HomeMy Public PortalAboutP&RAC Minutes 1994 06/06PARKS AND RECREATION ADVISORY COMMITTEE MINUTES JUNE 6, 1994 I. ROLL CALL AND CALL TO ORDER. Chair Grote called the meeting to order at 7:20pm. Committee members Ware, Coyle, and Killen answered the roll call. Chair declared a quorum present. Also attending was Richard Escott, Steve Milleman, Dan Krahn, Bob Hill, Rick Fereday, and Director Baker. II. REQUEST TO BUILD A DOCK AT OLD GOULD SITE NEAR MILL PARK(ATTACHED. - RICHARD ESCOTT. Committee informed Escott that the city wants to clean that area of commercial activities because it will have a bike path running through it and the parks Master Plan designates the area as scenic. In addition, committee informed Escott that he would have to provide parking which would be impossible. After brief discussion Escott decided to withdraw his request. III. COMMUNITY DOCK APPLICATION NEXT TO MILL PARK(ATTACHED) - STEVE MILLEMAN. Milleman showed committee a picture of the approved, 20 lot area and informed them lots 7 & 8 would have their own docks and the other 18 lots would be given lake access through "lot c" which will be owned by the property owners' association. In addition, Milleman informed committee that when designing the subdivision and "lot c" they did it believing the piece of property involved in the Century 21 trade would revert back to city ownership. Chair asked why the dock was centered on "lot c". Milleman tested that it is set back 25' from the northern edged of the propertydwhich will revert back to the city. Committee was concerned that the dock will cause more boat traffic in close proximity to Mill Park. Killen stated that people will think the subdivision beach area is public. Milleman stated he is sure that the homeowners will want to separate their common beach from Mill Park, through landscaping or fencing but it will have to go through the building permit process which will bring it back to the park board. After discussion, Coyle moved to recommend council ask that the design and construction of the dock be at the maximum distance from Mill Park. Ware seconded and the motion carried. IV. LETTER FROM DAN KRAHN CONCERNING MAY HARDWARE DOCK EXPANSION(ATTACHED) Krahn pointed out to the committee the meeting minutes from May S, 1991 "recommended council acknowledge this approval as a terminal expansion for the May Hardware dock system." Grote informed committee and Krahn she felt the statement applied to additional .boat slips. In addition, Killen stated she had been at the meeting and that was her intent due to downtown parking. Krahn stated he felt terminal means nothing could be moved further into the lake. Committee informed Krahn that the break water would not be any more of an impediment to the view from Art Roberts and Legacy Park, and in fact would push boat traffic further from the parks' beaches `rich is why the committee supported the application. Chair :formed Krahn that his concerns were not related to parks and he should not have had to come before this committee. She said hi n+ments should be going to the State of Idaho's Department of Lands .a the city council. Krahn asked what would happen if May Hardware needed to go even farther out into the lake next year. Chair responded that in that event the Parks Committee would review and comment on the application using the same visual and safety criteria they used this time Krahn and committee felt it would help a great deal if the Department of Lands would set standards for dock protrusion. V. SUMMER FEST PARK RESERVATION APPLICATION(ATTACHED). Eldredge informed committee that the Park Reservation Policy restricts the size of events in Mill Park to 400 people. Eldrege informed committee last year they sold 350 tickets per night and sold tickets at the door. Eldredge informed committee that 400 people attended the first night, 475 people the second night and 525 people the third and final night. Chair informed committee that when she was writing the Park Reservation Policy she thought Music Fest had 300 tickets printed and had added 100 to that number to get the restriction of 400 people in Mill Park at one time. In addition, Chair informed committee she had attended the final night and visited the park the day after Music Fest and found it to be in outstanding condition. Killen informed committee that she to had visited the Mill Park the day after Music Fest ended and was very impressed with how the park looked. Committee all felt that Music Fest's reputation stands for itself. After discussion Grote moved to recommend council grant to the McCall Music Society a variance to the Park Reservation Policy to increase the crowd limit to 500 for the August 1994 event only. The variance is recommended based on the following: --successful staging of the event with the crowd amounting to 500 people in 1993. --exemplary management of clean-up. --lower expected usage of Mill Park for sizeable events this year than has occurred in recent years. Coyle seconded and the motion carried. VI. MINUTES - MAY 9, 1994 Chair stated that on pg. 2 it should read, "site three was acceptable to all parties except Osprey Courts" Ware moved to accept the Meeting Minutes of May 9, 1994 with the above change. Killen seconded and the motion carried. VII. STAFF REPORTS 1. Director Director informed