Regular Meeting: Roll Call 2. Approval of Agenda: Agenda amended to move Roll Call and Approval of Agenda before the Executive Session. Trustee Shapiro moved, and Trustee Brent seconded the motion to approve the Agenda as amended. Motion carried: 6 -0. 3. Executive Session: Trustee Burford moved, and Trustee Hoyhtya seconded the motion to open the Executive Session for a conference with the Town's Attorney for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24-6 402(4)(b) and for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and /or instructing negotiators, under C.R.S. Section 24- 6- 402(4)(e) regarding an annexation agreement and to include TA McGowan, TP Trotter, PW Nordin, SC Kylie Crandall, SC Ferguson and TM Durbin. Motion carried: 6 -0. Trustee Hoyhtya moved, and Trustee Shapiro seconded the motion to close the Executive Session. Motion carried: 6 -0. Attorney's Opinion Required by C.R.S. 24- 6- 402(2)(d.5)(II)(B). As the attorney representing the Town of Fraser, I am of the opinion that the entire Executive Session, which was not recorded, constituted a privileged attorney- client communicati Rod McGowan, Legal Counsel 4. Consent Agenda: a) Minutes July 6, 2011 b) Resolution 2011 -07 -03 Final Acceptance of Park Place c) Resolution 2011 -07 -04 Final Release of Surety FVMRD landscaping d) Ordinance 384 Return check fee Trustee Shapiro moved, and Trustee Burford seconded the motion to approve the consent agenda. Motion carried: 6 -0. 5. Open Forum: 6. Updates: 7. Public Hearings: a) Los Nopales Hotel and Restaurant Liquor License Page2of3 Trustee Hoyhtya moved, and Trustee Brent seconded the motion to open the public hearing on the Los Nopales Hotel /Restaurant Liquor License hearing. Motion carried: 6 -0 The Board of Trustees, sitting as the Fraser Local Liquor Licensing Authority, conducted the following proceedings concerning the application of Los Nopales, LLC for a Hotel and Restaurant Liquor License. TA McGowan briefed the Board and the audience on the purpose and procedure for tonight's meeting. Pedro DeSantiago, member of Los Nopales, LLC was sworn and offered testimony in support of the application. TA McGowan offered as Exhibits 1 -3 copies of the liquor license application, proof of publication and the notice of the hearing and the Clerk's Finding of Facts regarding the application. Mayor Pro -Tem Sumrall accepted the exhibits into evidence. Trustee Burford moved, and Trustee Brent seconded the motion to close the public hearing on the Los Nopales Hotel and Restaurant Liquor License. Motion carried: 6 -0. 8. Discussion and Possible Action Regarding: a) Los Nopales Hotel /Restaurant Liquor License Trustee Hoyhtya moved, and Trustee Burford seconded the motion to approve Los Nopales Hotel and Restaurant Liquor License Resolution 2011- 07 -05. Motion carried: 6 -0. TA McGowan left the meeting. b) Statewide Redistricting Proposal Page 3of3 TM Durbin briefed the Board on the redistricting proposal, including Grand County with Larimer County on the Front Range. Hearings will be held this fall. A letter from the Town stating our concerns with the proposed redistricting will be sent to the State. c) Ordinance 385 Fishing Regulations TM Durbin outlined the need for the Ordinance regarding the Fraser ponds. Trustee Hoyhtya moved, and Trustee Brent seconded the motion to approve Ordinance 385 Fishing Regulations. Motion carried: 6 -0 9. Community Reports: CML Policy Committee representative for the Town of Fraser will remain Trustee Burford. Trustee Shapiro moved, and Trustee Brent seconded the motion to re- appoint Trustee Burford as the Town of Fraser's representative to CML. Motion carried: 6 -0. 10. Staff Reports: 11. Other Business: Trustee Hoyhtya moved, and Trustee Shapiro seconded the motion to adjourn. Motion carried: 6 -0.
