ROLL CALL AND CALL TO, ORDER Chair Grote called the meeting to order at 7:43 p.m. Committee members Coyle, Ware, and Killen answered the roll call:. Chair declared a quorum present. Also attending was City Manager Shimun. II. MEETING MINUTES - SEPTEMBER 19, 1994 Killen moved to accept the minutes as written. `'i``Ware '.g6CO ded and the motion carried. III. MEETING MINUTES - OCTOBER 24, 1994 Coyle moved to accept the minutes as written. Killen seconded and the motion carried. IV. REPORTS Ware reported on the first meeting of the Winter ReCreation Taskforce. They are currently working on the ice skating rink. They discussed snowmobiling and other areas of interest. V. NEW BUSINESS a. None VI. OLD BUSINESS a. Landing and launching of water craft in City parks. Killen moved and Coyle supported to request that City Council direct Attorney Burton to research the provisions of the no wake ordinance and report. back to P&R. The motion carried. * * * * * b. Alcohol in City parks. Killen moved to request that City Council direct Attorney ***** Burton to draft a revision to current City code to allow consumption of beer and wine in the City's parks, with the following conditions: 1. Anything keg size (2 1/2 gallons or more) will require a City permit, ranging in costfrom $50 to $150, depending upon the'size of the group. 2. Allowed only during regular'Park hours, with the possible exception of the Fourth of July. Grote supported and the motion carried. F.... c. Park Maintenance Contract. A number of questions regarding the contract were discussed. The Committee concluded that any adjustment in job requirements or pay for Baker would be up to the City Manager. d. Parks Catalog. Ware moved to recommend that City Council approve production of a Parks catalog to solicit donations for various Parks and Recreation projects listed in their Master Plan. it should include a breakdown for donations and be produced by mid December. Killen supported and the motion carried. e. Gravel Pit Resource Update. A report by Toothman-Orton Engineers was reviewed. f. Idaho Community Foundation Update. Staff was directed to determine the potential uses of the $500 grant that may be received by the City. g. Third Street Easement City Staff was directed to research any easement agreement at the end of Third Street, determine its provisions, and have them enforced. VII. JOINT POWER AGREEMENT REPORT City Manager Shimun briefed the Committee on the status of the agreement. He discussed a meeting that Les Ankenman and he had attended in Boise with the Local Roads Office of the Idaho Department of Transportation (IDT). IDT indicated that the Joint Powers Board could select a consultant by going through the RFP process, or it could choose a consultant from the State's "short list" (a list of State pre -approved consultants) and begin negotiating a contract. Ankenman and Shimun discussed the situation and determined that the fastest avenue would be to choose a consultant from the short list. They selected Toothman-Orton Engineering. VIII. OTHER BUSINESS Staff was directed to have "no snow boarding" and "no snowmobiling" signs placed around Legacy Park. IX. ADJOURNMENT Coyle moved and Ware supported to adjourn. The motion The meeting concluded at 8:58 p.m. Tomi Grote, Chairperson Gary Spmun, Acting Secretary *t*** LANDING AND LAUNCHING OF WATER CRAFT IN CITY PARKS NOVEMBER 9, 1994 Attorney Burton's schedule of events: 1. Parks and Recreation recommends Council request Attorney write ordinance, Attorney writes ordinance, Parks and Recreation reviews ordinance, recommends council adopt ordinance, council adopts ordinance and it becomes effective upon posting of area by Public Works. 2. Questions which should be addressed in recommendation to council: a. Types of watercraft? Be specific. b. Overnight use? c. Commercial or non-commercial use? d. Length of time vehicle can be docked? 3. Attorney suggest committee be very specific in what types of activities are appropriate vs. not appropriate. ex; If a water taxi business comes up should it be allowed? Can jet ski rental businesses have rental watercraft at the beach all day? Can a person come from another location, beach, go to lunch, shopping, business meeting, ect.? Can non-profit classes(kayak club) all beach at the same time? 4. Sample recommendation; moved to recommend council direct Attorney to draft a new parks ordinance allowing landing and launching of motorized watercraft registered as P.W.C.(personal water craft) and nonmotorized watercraft, North of Legacy Park's dock and South of the public boat ramps. Furthermore, allowing the landing and launching of nonmotorized watercraft in Rotary Park, West of the swim area. Landing and launching will be allowed from Sunrise to Sunset and the vehicle cannot be beached for more than one hour at a time. Effective after the areas have been posted by Public works in the spring of 1995. Seconded by and the motion carried. ALCOHOL IN CITY PARKS RESEARCH 1994 1. KETCHUM, ID. Legal in all city parks. Softball park sells beer. No problems. 2. PARK CITY, UTAH. Legal in all city parks. Kegs illegal. No problems. 3. JACKSON HOLE, WY. Legal in all city parks, except town square. Open container law in effect outside of parks. No problems. 