I. CALL TO ORDER
Assistant Town Attorney Nazzaro called the meeting to order at 8:30
A.M. and noted that due to the Chairman and Vice Chairman being
absent with notice, the board needed to select a Chairman Pro Tem.
Board Member Smith made a motion to select Board Member Robert
Canfield and the motion was seconded by Alternate Board Member
Greene with all voting AYE at roll call.

Board Member Smith had a correction on page four, third
paragraph, to change where it said Chairman Smith to Board Member Smith.
Board Member Smith made a motion to approve the minutes of the June 23,
2022, meeting with correction. Alternate Board Member Greene seconded
the motion with all voting AYE at roll call.

VI. PUBLIC HEARING.
A. Declaration of Ex-Parte Communication
Acting Chairman Canfield stated that he had spoken to Mr.
Dorsheimer, and it was strictly procedural, but he hadn’t spoken to him
since the last meeting. The other board members had no ex-parte
communication.
B. Administer Oaths
Deputy Clerk Basel swore in Dan Dorsheimer, Patrick
O’Connell, Jeff Peterson, Shane Ames, Carlos Linares, and Jay Colestock.
C. Applications for Development Approval
1. An application submitted by Matt Wolf, as Agent for Steve
Streit, owner of the property located at 590 Wright Way, Gulf Stream,
Florida, legally described as a parcel of land in Sections 3 and 4,
Township 46 South, Range 43 East, Palm Beach County FL.
a. Demolition Permit to remove existing 398 sq. ft. of
a single-story porch.
b. Special Exception to permit a new 500 sq. ft. single-
story porch resulting in increased side and rear
setbacks.
c. Level 3 Architectural/Site Plan Review to permit the
construction of a new 500 sq. ft. single-story porch.
Mr. Patrick O’Connell, Architect, stated he was there to
make a revision to what was previously approved by centering the loggia
for flow from the inside, give a cleaner look for the rear elevation and
give them more room in the side yard. He added that the fireplace and
chimney were also going to be demolished. Acting Chairman Canfield noted
that the plans still showed the fireplace and chimney, which Mr. O’Connell
stated it was a last-minute change, thus the reason for it still being on
the hardcopy.
There were some questions regarding the Special Exception and since
the applicant had asked for a special exception before could he ask for
another one. Assistant Town Attorney Nazzaro explained that the 300 sq.
ft. was a static number and that they were taking some square footage out
and had only asked for 20 sq. ft. for the last special exception they were
still within the 300 sq. ft. allowed. Board Member Smith agreed with the
architect that she thought this change was a much cleaner look.
Board Member Smith made a motion to recommend approval of a Special
Exception to allow 300 sq. ft. of covered unenclosed area that exceeds the
maximum permitted floor area ratio. Alternate Board Member Greene
seconded the motion with all voting AYE at roll call.
Board Member Smith made a motion to recommend approval of a Level III
Architectural/Site Plan to permit the demolition of the existing 398 sq.
ft. single-story porch and construction of a new 500 sq. ft. single-story
porch with the following condition:
1. Prior to the issuance of a certificate of occupancy or certificate
of completion, the owner of the property shall prepare and record a deed
restriction which, at a minimum, shall provide that all roof projection

areas required to remain unenclosed as per approval of this special
exception shall remain so for as long as the structure is in existence or
exceeds the maximum permissible FAR.
Alternate Board Member Greene seconded the motion with all voting
AYE at roll call.
2. An application submitted by Richard Gould, as Agent for Dan
Dorsheimer, owner of the property located at 945 Indigo Point, Gulf
Stream, Florida, legally described as Lot 72, Place au Soleil (Less Parcel
in OR2172P1699).
a. Demolition Permit to remove existing structures.
b. Special Exception to permit 300 sq. ft. of covered,
unenclosed area that exceeds the maximum permitted
floor area ratio.
c. Level 3 Architectural/Site Plan Review to permit the
construction of a new 5,290 sq. ft. two-story, West
Indies style single family dwelling with two-car
garage, covered patio, deck and swimming pool.
Mr. Jay Colestock, Architect, gave a detailed
PowerPoint presentation and noted that the proposals from the ARPB at the
last meeting had been addressed and there were now muntins on the rear
windows and the window openings had been reduced from 45% to 40% to now
meet the Code. He stated they were still seeking a special exception to
allow 289 sq. ft. of covered unenclosed area. Mr. Jeff Peterson,
Landscape Architect, gave an overview of the landscape plan.
Board Member Smith made a motion to recommend approval of a
Demolition Permit to remove the existing structure. Alternate Board
Member Greene seconded the motion with all voting AYE at roll call.
Board Member Smith made a motion to recommend approval of a Land
Clearing Permit to clear existing vegetation from the building site.
Alternate Board Member Greene seconded the motion with all voting AYE at
roll call.
Board Member Smith made a motion to recommend approval of a Special
Exception to allow 289 sq. ft. of covered unenclosed area that exceeds the
maximum permitted floor area ratio. Alternate Board Member Greene
seconded the motion with all voting AYE at roll call.
Board Member Smith made a motion to recommend approval of a Level
III Architectural/Site Plan to permit the construction of a 5,255 sq. ft.
two-story, West Indies-style single family dwelling with a two-car garage,
covered patio, deck and swimming pool with the following condition:
1. Any minor modifications to the approved landscaping shall be
submitted to the Town Manager for review and approval and any major
modifications shall be brought back to the ARPB for review and approval,
prior to commencement of landscaping.
2. Prior to the issuance of a certificate of occupancy or certificate
of completion, the owner of the property shall prepare and record a deed
restriction which, at a minimum, shall provide that all roof projection
areas required to remain unenclosed as per approval of this special

