If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by 6119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by 6119.07(1)(f) of the Florida Statutes. Please take note of 4119.07(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed. "I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If the public records being sought are maintained by your agency in an electronic format please produce the records in the original electronic format in which they were created or received. See 4119.01(2)(f), Florida Statutes. If you anticipate the production of these public records to exceed $1.00 please notify me in advance of their production with a written estimate of the total cost.Please be sure to itemize any estimates so as to indicate the total number of pages and/or records, as well as to distinguish the cost of labor and materials. Dear Chris O'Hare [mailto:chrisoharegulfstream@gmail.com], Thank you for your public records request dated November 2, 2013 that we acknowledged on November 3, 2013. The actual cost of production for the requested documents will exceed $1. In reviewing your request, the Town of Gulf Stream has already determined that it will take more than 15 minutes to find and produce all documents that may be fully responsive to your request. Your various requests have forced the Town of Gulf Stream to engage in extensive use of information technology, staff, and financial resources. The Town notes that this is one of more than 400 public records requests filed by you since September 2013, and the Town staff has already spent more than 200 hours, without recovery of costs, responding to those requests. The Town further notes after spending this time and money to acquire the public records you previously requested, you have not picked up the responsive documents. The Town will not proceed with further production of public records in response to this request until you pay a deposit of $16.29, which represents 30 minutes of staff time calculated at a rate of $32.57/hour, per Fla. Stat. § 119.07 (4)(d). Once the Town has received your deposit, staff will undertake further process, and your deposit will be applied to the staff time and costs incurred. If the documents can be obtained and produced within 30 minutes, and at a cost lower than the deposit, they will be promptly provided to you, with a partial refund of your deposit based on the actual cost of production. If the documents cannot be obtained within 30 minutes, or otherwise produced for a cost less than the deposit, the Town will send you a letter with an estimate for the actual cost of production, and require an additional deposit. We will apply staff time to the deposit and fulfilling your request.
