Please share this email with Mr. Nazzaro. There is not an email address for him on the Gulf Stream town website. To confirm, I would like the minutes to the 3 meetings regarding the Lemon Hill project presented to the ARPB. Also all communications regarding the issuance of the "early work permit" issued by the town to Mr. Benjamin to begin the excavation of the property before proper work permits have been issued by Delray. Additionally I would like to know when and by what process Mr. Smith left the ARPB and became a commissioner. You should be able to view your original requests at the following link: PRR 22-2903 (laserfiche.com) Requests for information are different than requests for records. Under Florida's Public Records Laws, the Town is not required to create a new record in order to accommodate a request for information. See Government -In -The -Sunshine Manual at page 165 (2022). Minutes from the ARPB meetings can be found by going to the Town's website: www.gulf- stream.org and click on "Find a Town Record", then click the Town Clerk folder, the Minutes folder, the ARPB folder, and then you can search by date. The dates the Lemon Hill project were discussed were the February 25, 2021, March 25, 2021, and April 22, 2021, ARPB meetings, as well as the May 14, 2021, Commission Meeting. We consider this request closed. The process of Mr. Thomas Smith becoming a Commissioner was explained at the Commission Meeting on April 8, 2022, and can be found in those minutes. Subsequently, since this first request was made on August 8, 2022, we have received multiple requests from you ad nauseum regarding the early work permit and information regarding FDEP permits. You will need to reach out to the FDEP for the answers to your questions regarding their permits. Pursuant to the public records laws, the duty of the Town of Gulf Stream is to provide access to, or copies of, public records at a reasonable time in reasonable conditions but only after receiving required payments. The Town of Gulf Stream is not required to give out information from these records nor give legal advice about these records. The Florida Statutes can be found here: httin://www.leiz.state.fl.us/statutes/ The Town of Gulf Stream's Code of Ordinances can be found here: hgps://www.municode.com/library/fl/gulf stream/codes/code of ordinances The Town is required to furnish copies of records when you identify the record, or the portion of a record, with sufficient specificity to permit the records custodian to identify the record and when the required fee is paid. The Town has spent at least 15 minutes on your request and is providing with you with a partial response at the same link above. The Town estimates that to fully respond to your request will require an additional hour of administrative support at $53.08 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (One hour @ 53.08) = Deposit Due: $53.08 in cash or check.