committee he had the entry and exit to the ice rink near Gravity Sports clean-up so it can be used for boat parking. Next, Director informed committee the City Attorney was looking into who is responsible for dead trees in Legacy Park, and Chief Points is looking into the rusty water run off north of the Legacy Park dock. In addition, Director informed committee that Administrator is working with the State Department of Lands to see that the Gould, dock building site is cleaned up. Finally, Director informed committee he has been unable to find out where the Brian Chapman Memorial Fund has gone and will be ready to report on it at the next meeting. VIII. NEW BUSINESS 1.Ada County Bicycle -Pedestrian Design Manual Coyle informed committee he talked with John Barns who is with the State of Idaho Department of Transportation and discovered the Ada County Bicycle -Pedestrian Design Manual has been updated. Coyle informed committee that Barnes is sending him a copy. Chair with consent of committee deferred the issue to its July meeting. IX. OLD BUSINESS 1. Letter to Will Pitman(attached). Committee acknowledged without action. 2. Letter to Jake Howard(attached). Coitimittee acknowledged without action. 3. Letter from Valley County Landscaping(attached ). Chair and committee all had deep concern about the bid default on park maintenance and wanted to know if the city is going to sue. Committee discussed court and alternative methods of dealing with the issue. Committee all expressed a desire to see professional landscapers caring for the parks. After discussion Killen moved to recommend council direct staff to contact the bidder in second position and ask them to pare back the R.F.P. to fit the budget. Grote seconded and the motion carried. X. OTHER BUSINESS. 1. Chair informed committee the Mayor had informed her Rotary Park had been overrun with kayakers Sunday, May 29 and recommended we find out who is giving'the lessons. Chair with consent of committee asked staff to contact Mayor, find out who is giving the lessons, send a letter informing them of park reservation procedure and of the restrictions on beaching water craft contained in city code, and forward a copy of the letter to the city police. Committee discussed the landing and launching of water craft in city parks and directed staff to place the issue on the July agenda. 2. Chair read a letter from the Progressive Club(attached) which states they will not be doing any more maintenance work in Community Park. After discussion Grote moved to recommend council publicly acknowledge the dedication of the Progressive club and send a letter to the Progressive Club thanking them for the years served and letting them know the effort was appreciate. Coyle seconded and the motion carried. 3. Chair informed committee the Master Gardeners met two weeks ago and agreed to go into Community Park this fall, totally weed it and transplant perennials into Mill Park. These volunteers will pilot the Adopt -a -Garden program which Chair plans to implement by next year. Committee felt the Master Gardeners should be recognized. XI. City Of McCall Parks and Recreation Idaho Ventures, Inc. D.B.A. Payette Lake Charters is a State Licensed Outfitting business established in McCall. The license for Payette Lakes Charters was issued by the State of Idaho in 1990 for power boat activities as well as fishing. This license also includes fishing on Little Payette Lake. A copy of the license is enclosed. Because of the continued and demanding tour industry and having become involved with a couple of tour companies, as well as the Department of Commerce and Tour Council, Idaho Ventures, Inc. is requesting a permit from the Parks and Recreation Department to build their own dock for their own boats. Idaho Ventures, Inc. D.B.A. Payette Lakes Charters is in the process of building a boat approximately 36 feet in length to put on Payette Lake. We will, at times as the demand dictates, have as many as three boats on the lake at the same time for various water activities. Although this can vary, the large boat being proposed will have it's own toilet facilities on it to help maintain the water quality of the lake. The boat will be services on a regular basis. The other boats will be requested to have a porta potty on them. A toilet facility will not be required at the proposed site. We feel with our license and having followed the tourist industry for the past five years this can do nothing more than help bring more tourist dollars to the City of Mc Call. The total number of people will vary. From past records as many as 500 people, per season, this also could vary. Realistically, the number of people touring the lake on a daily basis could vary from 12 to 24, depending on the size of the group. The area proposed for the dock is north of the Sports Marina, beyond the Fish and Game Net Pens, and that area north of the individual having the dock building permit. Ideally, the area requested would be that area in front of the Brundage Ski Resort office. With the City of McCall expanding their parks and recreation, we feel that this would only enhance that area and add to the attractiveness of that particular area. Idaho Ventures Inc. will maintain the area proposed and keep all trash picked up. They would also like the opportunity to