4. ASPEN, CO. illegal in all city parks, open container law. Up to 6 years ago legal. Parks department did not request outlawing it. Easier to clean up after 4th of July holiday now. 5. COEUR D' ALENE, ID. Illegal in all city parks. 6. SANDPOINT, ID. Illegal in all city parks including softball fields. 7. MOSCOW, ID. Illegal for last ten years. Don't know reason why it was made illegal. Legal in city center with caterer who has liqueur license. 8. NAMPA, ID. Illegal unless accompanied by caterer w/liqueur license 9. BOISE, ID. Legal in all city parks except; a. Band Shell area in Julie Davis Park(permitted with a caterer). b. Capitol to American green belt portion. 10. LEWISTON, ID. illegal in all City parks up to five years ago. Parks department lobbied to legalize alcohol, police perceived lots of problems and lobbied for it to remain illegal. Council legalized alcohol in three city parks(main picnic parks) by permit, issued from city hall. To receive permit must leave a damage deposit which starts at $50.00 and goes to $150.00 depending upon number of people. In last five years there has never been a problem and every damage deposit has been returned. Parks department felt there were far more problems perceived, than existed and stated the bottom line was, "the police had more bullets in their gun than needed". Currently lobbying for legalization in all parks. 11. WEISER, ID. Legal in all city parks, but not the sale of it. Recreation Department currently trying to get permission to sell beer. Problems with night vandalism, mostly by migrant farm workers and council is currently looking at making it illegal to consume alcohol in city parks. PROPOSAL - ROUGH COPY RECREATION AND PARKS DEPARTMENT RESPONSIBILITIES The Recreation and Parks Director will be in charge of the Parks Budget, and any additional Parks Personnel. Do weekly Park inspections and attend all Parks and Recreation Advisory Committee meetings. FAIRWAY PARK: Lawn care including mowing, watering and fertilizing. GARBAGE: The parks personnel will empty all trash containers daily in each park and shall deposit such litter at designated locations within the city limits. LITTER: The parks personnel shall police every park and beach and make sure that litter, cigarettes, broken glass and trash is not evident at any time. Once each month, each beach will be raked to remove broken glass and cigarette butts, flotsam and jetsam and all litter left on beach. In the event that a illegal fire is started in the beach sand, the parks personnel will remove all sand, ash and unburned materials and return the beach to an unblemished condition. This treatment will apply to all graveled areas, dirt surfaces and other unplanted areas. RESTROOM CLEANING: The parks personnel will clean public restrooms at Legacy, Mill, Davis, Fairway and Rotary parks each day and place an adequate supply of paper products in the receptacles for the public's use. This shall be done before 9am on Saturdays and Sundays. On any three day holiday weekend these restrooms will be cleaned twice each day, once before 9a.m. and once after 3p.m. Paper products will be purchased by the Recreation and Parks Director and a log of use will be kept. SWEEPING OF IMPERVIOUS SURFACES: A11 asphalt and concrete walkways, sidewalks, steps, parking lots, bike paths and approach areas shall be swept as needed. PAINTING: The Parks Department will maintain all picnic tables and benches in good repair, repainting as necessary and will regularly inspect these furnishings and will do what's necessary to remove graffiti or other minor vandalism, VANDALISM AND GRAFFITI CONTROL: The parks personnel will be responsible for removing graffiti with chemical solvents, paint, or sanding from interior and exterior walls, sidewalks, tables or other surfaces within 24 hours of the defacing. The parks personnel will repair any damage to toilets, sinks, pipes, asphalt, fences, recreational equipment or facilities. Serious vandalism shall be immediately reported to the Police Department and the parks personnel shall immediately close the area or building with signs and keep the public out of the crime scene until police investigators arrive. MAJOR REPAIRS, CONSTRUCTION, & EQUIPMENT: When such needs arise, the Recreation and Parks Director will fill out work order forms and turn them into the Public Works Department. RECREATION DEPARTMENT'S CURRENT PARKS RESPONSIBILITIES: Attending all Parks and Recreation Advisory Conunittee meetings, Parks budget work/review with P. & R. Committee, yearly parks tours, placing/retrieving swim buoys at Legacy Park, Research on Parks for P. & R. Committee(Alcohol in city parks, concessions in parks, playground specification research, ect.), the park reservation program, R.F.P. writing, grant writing, and the installation/removal of tennis, volleyball, and basketball nets. All maintenance of Fairway Park. RESPONSIBILITIES THAT SHOULD REMAIN WITII THE PUBLIC WORKS DEPARTMENT DUE TO SEASONAL LIMITATIONS OF THE RECREATION AND PARKS DEPARTMENT:. *Swim buoy installation/removal at Rotary, Legacy, and Davis Beach. *Turning on/off and flushing of sprinkler systems. REQUEST FOR PROPOSALS The City of McCall is accepting proposals for: MAINTENANCE OF CITY PARKS The park maintenance contractor will provide service to McCall City Parks, May 1, 1995 -- September 30, 1995. Proposals shall be submitted on