Review to permit the addition of a new single - car garage and driveway to an existing residence, a 15 sq. ft. foyer over the front door and the replacement of the asphalt shingle roof with a slate tile roof. 3. An application submitted by M. Mark Marsh of Bridges, Marsh, and Associates as Agent for 14 Driftwood Landing Revocable Trust, the owners of property located at 14 Driftwood Landing, Gulf Stream, Florida which is legally Described as Lot 2, Driftwood Landing as recorded in Plat Book 30, Pages 211 & 232 of the Public Records of Palm Beach County Florida. a. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the construction of a single family, partial two story, 6,677 sq. ft. Cape Dutch dwelling with attached two - car garage, and a swimming pool. Mr. Mark Marsh, Architect, gave a detailed PowerPoint presentation on this unique vacant lot. He stated the house being built was predominantly a single -story with a two-story area on the extreme north. Mr. Marsh noted that the owners didn't want to disturb the natural beauty of the area, but it was having to be raised approximately four ft. per FEMA requirements. He stated this was a Cape Dutch -style home and wanted to keep it as authentic as possible, dove -white in color with a clay tile roof in burnt orange, which he noted was different from what the plans stated. Mr. Cory Meyer, Landscape Architect, gave a detailed presentation of the landscaping on the property that would be a lush, tropical mixture of vegetation. 3 Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. Chairman Smith stated that the Town had received an e-mail from a neighbor regarding the south side of the house requesting more vegetation and screening, as they did not want to be looking straight into the bedroom from the front of their home. Chairman Smith asked if the owners would be willing to put more vegetation and screening on the south side to which Mr. Marsh stated they would speak with the owners regarding this issue. Vice Chairman Murphy asked if there were any other comments from neighbors to which Town Clerk Taylor answered that there were none. Chairman Smith asked how high the wall was going to be between this property and the Templeton property to which Town Manager Dunham stated the maximum was six feet. Chairman Smith pointed out that the town was opposed to two-story flat walls, so he suggested an architectural element be added to the garage wall. Vice Chairman Murphy made a motion to recommend approval of a Level III Architectural/Site Plan to permit the construction of a single -story and partial two-story, 6,074 sq. ft. Cape Dutch single-family dwelling with garage and swimming pool. 1. Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. 2. The applicant needs to address the points made in the e-mail from the neighbors on the south side regarding more screening as well as add an architectural element to the garage wall. Board Member Dockerty seconded the motion with all voting AYE at roll call. 4. An application submitted by Scott Heynen, as Agent for Anne and Paul Marcus, owners of the property located at 1224 N. Ocean Blvd., Gulf Stream, Florida which is legally described as 1224 N. Ocean Blvd, Delray Beach, Florida, Lot 5 of Hidden Harbor Estates, Plat 2 according to the Plat thereof, as recorded in Plat Book 115, Page(s) 173 of the Public Records of Palm Beach County and a perpetual easement over that certain 15-foot strip of land from Ocean Boulevard to the Atlantic Ocean, being the South 15 foot of Lot 7, Block D and Block E, Palm Beach Shore Acres (Ocean Boulevard Estates), according to the Plat thereof, as recorded in Plat Book 7, Page 38, of the Public Records of Palm Beach County Florida. a. DEMOLITION PERMIT to remove certain existing walls and driveways to accommodate the new structures. b. LEVEL 2 ARCHITECTURAL/SITE PLAN REVIEW to permit construction of 716" wall with 8' columns along State Road AlA and 516" walls with 6' columns On the north and west sides of the property. Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. The driveway on the north side will also be re- constructed. Mrs. Anne Marcus, Town resident and owner of 1224 N. Ocean Blvd., explained that they were seeking the changes for noise and safety issues, adding they had an adult son with disabilities. Mr. Scott Heynen, Landscape Architect, gave a detailed presentation of the changes wanting to be made and landscaping to be done. Board Member Dockerty asked if there was a wall on the south property line to which Mr. Heynen stated there was only a chain -link fence and heavily landscaped hedge. Vice Chairman Murphy asked if there had been any feedback from the neighbors to which Town Clerk Taylor answered there had been no feedback. Vice Chairman Murphy made a motion to approve a Demolition Permit to remove certain existing walls and driveways to accommodate the new structures. Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. Vice Chairman Murphy made a motion to approve a North Ocean Boulevard Overlay Permit to construct a 716" wall with 8' columns along State Road AlA. Board Member Dockerty seconded the motion with all voting AYE at roll call. Vice Chairman Murphy made a motion to approve a Level II Architectural/Site Plan Review to permit the construction of a 7161, wall with 8' columns along State Road AlA and 516" walls with 6' columns on the north and west sides of the property and to reconstruct the driveway on the north side. Board Member Dockerty seconded the motion with all voting AYE at roll call. Vice Chairman Murphy made a motion to approve the landscaping presented with the following condition: 1. Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. Vice Chairman Murphy excused himself from the meeting at 10:02 A.M. 5. An application submitted by Agent Patrick Ryan O'Connell for Stephen & Jennifer Streit, the owners of the property located at 590 Wright way, legally described as Sections 3 & 7, Township 46 South, Range 43 east, Palm Beach County, Florida, recorded in ORB 27602, Pg. 1775. a. SPECIAL EXCEPTION to allow the addition of 20 sq. ft. of covered entry. b. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW covering the covered front entry, remodeling the existing swimming pool, upgrading the hardscape, and adding new landscaping. 5 Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. Mr. Patrick O'Connell, Architect, gave a detailed PowerPoint presentation after Mr. Stephen Streit, Town resident and owner of 590 Wright Way, introduced himself to the Board, explaining they just wanted to make enhancements to an already beautiful house. Mr. O'Connell stated they would be replacing all the windows and doors, removing the coins and make some cosmetic improvements, as well as some landscape renovations and renovations to the existing pool. The 20 sq. ft. of covered entry was to get rid of the flat face on the front two-story wall, he added. Mr. O'Connell stated they would be replacing the aluminum gutters and downspouts with copper and replacing the roof with white flat tile. Chairman Smith asked if the shutters on the front were decorative or operable to which Mr. O'Connell stated they would be operable and added they did, however, remove the shutters from the back windows. Board Member Dockerty made a motion to recommend approval of a Special Exception to allow the addition of 20 sq. ft. of covered entry that exceeds the maximum permitted FAR. Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. Board Member Dockerty made a motion to recommend approval of a Level III Architectural/Site Plan to permit the renovation of the exterior of an existing two-story house including replacing doors, windows, roof, a new covered entry feature, other cosmetic improvements, landscape renovations and renovations to the existing pool with the following condition: 1.Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. 6. An application submitted by Agent Dan Carter for Ryan Howard and Bridget Nolan, owners of the property located at 578 Palm Way, Gulf Stream, Florida, legally described as Plat Book 24, Page 73, Polo Cove. a. SPECIAL EXCEPTION to construct a 564 sq. ft. Pergola Open Air with 10 ft. rear setback. b. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to replace 2 awnings with 1 Pergola & 1 cantilevered awning over pool terrace and re -landscaping. Mr. Ryan Howard, Town resident and owner of 578 Palm Way, introduced himself and explained how they have been slowly making improvements over the last six years that they have lived in Gulf Stream. He added that they were wanting to replace two vinyl awnings in the back yard with open-air pergola structures to add light and get rid of the dampness the awnings cause. He then turned it over to Mr. Dan Carter, Landscape Architect, who explained how the pergola worked 1.1 Minutes of ARPB Meeting & Public Hearing Held 3-24-2022 @ 8:30 A.M. electronically and manually. Mr. Carter stated they were adding deck area but were within the square footage allowed. He wasn't sure of the material yet, but stated he would bring it in for approval from the Town Staff before proceeding. Chairman Smith asked what color the pergola was going to be to which Mr. Howard answered that it would be white. Board Member Dockerty made a motion to approve a Special Exception to permit the rear setback to be loft., as provided in Sec. 70-75(e). Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. Board Member Dockerty made a motion to approve a Level III Architectural/Site Plan to permit the renovation of the pool terrace and upgrade existing landscaping and materials with the following condition: 1.Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modifications shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Alternate Board Member Canfield seconded the motion with all voting AYE at roll call. 7. Continued Consideration Tara Eidelson, as Agent of an application submitted by for Stewart Eidelson, the owner of property located at 920 Indigo Point, Gulf Stream, Florida, which is legally described as Lot 67, Place Au Soleil. a. Demolition Permit to remove existing decorative fagade items, round columns, and existing railings. b. Level 2 Architectural/Site Plan Review to permit construction of new decorative fagade items, square balcony and trellis columns, and new balcony railings. Town Manager Dunham stated the applicant had asked to defer her application once again to another meeting because they had changed architects.