possibly do some landscaping in the coming years to help enhance the area proposed. As parking has not been a problem in the past we feel it will not be a problem in the future. With a tune schedule planned to pickup individuals at the various public docks around the lake, the scenic beauty of the City of McCall and Payette Lake, we have found in the past that most people have parked their vehicles and walked to town. As I stated earlier, we anticipate no parking problems. Payette Lake Charters believes with establishing their own dock it will allow the various public docks more accessibility by the private boaters and help enhance more business for those merchants around the lake as well as the downtown area. Idaho Ventures, Inc. and Payette Lake Charters are establishing a Fly and Sports Shop in McCall to go along with their Outfitting business. We plan on offering fly tying, fly fishing as well as scuba and snorkeling activities in the surrounding area. Therefore, we believe having their own dock to go along with their recreational activities, will do nothing more than bring added attractions and tourist.dollars to the City of McCall. We would require a permit for a dock of 100 feet with the potential of 150 feet. The dock will meet those specifications established by the Department of Lands. In our discussions with various individuals around town and the Department of Lands, we had a very good response to our proposal. Idaho Ventures, Inc. carries their own insurance and bonding as required by the State of Idaho, before they issue a license. A copy of insurance is enclosed. Idaho Ventures, Inc. will continue to works with licensed caterers as they have done in the past. With a licensed caterer we are allowed to serve beer and wine as long as food is served. Idaho Ventures, Inc. will be operating on the lake from ice -off to freeze up with the months of June, July, August and September being the busiest. Therefore we are proposing a fee of $1400.00 to the Parks and Recreation - Department for the easement of this area. We therefore hope the City of McCall will work with us on this proposal as we greatly believe this will do nothing more than enhance the proposed area, as well as bring more revenue and tourist trade to the City of McCall. Recently there has been notification in the local paper of construction plans. As a property owner within 300 feet and directly affected by changes I wasn't notified. I would like clarification as to your process of notification. I have had discussion with your office before on their expansions along with the City of McCall. On their last expansion request of 400 feet into the lake they were denied, but reached agreement on a compromise of approximately 350 feet with the understanding there would be no further additions allowed. I suggest a review of the Park and Recreation Committee minutes of May 8, 1991, Item 3 stating conditions of approval. Those issues were agreed upon by the City and I believe by May Hardware if they were given the permit. I find it very frustrating and irresponsible for these bodies now to entertain another encroachment of a breakwater construction project. Any breakwaters should be attached only to existing pilings and kept out of public view. A problem with a previous design should not be allowed to further impact the public by encroaching on public waterway access. I believe the applicant should be held to the agreement of 1991 and work for a design that will not further impact those adjacent property owners by restricting access and use of our docks or public swim areas. I would like a copy of all your correspondence and decisions on this matter so I can stay informed. ABS4040-1 Dear Parks Committee: Below, you will find a brief outline of how we anticipate using Mill Park for our Music Society's SummerFest 94. If you have questions or require additional information please call Molly Eldredge at 634-8451. Generally, the concert series will be the same format as last year except for some very minor alterations . ABOUT THE EVENT: The McCall Music Society, a nonprofit organization, is requesting the use of Mill Park for the evenings of August 5, 6, &7,1994. On Friday and Saturday nights the concerts will begin at 7PM but the gate will be open at 6:15PM for picnickers to come and settle in ahead of time. Sunday night's concert will begin at about 5:00 PM as the gates open. Tickets will be $7 for adults and $4 for chilcten on Friday and Saturday nights and $1 n for all on Sunday night. Century 21 Chilshom Realty is the corporate sponsor for the Pops Concert on Friday night. West One Bank will again sponsor the classical night on Saturday, this year including a portion of Peter and the Wolf in ballet form. Shore Lodge and Weller Miller Insurance are sharing the sponsorship for the big jazz Sunday night including the Boise Big Band as well as the featured jazz musician, Boise's own Gene Harris. These local businesses will be having their corporate picnics at SummerFest. Seating will be on the lawn. Blankets and low backed beach chairs without legs will be encouraged. Brundage will have a concession of low "concert goers back rest " offered at $2 rental fee at the entrance. The concerts will be over before dark. NOISE: The music selected for SummerFest is played by the Boise Chamber