forms provided by the City. Proposals submitted in any other format shall be regarded as nonresponsive and will not be considered. Interested persons may obtain proposal forms at McCall City Hall or by calling 208-634-7142 during normal business hours. proposals shall be clearly marked and addressed as follows: McCall City Park Maintenance Proposal City of McCall Attn. City Clerk 216 E. Park Street P.O. Sox 1065 McCall,Id. 83638 Original proposals must be forwarded so as to arrive at McCall City Hall at the above address no later than 5:00pm, April 7, 1995. SCHEDULE "A" BIDDING REQUIREMENTS The successful bidder will be expected to provide payment and performance bonds, or an irrevocable letter of credit cashable by city on demand through a commercial bank doing business in the fourth judicial district of Idaho, in either case in an amount acceptable to the City Manager, but not less than the amount of the bid; and in either case in form and substance approved by the City Attorney. SCOPE OF WORK LABOR: The contractor will hire, supervise, and fire all employees required to perform the work under this contract. A police records check of the contractor and of all employees will be required and any person who, in the judgement of the City based upon a criminal history or current investigation, presents a threat to the public safety will not be employed by the contractor. The contractor will provide workmen's compensation insurance for all employees and provide proof of such coverage to the city. The contractor will ensure that all personal safety equipment is used by employees at all times and will provide the same to employees, such as hard hats and safety glasses. The contractor will provide all vehicles, equipment and tools required to perform the work under this contract save and except for specialized tools required for unique tasks. The contractor will keep all vehicles and equipment in good repair and will keep any and all safety equipment on all such equipment in place and operable. The contractor will provide automobile liability insurance on equipment in place and operable. The contractor will provide automobile liability insurance on any vehicle used in the performance of the contract which will travel on across any public street or highway and provide proof of the same to the City. The contractor will provide all fuel for the operation of vehicles, and equipment. WORK LOCATIONS: *Davis Beach There will be no contractor responsibilities at this site as there are no lawns or gardens. *Community Park Duties include, everything listed in scope of work and work to be performed. The site has underground sprinklers on a timing system. Lawn areas are small, garden area is large. *Legacy Park Duties include everything listed in scope of work and work to be performed. Underground sprinkler systems are on automatic timers. Lawn areas are large. *Mill Park Duties include everything listed in scope of work and work to be performed. Underground sprinkler systems are on automatic timers. Lawn areas are large. *Art Roberts Park Duties include, everything listed in work to be performed. The site has underground sprinklers on a timing system. Lawn areas are large. *Rotary Park Duties include everything listed in work to be performed. Lawn area its small, but must be hand watered. Contractor will discuss maintenance plan with the McCall Rotary Club to avoid duplication of effort. *Fairway Park Duties include everything listed in scope of work and work to be performed except mowing, watering and fertilizing of lawn areas. * Greenspaces Airport along Highway 55; City Hall and Library lawns; Central District Health area; Fire Station planter, walkway between Legacy and Mill Parks, grassed area on the old depot site at the East end of Lenora St. Duties include everything listed in scope of work and work to be performed. WORK TO BE PERFORMED: MOWING: Grass at each site will be mowed weekly. The mowing routine shall include removal of excess grass clippings by raking and shall include sweeping sidewalks, parking areas and other areas where clippings may be left from mowing. Mowing will not be done at any park site between 4pm on Friday afternoon and lam on Monday morning. Every effort will be made by the contractor to avoid mowing Legacy Park in the afternoon, when the park is at it's highest use. Mowing shall include the weed eating or trimming of all areas of turf not done by mowing and Shall be done to the same height as the grass is cut. Contractor will check all lawn areas for thatch and will dethatch lawns when the thatch layer exceeds 1/2" thickness. FERTILIZING/HERBICIDES/PESTICIDES, ETC: Contractor who is awarded the park maintenance contract will immediately take soil samples of all park lawn and garden areas, and have them tested. After testing contractor will compile a list of needed fertilizers(organic only), and application schedule. City will purchase and store fertilizers. Contractor will make the applications. Other chemical treatments of herbicides, pesticides or fungicides will only be made in consultation with the City staff and only by a licensed applicator. The materials cost for these treatments will be included in the contract price. The contractor will not be liable for extraordinary outbreaks of disease or insect infestation, unless