HomeMy Public PortalAbout06-15-2023 THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JUNE 15, 2023 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5:00 P.M., in the Council Chambers in the Municipal Building, 50 North 5th Street, Richmond, Indiana. CALL TO ORDER President Robinson called the meeting to order and the following business was conducted: ROLL CALL Board members present were: Vicki Robinson, Emily Palmer and Matt Evans. Also in attendance were Kim Vessels, Assistant City Attorney; Monica Burns, Deputy City Clerk; Lieutenant Kevin Smith; Greg Shells, Director of Public Works and Engineering; Police Chief Mike Britt; Cedric James, Code Enforcement; Desiree Durbin, Animal Control Officer; Kimberly Philips; and Media. APPROVAL OF MINUTES Ms. Palmer moved to approve the minutes of June 8, 2023, supported by Mr. Evans. Upon a vote viva voce, the motion carried. CLAIMS FOR PAYMENT Mr. Evans moved to approve the Claims for Payment for June 1.6, 2023 in the amount of Three Hundred Ninety Three Thousand Three Hundred Twenty Nine and twenty nine cents ($393,329.29), supported by Ms. Palmer. Upon a vote viva voce, the motion carried. PAYROLL CLAIMS FOR PAYMENT Mr. Evans moved to approve the Payroll Claims for Payment for June 16, 2023 in the amount of Nine Hundred Thirteen Thousand Eight Hundred Forty Six and fifty four cents ($913,846.54), supported by Ms. Palmer. Upon a vote viva voce, the motion carried. Mr. Evans moved to approve a Special Payroll Claims for Payment in the amount of Three Hundred Eighty Four Dollars and no cents ($384.00), supported by Ms. Palmer. Upon a vote viva voce, the motion carried. Upon a vote viva voce, the motion carried. • STREET CLOSURES li).ScR Hideaway Customer Appreciation Day The request is .for the closure of Elm Street from the 900 block alley to the underpass on. August 12, 2023 from 10:00 a.m. to 11:30 p.m. Lieutenant Kevin Smith told the Board that he would talk to INDOT to find out if there were any plans for construction work being done in that area during that time. Ms. Palmer moved to approve, supported by Mr. Evans. Upon a vote viva voce, the motion. carried. VFW Annual Car Show On July 1, 20 the request is for closure of the 200 block alley between South gth and 9'1' Streets from 8:00 a.m. to 2:00 p.m. Also asking for barricades be delivered to them on Friday like in years past. Mr. Evans moved to approve, supported by Ms. Palmer. Upon a vote viva.voce, the motion carried. Main Street Richmond Car Show On Saturday, June 17, 2023 with a rain date of June 24, 2023 from 8:00 a.m. to 5:00 p.m. The request is for the closure oflOth Street from North"A" Street to South"A" Street. The intersection of 10'1' and Main Street will remain open. This will give the participants plenty of time to set up and tear down. There will also be a DJ so they are also asking for a Noise Variance. Board of Works Minutes June 15, 2023 Ms. Palmer moved to approve, supported by Mr. Evans. Wayne County Commissioners Mary Anne Butters —Liaison to the Fair Board The request is .for the closure of Salisbury Road at the Fairgrounds property to NW "L" Street on June 23, 2023, starting at approximately 9:50 p.m. and ending at about 10:20 p.m. for a fireworks show. Mr. Evans moved to approve, supported by Ms. Palmer. Upon a vote viva voce, the motion carried. BID OPENINGS - None BID AWARDS - None CONTRACTS • CONTRACT NO. 67-2023 —CLARK DIETZ The City hereby retains Contractor to provide professional services for the design (drawings and specifications,) of a North 9th Street park plaza adjacent to Elm Place and North F. Street The Project shall include, but shall not be limited to the development of pre-construction drawings, conceptual site plan/layout, preliminary plans for site, lighting, electric, specifications, cost estimates, final construction plans, fielding construction questions, and facilitating two (2) shareholder meetings. The plaza design is procured in part to develop open-air public gathering spaces outdoors due to the impact of COVID-19 restrictions upon the community. This Contract is to replace previously approved, Contract No. 18-2022, so the Board is also asked to rescind that contract. Not to exceed $40,000.00 Ms. Palmer moved to rescind Contract No. 18-2022, supported by Mr. Evans. Upon a vote viva voce, the motion carried Ms. Palmer moved to approve Contract No. 67-2023, supported by Mr. Evans. Upon a vote viva voce, the motion carried. • CONTRACT NO. 118-2023 — INDOT This is a matching grant agreement for Community Crossings where the City was awarded $699,727.44. These funds will be used to pay for 50% of the cost to rehabilitate (28) sections of roads totaling 3.4 miles within the City. This contract was electronically signed by Emily Palmer due to the 48 hour deadline for signing that was placed on this offer by the State. The Board previously voted on allowing her to sign these type of contracts electronically. Board of Works Minutes June 15, 2023 Mr. Evans moved to approve, supported by Ms. Palmer. Upon a vote viva voce, the motion carried. • CONTRACT NO. 11.9-2023 — FLETCHER CHRYSLER DODGE JEEP RAM The City retains Contractor to furnish four (4) 2023 Police Pursuit 3.6L V6 AWD Dodge Charger Vehicles with the selected options, including,but not limited to floor carpet,power heated mirrors, cloth front/rear vinyl seats, side spot lamps, and extra non-key alike fobs for the Police Department. Not to exceed $139,81.2.00 Ms. Palmer moved to approve, supported by Mr. Evans. Upon a vote viva voce, the motion. carried. • CONTRACT NO. 1.21-2023 —MILESTONE CONTRACTORS, L.P. The City retains Contractor to perform services in connection with street rehabilitation for approximately twenty-eight (28) roads or road areas which are designated as a part of the Community Crossings Streets Project (2023-1) for the City. Not to exceed $1,374,060.90 