OF THE CITY OF RICHMOND, INDIANA
RESOLUTION NO. 12-2016
A RESOLUTION AUTHORIZING THE GRANTING OF EASEMENTS
WHEREAS, The Board of Public Works and Safety of Richmond, Richmond, Indiana ("Board")
is the disposing agent for real property owned and to be transferred or acquired by
the City of Richmond, Indiana ("City") pursuant to the provisions of Indiana Code
(IC) 36-1-11, et. Seq. (the "Act"); and
WHEREAS, The City of Richmond is the owner of certain properties located adjacent to US
Route 40 near areas informally or commonly known as the Elder Beerman lot, the
Leland lot, and the Bullerdick lot; and
WHEREAS, Richmond Power & Light, a municipally owned utility company owned by the City
of Richmond, Indiana, is seeking three (3) easements in connection with the US 40
Street Project (3`d Street to I Ith Street along US Route 40); and
WHEREAS, The City of Richmond, Indiana, wishes to grant said easements on the following
described real estate to Richmond Power & Light ("RP&L):
a) An easement on real estate described and shown in the attached
Exhibit A, consisting of approximately 625 square feet, more or less; and
b) An easement on real estate described and shown in the attached
Exhibit B, consisting of approximately 0.049 acres or 2,142.0 square feet, more or
less; and
c) An easement on real estate described and shown in the attached
Exhibit C, consisting of approximately 0.039 acres or 1,692.39 square feet, more
or less; and
WHEREAS, The management of Richmond Power & Light, is in need of the easements set forth
in Exhibit A, B, and C, for the location of electrical equipment in connection with
said US 40 Street Project.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of
Richmond, Indiana that said Board approves the granting of easements on the following described
real estate from the City of Richmond, Indiana, to Richmond Power & Light, a municipally owned
utility company owned by the City of Richmond, Indiana, in consideration of the mutual benefits
to be gained by this transaction:
a) An easement on real estate described in the attached Exhibit A,
consisting of approximately 625 square feet, more or less; and
b) An easement on real estate described in the attached Exhibit B,
consisting of approximately 0.049 acres or 2,142.0 square feet, more or less; and
c) An easement on real estate described in the attached Exhibit C,
consisting of approximately 0.039 acres or 1,692.39 square feet, more or less; and
NOW, THEREFORE, BE IT FURTHER BE IT RESOLVED by the Board of Public Works and
Safety of Richmond, Indiana, that the Mayor, David M. Snow, the City Attorney, Walter S.
Chidester, or the Assistant City Attorney, Kimberly A. Vessels, be authorized to take all other
action necessary (including, but not limited to, signing any and all documents) to effectuate the
granting of the above -referenced Easements for the real estate set forth as described and shown in
Exhibit A, as described and shown in Exhibit B, and as described and shown in Exhibit C, which
easements will be from the City of Richmond, Indiana, to Richmond Power & Light, a municipally
owned utility company. ��y�

LAND DESCRIPTION
For Richmond Power & Light Easement
Situated in the Northeast Quarter of Section 5, Township 13 North, Range 1 West, City of
Richmond, Wayne Township, Wayne County, Indiana, being part of Tract Number 295 as
numbered on the Official Map of the City of Richmond currently conveyed to the City of
Richmond, Indiana by Warranty Deed recorded in Deed Record Book 453, Page 105 in
the Office of the Wayne County Recorder, and being more particularly described as
follows:
Beginning at the southeast corner of said Tract Number 295 being at the intersection of
the north line of South A Street and the west line of a 24-foot wide public alley west of
South 7th Street;
thence North 901 00' 00" West 25.00 feet along the north line of said South A Street to a
point;
thence North 000 00' 00" West 25.00 feet to a point;
thence North 900 00' 00" East 25.00 feet to a point on the west line of said alley;
thence South 000 00' 00" East 25.00 feet along the west line of said alley to the point of
beginning, containing an area of 625 square feet.

Charles W. Starr Eight (8"') Addition as shown in Plat Book 1, Page 227 currently
conveyed to the City of Richmond, Indiana by Warranty Deed described in Instrument
Number 1997004018 recorded in the Office of the Wayne County Recorder, and being
more particularly described as follows:
Commencing at the current northwest corner of South A Street and South 91h Street;
thence North 000 00' 00" West 200.00 feet, more or less along the current west line of said
South 9`h Street to the southeast corner of said City Tract and Lot Number 23 being the
TRUE POINT OF BEGINNING for this easement description herein described;;

Indiana, being part of Lot Number 32 in the Charles W. Starr Eight (8'h) Addition as shown
in Plat Book 1, Page 227, and part of Tract Number 461 as shown on the Official Map of
Richmond currently conveyed to the City of Richmond, Indiana by Quit Claim Deed
described in Instrument Number 1994006829 recorded in the Office of the Wayne County