exception shall remain so for as long as the structure is in existence or
exceeds the maximum permissible FAR.
Alternate Board Member Greene seconded the motion with all voting
AYE at roll call.
3. An application submitted by Ocean Avenue Custom Homes LLC,
as agent for Benedetto DiCicco, owner of property located at 2775 Avenue
au Soleil, Gulf Stream, Florida, legally described as Lot 93 Place au
Soleil and 4-46-43.

garage that faces the street.

Mr. Shane Ames, Architect, gave a detailed PowerPoint
presentation. Discussion was had regarding the unique lot and
positioning of the three-car garage. Board Member Canfield asked if they
had made any effort to place the garage facing east to which Mr. Ames
answered it was a long, narrow lot so it would be difficult to maneuver
the cars. Board Member Smith asked if they had considered situating the
house a different way so that the garages could be located elsewhere to
which Mr. Ames again stated the configuration of the lot and the present
location of the house gave it a nice street presence from the front.
Board Member Smith stated eight criteria needed to be met for the
variance and asked the applicant to go through each of them. Discussion
was had and the board agreed it was a unique lot, but that the applicant
did not meet all eight criteria for a variance, stating specifically
numbers five and eight. The board suggested that the applicant eliminate
the third garage or flip the house in another direction. Alternate Board
Member Greene stated the issue was that the three-car garage facing the
street was prohibited per the Code. It was decided to defer the
application to the September 22, 2022, meeting, but the board allowed Mr.
Ames to resume the presentation to show the detailing of the home,
colors, roof tile, etc. Mr. Ames mentioned making the three-car garage a
two-car garage with a storage room to which Alternate Board Member Greene
stated as long as the storage room wasn’t a secret garage. Board Member
Smith noted that the two-car garage would still need to be screened.
Alternate Board Member Greene reiterated that if a car could be stored in
the storage room it would still be a garage. Mr. Ames suggested these
changes trying to get approval from the board, but Board Member Smith
stated she would need to see a new set of drawings. Discussion was had
regarding the special exception to which the board did not have issue
with.

Board Member Smith made a motion to defer the application to the
September 22, 2022, ARPB meeting. Alternate Board Member Greene seconded
the motion with all voting AYE at roll call.
4. An application submitted by Philip Colnon, Architect for
Signature Builders Group LLC, as Agent for Dov Siedman, owner of property
located at 3813 N. Ocean Blvd, Gulf Stream, Florida, legally described as
all that part of Lot 3, Block “B”, of the plat of Blocks A, B & Z Palm
Beach Shores Acres (Ocean Boulevard Estates), for the following:
a. Demolition Permit to remove existing front entry gate
and existing balcony rails.
b. North Ocean Overlay Permit to permit a front entry
gate.
c. Level 2 Architectural/Site Plan Review to permit
replacement of existing front entry gate and balcony
rails with similar architectural style.
Mr. Carlos Linares, Architect, stated Mr. Colnon had
submitted the application, but for the record, he wanted it known that
Randall Stofft Architects were the architects for this project. Mr.
Linares then gave a detailed PowerPoint presentation. There were no
questions from the board as it was a straightforward presentation.
Board Member Smith made a motion to approve a Demolition Permit to
remove existing front gate and existing balcony rails. Alternate Board
Member Greene seconded the motion with all voting AYE at roll call.
Board Member Smith made a motion to approve a North Ocean Overlay
Permit to permit a front gate entry. Alternate Board Member Greene
seconded the motion with all voting AYE at roll call.
Board Member Smith made a motion to approve a Level II
Architectural/Site Plan to permit replacement of existing front entry gate
and balcony rails with similar architectural style. Alternate Board
Member Greene seconded the motion with all voting AYE at roll call.
5. An application submitted by Carlos Linares, Architect for
Randall Stofft Architects, as Agent for Stewart Eidelson, owner of
property located at 920 Indigo Point, Gulf Stream, Florida, legally
described as Lot 67 Place Au Soleil, for the following:
a. Demolition Permit to remove existing decorative facade
items, round columns, and existing railings.
b. Level 2 Architectural/Site Plan Review to permit exterior
architecture renovation with new decorative façade items,
square balcony and trellis columns, and new balcony
railings.
Mr. Carlos Linares, Architect, gave a detailed
PowerPoint presentation explaining they had taken on this project mid-
stream after Mrs. Eidelson had started construction prior to getting
permission from the Town. He added they were keeping the style of the
home Gulf Stream Bermuda. Mr. Linares stated that the renderings did
not represent the true colors and he explained the proposed colors of a