Orchestra, the Boise Big Jazz Band , and this year, Gene Harris. There will be Pop's music played on Friday night, Classical on Saturday night, and Jazz on Sunday night. Acoustics are loud enough for the audience to hear but not so loud as to be heard in other parts of the area,. Last year the people in Mill Park Condos were , I think, thrilled by the opportunity to be participating from their porches. According to the Police Chief, there were NO complaints, only complimentary comments. Noise is not a factor to be "controlled" at this event, especially since everyone was well out of the park by dark. CONCESSIONS: At this time, we are planning only three booths: one will be SiBueno's fried ice cream and cold soft drinks; one will be St.Chapel wine; one will be beer from McCall Micro Brewery. There may be a table set up to disburse pre sold gourmet box picnic dinners , but that has yet to be decided. On Saturday night only, the evening's corporate sponsor, West One Bank, will have a open- air tent at the top of the hill in the park as a "Hospitality Tent" used to host invited clients. We will state in Big Letters on the tickets and in our PR that it is unlawful to bring alcoholic beverages into the park with picnics, etc. We did this last year and had ushers informed and watching, and to my knowledge, this was not an issue. The same will be repeated in "94. We will also place a sign in both wine and beer booths that we reserve the right to refuse service. INSURANCE: See attached. TICKETS Tickets will be mostly sold ahead of time and there will be about 475 offered each night, as we had last year. We felt after all was said and done, probably the park would very comfortably hold an additional 150-200 people but that we liked the feeling of a lot of space between blankets and chairs as before. So we will repeat last year's offering. CLEAN UP PLAN: There will be six plastic bag lined garbage cans around the perimeter of the park along the walk ways. There is a committee in place to insure the proper pick up is c completed following each night's concert. We were absolutely amazed last year at the condition the concert goers left the park in. Our committee hardly had to do a thing! Whether or not we rent porta potties this year is still under consideration. Last year we brought in three and I doubt that any were used more than a couple of times. People are actually there for such a short time that we didn't find a necessity for more than the two park rest rooms. We would like to hold off on this decision until a later date, if it is OK with you. The "Site" Committee will be back in the park at 8:00AM on Monday manning to disassemble the booths and staging. The park will be clear by 10:00AM as it was last year, and you'll never know SummerFest had happened! SECURITY: Valuables are stored in waiting trucks following each night's concert and we have hired once again a man to sleep on the premises to insure security. The police are made aware that he is there and of the nature of the park's use. They patrol spontaneously throughout the night but not on a continual basis. Last year they did not feel it necessary for us to hire extra off duty police to patrol during the concert for security reasons, due to the type of music drawing the kind of crowd that was in attendance. We are comfortable with their advice. Jean Ann Tucker has recently met with the Chief of Police to discuss our plan. He approved. We do have about 12 ushers a night in the park itself during the concert to control the perimeter and to direct people to the proper areas for picnicking, etc. We will again put log pole/rope " "fencing" around the perimeter to direct people traffic and insure one entrance only. Because of the incident last year relating to injuries due to the microburst, we feel it is necessary to have an ambulance on hand during the concerts. We have consulted with the hospital and arrangements are in the making . Besides, if we're prepared, then nothing will happen! PARKING: Attached is a chart showing our parking plan. We felt that last year we did an "over -kill" on managing the parking. People know the area and found their own spots, however, a committee has been formed to help direct parking from the three streets accessing the park area. Signage and committee members will direct people to available parking places in the area. There will be a designated Handicapped Parking near the park entry ramp. Mill Park Condo parking lots and the Manchester development entry are off limits and NO PARKING signs will be posted in those areas . This parcel is the portion of the bikeway/pathway from Stibnite St to the McCall Airport, the abandoned UPRR right of way, formerly owned by the State of Idaho. The conversion application referred to this parcel as State Land. It was identified in the Mill Park conversion application as Parcel No. 13 on Map 6 (I have enclosed copies of Map 1 and 6 for your information.) When the conversion application was filed this property was owned by the State of Idaho. The parcel was sold by auction by IDOL and the city was outbid for ownership at that sale. Subsequently the city tried to negotiate the purchase with Mr. Hoyle, without success. The city then filed a condemnation action and was able to resolve the matter without a court hearing. The