caused by his negligence. The contractor shall keep a log of all applications, including type of application, application rate, dates, times, and name of applicator. PRUNING AND TRIMMING: Hedges and shrubs shall be pruned and trimmed at times generally accepted by horticulturists for each particular species. Limbs from trees which present a hazard shall be removed. The contractor will report the existence of hazardous conditions to the Recreation and Parks Director who shall instruct on the removal or on other mitigation of the potential hazard. All pruning will be done to improve appearance or preserve the health of the tree or bush. WATERING: The contractor will develop a watering schedule to be approved by the city for all turf areas described in the work locations section and when agreed to by the city shall execute that plan. The contractor shall be responsible for replacing damaged sprinkler heads which shall be provided by the city. Other plumbing repairs related to the sprinklers shall be reported to the Recreation and Parks Director and the city shall repair such problems. The Public Works Department will start up sprinklers in the spring and blow them out and shut down the irrigation systems in the parks for the winter. REPLACING PLANT MATERIALS: Dead or dying plant materials including flowers, bushes, shrubs, and trees will be removed by the contractor but only with the authorization of the city's public works director. Replacement materials will be provided by the city. ENFORCEMENT OF PARK RULES AND REGULATIONS: When working in the parks, the contractor or his employees shall watch for persons breaching the park rules and regulations and immediately call the police department. INSPECTIONS: Each week the contractor will inspect each work area and keep regular contact with the Recreation and Parks Director on park maintenance activities. At the conclusion of the season, the contractor will meet with. the Parks and Recreation Advisory Committee and the Recreation and Parks Director to review this scope of work. Contractor will work with the committee to prepare a report for the city council on the status of park maintenance. The contractor has a positive responsibility to report any threat to the public's safety from any hazard in any park to which this contract applies. SCHEDULE "S" REMODEL SPRINKLER SYSTEMS: Install timers, replace sprinkler heads with pop-up heads(model & brand to be approved by city), and replace any pipe that will not work with the new pop-up heads and timer. Places needing remodeling include; Old Depot parking area, Community Park, City Hall, Library, Art Roberts Park, and Rotary Park. Then estimate the time savings from the maintenance contract and bid as part of schedule "A". Deduct the time savings from the installation costs. Enter the net cost as the bid for schedule "B". SCHEDULE "C" LEGACY PARK IMPROVEMENTS: Install 200 square feet of ground covering shrubs on the steep bank at Legacy Park. Estimate the cost and use it for the bid for schedule "D". NOTE: BIDS ON SCHEDULES B,&C, ARE OPTIONAL. YOU MAY BID ON SCHEDULE "A" ONLY. COMMERCIAL GROUND LEASE This Commercial Ground Lease ("Lease") is made November 9, 1994, by and between the City of McCall, Idaho, an Idaho municipal corporation ("Lessor"), and J. R. Simplot Company, a Nevada corporation ("Lessee"), for and in consideration of the mutual covenants in this Lease. 1. Lessor leases to Lessee, and Lessee leases from Lessor, the real property described on Exhibit "A" to this Lease ('Property"), which is located within the City of McCall, Valley County, Idaho, at the northeast corner of Highway 55 and Deinhard Lane, and on a "triple net" basis, that is, with all expenses of the Property to be borne by Lessee. 2. This Lease is for a term of two years commencing at 12:01 AM on May 1, 1994, and ending at 11:59 PM, April 30, 1996, except as this Lease may be renewed from time to time by mutual written renewal agreement, or sooner terminated by mutual written agreement. 3. For occupancy of the Property Lessee agrees to pay to Lessor, and Lessor agrees to accept from Lessee, monthly rental of $250.00 in advance, the receipt of which for the first month is acknowledged. Further rent payments shall be made on or before June 1, 1994, and on or before the same day of each month thereafter. Such rent shall increase by $200 (per month) to $450 per month on November 1, 1994, and increase by a further $200 per month upon the first day of each sixth month anniversary thereafter. 4. Unless otherwise directed by Lessor in writing, Lessee shall make all payments due Lessor, on or before the due date and during normal business hours, at City Hall, which is 216 East Park Street, McCall, Idaho. 5. Lessee has examined and agrees to accept the Property in its present condition. 6. Lessee shall use the property only for lawful open -space uses, including, but not limited to, construction of park -like improvements possibly associated with nearby business uses. 7. Lessee shall landscape the Property, but shall not make any changes other than landscaping in the property except in accord with City approval of designs for and site plans of Property. Once the Property is landscaped, Lessee shall not break ground, or remove vegetation once in place, prior to obtaining such approval. 