RESOLUTION RESCINDING A PORTION OF RESOLUTION #99-382
AND AWARDING A CONTRACT FOR ASBESTOS REMOVAL ON AN
EMERGENT BASIS
WHEREAS, by Resolution #99-382 the Mayor and Council of the Borough of
Carteret (the "Borough") declared an emergency and awarded certain contracts in
connection with the Borough Hall Furnace; and
WHEREAS, it has been determined that the asbestos removal services proposed
to be performed by Unipro, Inc. did not meet the job specifications; and
WHEREAS, Unipro, Inc. was awarded the contract to perform asbestos removal
services by Resolution #99-382; and
WHEREAS, the emergency conditions which required the award to Unipro, Inc.
without bid still exist as certified by the Borough Engineer; and
WHEREAS, the emergency conditions affect the health, safety and welfare of
the Borough; and
WHEREAS, E.P.C. Technologies has submitted a proposal to perform the
asbestos removal which meets the specifications for the job.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that a contract be awarded to E.P.C. Technologies in an
amount not to exceed $16,550 for the removal of asbestos in connection with the
emergency replacement of the Borough Hall Furnace.
BE IT FURTHER RESOLVED that this award of contract is being made
without competitive bidding in that the situation which this contract will correct
constitutes an emergency affecting the health, safety and welfare of the Borough.
BE IT FURTHER RESOLVED that the Borough Engineer has certified that an
emergency exists.
BE IT FURTHER RESOLVED that this resolution shall be advertised as
prescribed by law and shall take effect immediately.
BE IT FURTHER RESOLVED that the portion of Resolution #99-382 which
awarded a contract to Unipro, Inc. is hereby rescinded.

and certified as a true copy of the original
on December 17, 1999.