Mr. Evans moved to approve, supported by Ms. Palmer. Upon a vote viva voce, the motion carried. • CONTRACT.NO. 123-2023 —REDDOG ENTERPRISES INC. The City retains Contractor to provide services in connection with the emergency securing, cleanup of premises, and sealing and boarding of structures located at 148 SW 13th Street. Not to exceed $620.00 Ms. Palmer moved to approve, supported by Mr. Evans. Upon a vote viva voce, the motion carried. • CONTRACT NO. 1.24-2023 —B&B CONSTRUCTION OF RICHMONI), .INC The City retains Contractor to perform services in connection with the demolition of certain structures previously deemed by the Richmond Unsafe Building Commission to be unsafe, the garage located at 221. Lincoln Street. Services shall include demolition, removal of debris, and restoration of the site. Not to exceed $3,000.00 Mr. Evans moved to approve, supported by Ms. Palmer. Upon a vote viva voce, the motion. carried. • CONTRACT NO. .1.25-2023 —MIk..ESELL EXCAVATION, INC. Board of Works Minutes June 15, 2023 The City retains Contractor to perform services in connection with the demolition of certain structures previDusly deemed by the Richmond Unsafe Building Commission to be unsafe, the garage located at. 109 Lincoln Street. Services shall include demolition, removal of debris, and restoration of.the site. Not to exceed $3,000.00 Ms. Palmer moved to approve, supported by Mr. Evans. CHANGE ORDERS - None ADDENDUMS - None RESOLUTIONS - None PETITIONS —None Ms. Robinson recessed the meeting for fifteen minutes before beginning with the Vicious Dog Hearing. After the recess Ms. Robinson brought the meeting back to order. MISCELLANEOUS • HEARING ON VICIOUS DOG. Dakota Lee Mills and Kimberly G. Phillips The Deputy Clerk swore in Lieutenant Kevin Smith and Animal Control Officer Desiree Durbin. Kimberly Phillips, owner of the property where the bite occurred and the grandmother of Dakota Mills who was the owner of the dog, left the meeting before the hearing convened. Lieutenant Kevin Smith made his presentation to the Board. On May 12, 2023 at approximately 2:36 p.m., Animal Control Officer Durbin responded to Reid Health in reference to a reported dog bite. Initial information came from the reporting person, Angela Dawson. Vicky Allen, Dawson's daughter, had been bitten by two dogs at 743 Richmond Avenue, Richmond, Indiana. The exact time that the incident occurred could not be determined; however, it was determined that the incident occurred prior to 11:30 a.m. Upon Durbin's arrival at Reid Health, she spoke with Vicky Allen and found that her injuries had already been treated by Emergency Room staff Allen stated that she was visiting a friend that lives at 743 Richmond Avenue. She knocked on the door of home„the Board of Works Minutes June 15, 2023 dogs pushed the storm door open and began attacking her. She said that she knew the dogs were aggressive and they were usually placed in the fenced backyard before anyone came over. She had a puncture wound on her left wrist, a bite on her left calve, and multiple punctures and tearing of the skin on her right arm. Animal Control Officer Durbin took digital photos of the treated injuries. Officer Durbin provided photos of the injuries from Angela Dawson (mother of victim) that showed wounds prior to medical treatment. Those photos are inckided in the information report 4RP23-011.07. Animal Control Officer Durbin later spoke with the animal owner, Dakota Mills. He stated that the male Pit Bull dog, Little Feller, had bitten Allen. He also stated that he had to pick the dog up to krep him from continuing to bite Allen. Mills denied that his second clog was involved in the attack of Allen. Officer Durbin said that she was unable to verify if the second dog wxi involved or not. Durbin inspected the vaccination records for the Pit Bull. The records stated that the dog had been vaccinated on January 24, 2023 for rabies. She then placed the animal on a 10 day home quarantine. The quarantine guidelines were explained to Mills. Mills informed Officer Durbin that he had already set a date for the dog to be euthanized by the animal's veterinarian, Greensfork Animal Hospital. Officer Durbin was able to verify that there was an appointment at Greensfork. Animal Hospital for May 22, 2023 for the animal to be euthanized later in the day. Animal Control Officer Durbin conducted a follow-up on the 10-day quarantine on May 22, 2023. She was unable to get anyone to answer the door at the residence. Durbin was able to make phone contact with the homeowner, Kimberly Phillips, grandmother to Mills. Phillips stated that the animal was showing no signs of rabies. She also told Officer Durbin that the appointment for the euthanasia had been cancelled due to the 'family wanting to spend more time with the dog. In accordance with the Codified City Ordinances of the City of Richmond 91.1.5 Dangerous/Vicious Dogs, the Richmond Police Department has initiated an investigation to determine the Pit Bull, Little Feller, is a Dangerous/Vicious dog.. Lieutenant Kevin Smith asked Animal Control Officer Desiree Durbin several questions to verify the everts mentioned above. It was the recommendation of Lieutenant Kevin Smith of the Richmond Police Department that the Board find that Pit Bull, Little Feller, is a Vicious and Dangerous dog. Ms. Palmer moved to accept the recommendation of the Richmond Police Department that the animal be deemed a vicious dog and being so .subject to the automatic provisions of the Richmond City Code, supported by Mr. Evans. Upon a vote viva voce, the motion carried. Kim Vessels, the Assistant City .Attorney explained that the plaintiff according to Code 91.15 had 20 calendar days to appeal the ruling. Under the same code they have 7 days to comply with the requirements that have to be met if they intend to keep the dog. The meeting wes then closed.
