Thank you for your time yesterday.
This confirms our request to withdraw Variance Application #22-11 for the 5' wide by 20' long timber dock at the east
end of Bluewater Cove that was to be situated between Lots 7 and 8.
Regarding the private walkway between Lots 7 and 8, at the appropriate time, and if we still want to include this feature
in the project, we would then request a Level 1 staff approval for a private walkway and gate to the ICW seawall
between Lots 7 and 8. In that regard, as we discussed, attached is a copy of the final plat showing Tract "D" between
Lots 7 and 8, which is dedicated to the Bluewater Cove HOA and subject to a general utility easement.

Discussion:
The applicant is seeking relief from various provisions of the Town Code Section 66-369. Docks.
which states in part as follows:
Permitted as accessory use. Docks shall be permitted only as an accessory use to single-family dwellings for the
exclusive use of the dwelling's occupants (residents and nonresident members of the occupant's family and
resident guests at the dwelling). Docks shall not be permitted on vacant lots unless the vacant lot is adjacent to
a developed lot under the same ownership and a unity of title has been recorded.
The dock proposed by the applicant is to serve as an observation platform owned and maintained by
the Bluewater Cove association, and not as an accessory use to any one single-family dwelling, but
many. Further, it is constructed on land that does not have a single-family dwelling, and does not
meet the setback requirements.
The Gulf Stream Code sets forth procedures and standards for the ARPB and the Town Commission
to review and approve, approve with conditions, or deny applications for variances. Variances are
deviations from the terms of this Code that would not be contrary to the public interest when owing
to special circumstances or conditions, or when the literal enforcement of the provisions of this Code
would result in undue and unnecessary hardship.
When making a recommendation on this application for a variance, the ARPB must find that:

1. Special conditions and circumstances exist which are peculiar to the land, structure, or building
involved and which are not applicable to other lands, structures, or buildings in the same zoning
district.
2. The special conditions and circumstances do not result from the actions of the applicant.
3. Granting the variance requested will not confer on the applicant any special privilege that is
denied by this code to other lands, buildings, or structures in the same zoning district.
4. Literal interpretation of the provisions of this Code would deprive the applicant of rights
commonly enjoyed by other properties in the same zoning district under the terms of this Code
and would work unnecessary and undue hardship on the applicant.
5. The variance granted is the minimum variance that will make possible the reasonable use of the
land, building or structure.
6. Granting the variance would not permit to be established or re-established any use prohibited in
that zoning district.
7. Granting the variance is consistent with the goals, objectives and policies and future land use map
of the adopted comprehensive plan.
8. Granting the variance will be in harmony with the general intent and purpose of the Code and
that such variance will not be injurious to the area involved or otherwise detrimental to the public
welfare.
These are the criteria the applicant is required to address.
The ARPB shall hear, review, and consider this application for a variance and recommend one of the
following actions to the Town Commission:
1. Grant the application in full.
2. Deny the application in full.
3. Grant the application in part.
4. Grant a modification of the application in such form as the Town Commission deems proper and
consistent with the variance standards.
5. Establish such conditions as the ARPB deems necessary to ensure conformance with the variance
standards.
6. Return the application to a recommending review authority or applicant with specific instructions
as to additional information, evidence, or testimony desired in order to make a decision consistent
with the variance standards.
7. Continue the consideration of the application to a time certain.

