HomeMy Public PortalAboutORD-CC-1991-08ORDINANCE # 91-08 AN ORDINANCE AMENDING THE MOAB MUNICIPAL CODE TO INCLUDE CHAPTER 17.71 REGARDING GUEST APARTMENTS. BE IT ORDAINED by the Moab City Council that the following Chapter 17.71 regarding Guest Apartments be added to the Moab Municipal Code, and that the same shall read as follows: CHAPTER 17.71 GUEST APARTMENTS Sections: 17.71.010 Guest Apartment Defined 17.71.020 Existing Guest Apartments In R-3 and R-4 Zones 17.71.030 Guest Apartments and Short -Term Boarding Houses Not A Permitted Use 17.71.040 Enforcement 17.71.010 Guest Apartment Defined: A structure whose original purpose was that of a multiple -family dwelling unit of two or more family units such as a duplex, triplex, 4-plex or other apartment -type complex and currently rented on a short-term basis (less that 30 days). 17.71.020 Existing Guest Apartments In R-3 and R-4 Zones: This ordinance shall not apply to multiple -family dwellings of apartment houses that have converted to guest apartments in the R-3 and R-4 zones and have a current business license prior to the effective dates of this ordinance. 17.71.030 Guest Apartments And Short -Term Boarding Houses Not A Permitted Use: No license shall be issued for guest apartments and the future conversion of apartments to guest apartments shall not be a permitted use in any residential zone. Short-term boarding and rooming houses shall not be a permitted use in residential zones. 1 17.71.040 Enforcement: All violations of said Guest Apartment ordinance are classified as Class B Misdemeanors, punishable by a fine not to exceed $1,000.00 or by imprisonment in the county jail for a period not to exceed six months, or by both such fine and imprisonment. Each day of violation or non-compliance shall constitute a separate offense and may be prosecuted accordingly. 1991.
