RESOLUTION AUTHORIZING CERTAIN LEGAL, AUDITING AND
ENGINEERING SERVICES ADOPTED BY THE BOROUGH COUNCIL
OF THE BOROUGH OF CARTERET
WHEREAS, there exists a need for specialized legal, auditing and engineering
services in connection with the possible privatization of the Borough of Carteret's
(the "Borough") Sewer System (the "System"); and
WHEREAS, such special services can be provided by those firms identified
below;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the
Borough of Carteret as follows:
Craig J. Coughlin, Esq., Iselin, New Jersey is hereby retained to provide
the specialized general counsel services necessary in connection with the
possible privatization of the Borough's system in accordance with the
existing contract with the Borough at the hourly rates set forth in the
existing contract with the Borough (Initial Budget: $5,000).
The law firm of McManimon & Scotland, L.L.C., Newark, New Jersey is
hereby retained to provide the specialized legal services necessary in
connection with the possible privatization of the Borough's System in
accordance with the existing contract with the Borough at the hourly rates
set forth in the existing contract with the Borough (Initial Budget:
$30,000).
The firm of Lerch, Vinci & Higgins, Fair Lawn, New Jersey is hereby
retained to provide the specialized auditing services necessary in
connection with the authorization and the possible privatization of the
Borough's System in accordance with the existing contract with the
Borough at the hourly rates set forth in the existing contract with the
Borough (Initial Budget: $30,000).
The firm of Killam Associates, Whitehouse, New Jersey is hereby retained
to provide the specialized engineering services necessary in connection
with the possible privatization of the Borough's System in accordance
with the existing contract with the Borough at the hourly rates set forth in
the existing contract with the Borough (Initial Budget: $10,000).
The services are awarded without competitive bidding as "Professional
Services" in accordance with the Local Public Contracts Law, N.J.S.A.
40A: 11-5(1)(a).
The working group is hereby directed to seek reimbursement for their
costs from the successful vendor.

A copy of this resolution shall be placed on file with the Clerk of the
Borough of Carteret.
A notice in accordance with the Local Public Contracts Law of New
Jersey shall be published to the extent required by such law.