light gray for the house with white shutters. Discussion was had
regarding the railings on the front entry area shown on the renderings
and Mr. Linares noted that staff had advised that these were not
allowed in Place au Soleil. Mr. Linares stated that his client was
adamant about having something there to which Assistant Town Attorney
Nazzaro read straight from the Code the prohibitions. It was decided
since it was prohibited, the railing would not be allowed. Board
Member Smith asked about the void of shutters on the left side of the
garage to which Mr. Linares stated that area was going to be heavily
landscaped and added that it was not necessarily a window, but glass
block, and he didn’t feel it needed shutters. Town Manager Dunham
stated if the applicant was going to make major landscape changes, it
would need to come before the staff to which Mr. Linares heartily
agreed. The board decided that shutters needed to be on the glass
block window left of the garage.
Board Member Smith made a motion to approve a Demolition Permit
to remove the existing, decorative façade items, round columns, and
existing railings. Alternate Board Member Greene seconded the motion
with all voting AYE at roll call.
Board Member Smith made a motion to approve a Level II
Architectural/Site Plan to permit exterior architecture renovation with
new decorative façade items, square balcony and trellis columns, and new
balcony railings with the condition that shutters be added to the east
front window. Alternate Board Member Greene seconded the motion with all
voting AYE at roll call.

Assistant Town Attorney Nazzaro welcomed the newest Alternate
Board Member, Mr. Greene, and thanked him for his service as well as
Board Member Canfield for chairing the meeting.

Discussion:
This application was originally heard by the ARPB on July 28, 2022. Included in the plans submitted
for review was a request for a variance to allow a three-car garage facing the street in violation of
Section 70-105. At the July meeting, the ARPB indicated they would not recommend approval of
the variance and suggested the applicant eliminate the third garage or flip the house in another
direction.
The new submittal includes a two-car garage, eliminating the southernmost garage door which is
now a wall with a window and landscaping in front. A door for a golf cart entrance has been
relocated from the front of the home to the east side of the property, further reducing the number
of garage-type doors in the front entry. The driveway was reconfigured from multiple entries on

the south and west side to only allow entry on the south side of the property, maintaining the
existing hedge that borders Avenue Au Soleil on the west.
Special Exception
The total FAR that is being proposed (7,268 sq. ft.) is 298 sq. ft. more than the code allows
without approval of a special exception to increase the FAR. The Special Exception request is
being made pursuant to Section 70-72 (b), Special Exception Floor Area Ratio (FAR) for Roof
projections and reads as follows:
Roof projections. Up to 300 square feet of roof projections (covered, unenclosed floor areas) may
exceed the maximum permissible FAR subject to the following:
(1) Maximum floor area. The maximum floor area in excess of FAR is 300 square feet. One or
more roof projections may be approved under this special exception provided the total
floor area of all projections does not exceed the maximum permitted FAR, by more than
300 square feet.
(2) Specific standards for review.
a. The roof projection(s) shall be compatible and complementary to the architecture of
the structure and shall add appropriate architectural detail and relief to a facade.
b. The roof projection(s) shall not make the structure look more massive.
c. The total floor area of the roof projections shall not exceed the maximum permissible
FAR by more than 300 square feet.
d. For each one square foot of roof projection over the maximum permissible FAR, two
square feet of roof projection must be provided that are within the maximum
permissible FAR, and all shall remain forever unenclosed.
e. Prior to the issuance of a certificate of occupancy or certificate of completion, the
owner of the property shall prepare and record a deed restriction which, at a
minimum, shall provide that all roof projection areas required to remain unenclosed
as per approval of this special exception shall remain so for as long as the structure
is in existence or exceeds the maximum permissible FAR.
The applicant is required to meet the above standards for review as he is seeking to add 298
additional sq. ft. of covered, unenclosed area that exceeds the maximum permitted FAR by 298
sq. ft. or less. The final standard for review has been included in the recommended motion
below.
