COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA
ORDINANCE NO. 41-2023
A SPECIAL ORDINANCE DESIGNATING A I)ORA NO. 1 AS "DEPOT DORA"
PURSUANT TO RICHMOND CITY CODE CHAPTER 63
WHEREAS, On .q,-5 , 2023, the Common Council ("Council") of the City
/
of Richmond, Indiana ("City") passed an establishment ordinance, see Ordinance
No. i _a -2023, containing certain findings in order to set up state and local
requirements and guidelines to be incorporated into Richmond City Code Chapter
63 for the lawful establishment of up to seven mapped areas within the City which
may be approved by local ordinance to be a "Designated Outdoor Refreshment
Area" also known as a "DORA" pursuant to Indiana Code (IC) 7.1-3-31; and
WHEREAS, The DORA Act authorizes licensed retailer permittecs to apply for designation with
both the Indiana Alcohol and Tobacco Commission and the City in order for the
potential permittees to be considered for participation in any designated
refreshment area(s) established within the City; and
WHEREAS, In order to support investment, growth, walkability, vendor flexibility, recreation,
patrons, economic boost, customer spending, overall revenue, collaboration, and
downtown vitality, it would be in the best interest of the citizens of the City to
designate the City's first DORA area to be known as I)ORA No. 1 and specifically
named "Depot DORA" as set forth herein.
NOW THEREFORE. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA, that the above preambles to this designation ordinance are incorporated
as findings into this ordinance and any approved applicants who are permitted to participate in said
DORA No. 1, specifically to be known as the "Depot DORA" are subject to this designation
ordinance, the DORA Act, the City's establishing ordinance (Ord. lf_e2 -2023), Richmond City
Code Chapter 63, and all other applicable federal, state, or local laws.
NOW THEREFORE. BE IT ALSO ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF RICHMOND, INDIANA, that the following requirements are adopted for said Depot DORA:
SECTION 1 A map of the Depot DORA is attached hereto and incorporated by reference as
Exhibit A.
SECTION 2 The boundaries of the Depot Dora are as follows and shall specifically exclude the
named streets or other markers unless otherwise specifically included: starting at the south-west
corner of North D Street and Fort Wayne Avenue; thence north-east to Neff Street, thence north-
west for three-quarters of a block along Neff Street; thence north-east; thence south-east for three-
quarters of a block along Neff Street so that Neff Street is included within said boundaries; thence
north-east along Fort Wayne Avenue until North 8th Street so that said portion of Fort Wayne
Avenue is included within said boundaries; thence north to the corner edge of the adjacent parking
lot.; thence east crossing North 801 Street along the Norfolk Southern Railroad tracks (excluding
said tracks) to North 1.0th Street; thence south to the north-east corner of the intersection of North
E and North 10th; thence south-west to the north-east corner of the block to the south of North E;
thence South along North 10th Street to North D Street; thence west along North D Street to the
place of beginning.
SECTION 3 The locations and addresses of the proposed designated permittees and vendors
within the Depot DORA are included in the map attached as Exhibit A.
SECTION 4 The Depot DORA is consistent with the City's Unified Development Ordinance.
SECTION 5 The number, spacing, and type of signage designating the .Depot DORA is attached
hereto and incorporated by reference as Exhibit B.
SECTION 6 The dates and hours of operation for the Depot DORA shall be limited as described
in Richmond City Code Chapter 63, which times of operations are also not to be in violation of IC
7.1.-3-1-14 as amended from time to time. Specifically the Depot DORA will be permitted to be
open and operational from 4:00 p.m. until 1. 1:00 p.m. on Thursdays, Fridays, and Saturdays. The
Depot DORA is not permitted to be open on any other days and times.
SECTION 7 All additional optional provisions regarding the operation of the DORA described
in Chapter 63 shall be and are required within the Depot DORA.

SECTION 8 This designation ordinance for the Depot I)ORA may be dissolved at any time by
a dissolution ordinance adopted by the Richmond Common Council. The establishing ordinance
creating Richmond City Code Chapter 63 is also incorporated herein by reference as if fully set
forth herein.
Passed and adopted by the Common Council of the City of Richmond, Indiana, this ir day
