HomeMy Public PortalAboutORD-CC-1991-02ORDINANCE NO. 91-02 AN ORDINANCE AMENDING SECTION 5.20.170 OF THE MOAB MUNICIPAL CODE ENTITLED CLASS II RETAIL LICENSE. Be it ordained by the Moab City Council that Section 5.20.170 of the Moab Municipal Code is hereby amended to read as follows: 5.20.170 Class II retail license. Class II retail licenses shall entitle the licensee to sell beer in the original containers and on draft in containers not to exceed sixteen (16) ounces on the premises for consumption on the premises in accordance with the Liquor Control Act and the ordinances of the city, and shall be issued solely to restaurants, cafes and other establishments whose primary purpose is the dispensing of food. The food and service sold or rendered shall be sufficient in nature to amount to evidence and afford assurance to the city council of a bona fide restaurant business instead of a mere pretext for obtaining a license. A. It is unlawful for any person under the age of twenty- one years to sell or serve beer or liquor under this license; or B. It is unlawful for any person to sell or serve beer or liquor to anyone, other than in conjunction with the purchase of food menu items, under this license; or C. It is unlawful for any licensee, operator, manager or any other person in charge or a licensed premise holding a Class II retail beer license to hire or allow or permit any person under twenty-one years of age to sell or serve beer or liquor for consumption on or off the premises. 1991.