Projects Requiring a Variance Community Dock
IV.G.1. From what specific Zoning Code regulation is a variance requested?
Sec. 66-369 (2): Docks are permitted as accessory use.
IV.G.2. What does the Zoning Code require for this specific site?
Docks shall be permitted only as an accessory use to single-family dwellings for the exclusive use of
the dwelling's occupants (residents and nonresident members of the occupant's family and resident
guests at the dwelling). Docks shall not be permitted on vacant lots unless the vacant lot is adjacent to
a developed lot under the same ownership and a unity of title has been recorded.
IV.G.3. What is proposed?
As a community amenity for the 12 interior lot owners, we are proposing an observation platform
extending 5' east of the seawall, for a width of 20', which will connect to the paver sidewalk that extends
east of the cul-de-sac roadway. The platform can be used for observation and fishing. No boat docking
will be allowed. The Bluewater Cove Homeowners Declaration governing this amenity are as follows:
1. Community Walkway & Waterfront Platform. The Community Walkway & Waterfront
Platform identified on the Plat as Tract "D", including any walkway, seawall, pilings, equipment,
installations, or improvements thereon, lying between and contiguous to Lots 7 and Lot 8, are Community
Property, and, as such shall be maintained, repaired, replaced, insured, administered, and regulated by the
Association in all respects.
(a) Owner or Owner's guests, tenants, invitees shall: (i) use the Community Walkway
& Waterfront Platform in a responsible, courteous manner, considerate of others and adjacent Lot Owners;
and (ii) remove all personal property from the Community Walkway & Waterfront Platform after use.
(b) All uses of the Community Walkway & Waterfront Platform shall be in accordance
with all local, state, and federal government permits, approvals, and governmental conditions. No
alterations or additions to the Community Walkway or Waterfront Platform, including, without limitation,
the installation of any davits, hoists, or other improvements, shall be made.
(c) The Association shall promulgate rules from time -to -time regulating the time the
Community Walkway & Waterfront Platform may be used for such things as hours of use.
IV.G.4. What is the total variance requested?
A 20' wide community platform/dock adjacent to community (common) property, to be used as an
accessory to use to community (common) property rather than as an accessory use to a single-family
dwelling for the exclusive use of the dwelling's occupants (residents and nonresident members of the
occupant's family and resident guests at the dwelling).
IV.G.5.(1). What specific conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not applicable to other lands, structures, or
buildings in the same district?
The proposed amenity could only exist in a new subdivision with adequate waterfront area to situate
such an improvement. Moreover, the amenity is intended to benefit the 12 interior lot owners. Within
the Place au Soleil District, indeed all of Gulf Stream, there exists no other similar undeveloped,
unsubdivided, property, as all waterfront land is privately owned. The likelihood of this request being
duplicated anywhere in the town of Gulf Stream is highly unlikely, but if similar conditions did somehow
exist, a similar analysis could be fairly applied.

applicant? Yes
IV.G.5.(3). Will granting the variance confer upon the applicant any special privilege that is

Within the Place au Soleil District, indeed all of Gulf Stream, there exists no other similar undeveloped,
unsubdivided, property, as all waterfront land is privately owned. The likelihood of this request being
duplicated anywhere in the town of Gulf Stream is highly unlikely, but if similar conditions did somehow
exist, a similar analysis could be fairly applied.
IV.G.5.(4). How would a literal interpretation of the provisions of the Zoning Ordinance deprive
the applicant of rights, commonly enjoyed by other properties in the same zoning district under
the same terms of the ordinance and work unnecessary hardship on the applicant?
Because the proposed improvement is an accessory use to community (common) property rather than
privately owned lot/dwelling, a literal interpretation does not allow such an improvement to be built
anywhere in the same district. However, as stated previously, this is a unique request in that the
underlying conditions that make the proposed improvement possible, do not exist anywhere in the
district.
IV.G.5.(5). Is the Variance requested the minimum variance that makes possible the
reasonable use of the land, building, or structure?
Yes. In this case, the proposed improvement is only 5' deep and 20' wide. The 5' depth complies with
the maximum dock depth. The proposed width conforms to the common property area, and any
significant narrowing of the proposed width would render the proposed improvement obsolete.
IV.G.5.(6). Will granting the variance permit any prohibited use to be established or re-
established? No.
IV.G.5.(7). Is the requested variance consistent with the goals, policies, and objectives of the
future Land Use Map and Comprehensive Plan? Yes.
IV.G.5.(8). Will the variance be in harmony with the general intent and purpose of the Zoning
Ordinance and not be injurious to the area involved or otherwise detrimental to the public
welfare?
Zoning ordinances are, in part, intended to protect, preserve, and enhance the quality of life of Gulf
Stream residents. The proposed amenity will allow property owners within the new community, that
would otherwise have no water access, to enjoy views of the Intracoastal Waterway. The activities that
will be allowed on the proposed improvement are, in many ways, far more restrictive than activities
currently allowed on privately owned docks. Moreover, the adjacent property owners most impacted by
the proposed improvement would have full disclosure as to its existence.
