Dear Council Member,
Ordinance No. 2-2024 is a district ordinance and establishment plan for a Planned Development across five
properties currently addressed 0 South 371h Street (Parcel IDS: 891802300102006030, 891802300102005030,
891802300102007030, 891802300102001030, 891802300102008030; LEGAL DESCRIPTIONS: PT NW
SEC 2-13-1 1.184A PT SW SEC 2-13-1 9.256A, PT SW SEC 2-13-1 21.405 A, PT SW SEC 2-13-1 2.560A,
PT SW SEC 2-13-1 5.006A, PT SW SEC 2-13-1 40.210A). The proposed Planned Development would
allow the creation of a mixed -residential neighborhood project. The petitioner, 1 lth Street Development,
LLC, is requesting that the development's current base zoning district of Medium Density Single-family
Residential (R2) be changed to a combination of sub -districts within the development whose base zoning
districts would become Medium Density Single-family Residential (R2), High Density Single-family
Residential (R3), Urban Residential (UR), and Intense Multi -family Residential (M2) respectively. This
means that, if approved, the above zoning districts' development standards (UDO — Article 5) will apply to
their assigned sub -districts within the Planned Development, with some exceptions that are indicated in
Sections 5-8 of the district ordinance draft included in your packet.
The sub -districts within the proposed Planned Development represent five different housing types, identified
in the petition as Custom Homes, Sunrise Homes, Brookside Homes, Cottages or Courtyard Villas, and
Apartments. Conceptual representations of the style and design of each of these housing types is included in
your packet as Exhibit D. In total, the project proposes 178 new single-family units and an undetermined
number of multi -family units (250 max).
Planned developments are guided by the UDO's Article 4: Planned Development District (attached) and
Article 9: Processes (Section 9.09-9.12). There are three phases to a planned development; a (1) district
ordinance and establishment plan, (2) detailed development plan, and a (3) final development plan. A district
ordinance and establishment plan is similar to a zoning map amendment, where the ordinance goes before
Plan Commission for a public hearing and recommendation to Common Council before Council makes the
final determination. A detailed development plan mirrors the primary plat process, where the application
goes before Plan Commission for a public hearing and final decision, but does not go in front of Common
Council. Finally, a final development plan is like a secondary plat application, which goes before Plan
Commission for review and approval, but does not require a public hearing.
This ordinance is respectfully requested to be referred to the Richmond Advisory Plan Commission for
public hearing at its meeting on Wednesday, January 24, 2024.