8. Lessee shall be solely responsible for the maintenance of Property. Lessee at its expense will provide or see to the provision of all services, utilities, labor, and materials needed for the Property, and pay all accounts for services, utilities, labor, and materials supplied to the same prior to their becoming delinquent. 9. Lessee and Lessor both anticipate that no taxes will become owing to any jurisdiction by Lessor or Lessee with respect to Property. Should any such taxes become payable, they shall be paid by Lessee prior to their becoming delinquent. 10. Lessee shall provide and pay for insurance of any improvements on the property, in the amount of replacement cost, against fire, storm, vandalism, and other casualties and contingencies. Lessor shall prohibit the storage of liquid fuels, other combustibles, hazardous materials, and toxic materials within the Property, and include such prohibition in all rental agreements and subleases with Subtenants. Lessee will maintain public liability insurance against personal :injury and property damage on Property or caused to persons or property off of the Property by conditions on Property, in an amount of not less than $300,000 combined single limit. 12. Lessee will comply with all ordinances, regulations, and laws affecting the Property or its use, and will not use nor permit the Property to be used for any unlawful purpose. 13. Lessee will not erect on the Property signs, poles, lights, nor advertising devices, without prior written approval of Lessor, nor without first securing building permits and paying the appropriate fees. Approval of the site plan for the Property in the context of the Development Agreement between the parties does not constitute approval for signs, poles, lights, or advertising devices, which shall be separately submitted for design approval by the City Planning and Zoning Commission and Council. 14. Lessee will not permit any materialman's, mechanic's, laborer's„or other lien of any nature to attach to the Property. • 15. Upon termination or expiration of this Lease or any extension th,,reof, all fixtures and improvements on the Property become the property of Lessor. lb. If Lessee defaults in payment of rents specified herein after thirty days written notice of delinquency, or fails to do any other act required by this Lease, Lessor has the option of terminating this Lease, re-entering the Property, and removing all persons and property from the Property. Lessor has the option of doing any such act at Lessee's expense, and charging such expenses to Lessee. Upon re-entering the Property, Lessor may succeed to the benefit of and take over as direct lessor some or all of Lessee's contracts with Subtenants. 17. Lessee agrees to save Lessor and hold Lessor harmless against a.ny loss or liability for injury or damage to person or property occurring on the Property or property adjacent to Property during the term of this Lease from any cause whatsoever, including negligent acts or omissions of Lessor, its agents, or employees. 18. The parties agree that the Property is truly unique, that the rent contemplates solely the anticipated landscaping/park uses, and that Lessor would not lease this Property other than to Lessee. Lessee will not assign the Lease nor sublet the Property. Any such assignment or sublease will be void without such consent. ; 19. If any legal action or proceeding related to this Lease is begun by any party to this Lease, the prevailing party shall be entitled to recover its commtrcially reasonable attorneys fees and witness and expert witness fees, incurred in prosecuting or defending the same. The Lessor shall be entitled to such fees, if the prevailing party, notwithstanding the fact that the City Attorney is salaried. 20. This Lease is governed by the law of Idaho, and Valley County;, Idaho is the proper venue. 21. Time is of the essence with respect to the obligations of the part es under this Lease. 22. Any rights and remedies stated in this Lease are cumulative. 23. The neglect of any party to enforce its rights at any particular times or upon any particular occurrences shall not preclude resort to those rights at any other time or with respect to any other occurrences. Any waiver of any right pnust be done in a writing executed by the party to be charged with such waiver, and executed with LEASE of MUNICIPAL PROPERTY ' page 2 of 4 White -Leasure Development Company no fewer or different formalities and approvals than were attendant.upon execution of this Lease. 24. This Lease shall bind and inure to the benefit of the parties and their respective heirs, successors and assigns. 25. All exhibits and other attachments, if any, to this Lease are a part of this Lease. This Lease constitutes the entire agreement between and among the parties as to the Property and all prior negotiations and discussions, memoranda; correspondence, and communications respecting the Properlty are merged into and extinguished by this Lease. 26. The gravel pit was graded on October 29 and 30th, 1994. O'Neill Enterprises, Inc. will continue gravel excavation in the future as construction on the Bypass proceeds. Incidentally, during this grading the contractor has stockpiled some gravel for City use. The recent grading is in general conformance with the park concept plan.