acquisition of the Hoyle Parcel leaves only the Kalman parcel behind City Hall (First to Park St.) as the only remaining acquisition and dedication required to meet the requirements of the conversion. The City Attorney has filed various actions on that parcel which are scheduled to be heard in court on Thursday, May 26, 1994 and following. After the hearing on summary judgement, it may be a period of months before the court issues its ruling and then negotiations for acquisition can proceed. One position is available for a three year term. The deadline for application is July 7, 1994 at 5 p.m. The Committee advises the City Council on all policy matters related to the development and maintenance of parks and on the operation of recreation programs. The Committee meets monthly and occasionally more frequently. The City has secured a $405,000 grant to construct bikepaths through the city in 1995 and the Committee will be involved in the routing and design of those pathways. We discussed the project with the fundraisers at our meeting Monday and concluded that we could not make an informed recommen- dation to you until we had more information about a sewer line project currently underway on the park's east border. The project threatens to delay the construction of the playground until next year, the fundraisers say. No staff at our meeting could tell us whether or not that is true. Normally, we would have tabled the topic until we could get some answers to our questions, but time grows short to get a decision, fundraisers say, so that they can make their construction window. The extraordinary effort made by two McCall women, Kathy Rake and Laurie Braun, deserve your special consideration. So we are appealing to the council to review their proposal with a quorum of the park board in attendance (notice has been properly posted) at your Thursday meeting. The choices to be made are fairly straightforward, in my view, and can be done quickly after you review this background and listen to a brief presentation Thursday by the fundraisers. In the past eighteen months, these two women have raised nearly $20,000 to construct this project and have enlisted the aid of several volunteer professionals to guide them in the playground's design. It is the most singularly impressive park fundraising effort I have seen in my decade in this town. But, as in all efforts, things change in eighteen months and those changes threaten the opportunity to have the playground in place by this summer. Specifically:  The fundraising effort was too successful. The original site alotted will not be big enough to hold all the equipment they can now afford to install. The fundraisers have asked us to consider a new site, still on the north side of the park, but inside the walkway loop, which they say provides sufficient land. The park board feels that while the proposed new site has many advantages over the old one, any change should in fairness trigger the public process all over again (it is my personal feeling that Mr. DeBoer would continue to stand in opposition and that the Music Society may change it's position of neutrality back to opposition. I very much doubt we will encounter any new opposition).  If the new site is not approved, the project can be scaled back to fit the original site. We will lose quality in the playground and the fundraisers have been in- formed by the interim city manager that construction could not begin until a sewer line being laid on the eastern border of the site is completed. This condition could delay the project for another year, the fundraisers say. Project Background Last year, the council approved a park board motion to allot land in the northeastern corner of Mill Park (where the restrooms and the U of I tree grove is) as the site for a children's playground. The playground was a proposal brought to the park board by two private citizens, Kathy Rake and Laurie Braun, who pledged to raise the funds to build it. The park board went to substantial lengths to contact Mill Park users and adjacent property owners. Two parties voiced concerns over the idea. The McCall Music Society, which holds the SummerFest concert in the park was concerned that the playground would change the park's ambience and make it more unwieldy to stage the concert. Judd DeBoer of Mill Park Condos expressed strong opposi- tion, wishing the park to retain it's character as a quiet retreat. In the end, the Music Society accepted the site we recommended to the council as being the least intrusive in their view. Mr. DeBoer contin- ues to stand in opposition to the proposal. There was a brief discussion of moving the project to another park site, but the fundraisers insisted on two conditions before they would raise the funds: that the project be in Mill Park and that con- struction would occur in the year that the fundraising was completed. The park board supported the project in Mill Park because we believe that Mill Park is underused as a quiet retreat and concert site. A children's playground would be another use for the site and would reduce the pressure on the Legacy Park beach. At the time the previous council approved the project, the only contingency was that a final site plan be reviewed by the park board and approved by the council and they could start turning dirt.
