HomeMy Public PortalAbout27 Amend Conflict Interest CodeTown of Truckee California RESOLUTION NO. 97-27 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE AMENDING THE CONFLICT OF INTEREST CODE APPENDIX FOR DESIGNATED EMPLOYEES WItEREAS, the Town of Truckee is required by law to adopted a Conflict of Interest Code for designated employees as required by the Political Refom~ Act, Government Code Sections 8 ! 000 et seq; and WHEREAS, the Fair Political Practices Commission had adopted a regulation, 2 Cal. Code of Regulations Section 18730, which contains the terms of a standard model Conflict of Interest Code, which can be incorporated by reference, and which will be amended to conform to amendments in the Political Reform Act after public notice and hearings conducted by the Fair Political Practices Commission pursuant to the Administrative Procedure Act, Government Code Section 11370, et seq; and WHEREAS, the attached Appendix accurately sets forth those positions which should be designated and the categories of financial interests which should be made reportable; NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, as follows: The terms of 2 Cal. Code of Regulations Section 18730 and any amendments to it duly adopted by the Fair Political Practices Commission along with the attached Appendix in which officials and employees are designated and disclosure categories are set forth, are hereby incorporated ;by reference and constitute the Conflict of Interest Code of the following departments and agencies: Town Manager Personnel Director Town Attorney Town Clerk Public Works Engineering Administrative Services Planning Building and Safety Planning Commission Police Persons holding designated positions shall file a Statement of Economic Interest pursuant to the Conflict of Interest Code, and all designated persons shall file their Statement with the Town Clerk to whom the Town Council hereby designates the authority to carry out the duties of filing officer. Town of Truckee Resolution Page 2 APPENDIX TO RESOLUTION 97-27 AMENDING CONFLICT OF INTEREST CODE All persons holding the hereafter named designations shall file a "Statement of Economic Interests for Designated Employees" (FPPC Form 700) for each Disclosure Category being all of A-Investments (less than 10%), A-2 Investments (greater than 10%), B-Interests in Real Property, C-Income & Business Positions, D-Income - Loans, E-Income-Gifts, F-Income-Travel Payments, G-Business, as set forth after the named designation. The economic interest to be disclosed for each disclosure category shall be: (1) being or doing business within the geographical jurisdiction or service area of Town; and/or (2) is such a kind or economic interest which the employee foreseeably can affect in a material way through the conduct or operation of such employee's office with the Town. Town of Truckee Resolution Page 3 The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town of Truckee, held on the 7th day of July, 1997, by Councilmember Carpenter who moved its adoption, which motion being duly seconded by Councilmember Susman was upon roll call carried and the Resolution passed by the following vote: AYES: Councilmembers Carpenter, Florian, McCormack, Susman & Mayor Drake NOES: None ABSENT: None Robert W. Drake, Mayor
