APPROVING 2018, 2019, 2020 CY FUNDING FOR
THE BLAZING STAR CULTURAL ARTS CENTER
IN CJAC AND THE CARTERET HISTORICAL COMMITTEE
WHEREAS, the Mayor and Council of the Borough of Carteret have determined it to be an
important priority to establish and promote the conduct of educational, cultural, performing and
visual art programs within the Borough of Carteret; and
WHEREAS, the Borough desires to authorize funding to support arts, cultural and historical
programing to be provided by the Central Jersey Arts Council and the Carteret Historical
Committee at the Blazing Star Cultural Arts Center and throughout the Borough of Carteret; and
WHEREAS, CJAC is a New Jersey Nonprofit Corporation, established under N.J.S.A. 15A:1 -1
et seq. (commonly known as New Jersey Nonprofit Act) having as its principal purpose the
conducting of educational, cultural, performing and visual arts programs inclusive of
presentations to groups of students, public discussion, publication of literature, public education,
and public relations in support of the arts; and
WHEREAS, CJAC has since its establish in 2014 provided educational, cultural, performing and
visual arts programing within the Borough of Carteret.
WHEREAS, CJAC has submitted a proposal to the Borough to conduct an educational, cultural,
performing and visual arts program within the Borough of Carteret which is described more fully
in the document attached hereto as "Exhibit A'; and
WHEREAS, the Borough has evaluated said proposal and finds that it meets the purposes for
which the Borough of Carteret Arts Funding Program and the monies appropriated therefor may
be utilized; and
WHEREAS, the Borough desires to authorize funding for calendar years 2018, 2019 and 2020 to
support continued programing at the Borough's Blazing Star Cultural Arts Center and throughout
the Borough by CJAC and the Carteret Historical Committee in the amount of $65,000.00 per
year including educational, cultural, performing and visual arts programs; and
WHEREAS, the Borough and CJAC are desirous of effectuating and implementing an agreement
for same;
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret as follows:
1. That the Mayor and /or appropriate Borough Officials are hereby
authorized and directed to execute the attached Grant Agreement with
the Carteret Blazing Star Cultural Arts Center.
2. That the Borough also hereby authorizes a $65,000.00 per year grant to
the Central Jersey Arts Council, Inc. for its arts programming directly
within the Borough and through the Blazing Star Cultural Arts Center.

RE: Summary of services & programs provided by Central Jersey Arts Council (CJAC)
Dear Mrs. Pogorzelski:
It is our pleased to continue to provide the Borough of Carteret and its residents with high quality arts,
cultural, and history -based programs and services. From it's establishment as a 501 C -3 in 2014, CJAC
has developed and run events in the Blazing Star Cultural Arts Center as well as other public spaces
throughout Carteret. We look forward to continuing our partnership with the Borough of Carteret and
we stand steadfast in our commitment to serve Carteret over the current and upcoming years (2018,
2019, and 2020). We share in Mayor Dan Reiman's belief that the arts, culture, and history together
serve as a force for personal betterment, community enrichment, and revitalization. Please see a
selection of our year -round programs and services listed below:
• Art in The Parks - community workshops led by teen volunteers in Carteret public parks
• Blazing Star Teen Advisory Board - volunteer group of teens that plan and run events
• Art & Story Time - reading and art making with teens at the Carteret Free Public Library
• Exhibitions and related events at the Blazing Star - Historical and visual arts
• Performances, presentations, and practices at the Blazing Star - Music, open mic. poetry,
choir, cultural, and historical lectures

BOROUGH OF CARTERET
FUNDING AGREEMENT
This Agreement made this 14th day of January 2019, between the Borough of
Carteret, a municipal corporation of the State of New Jersey, having its principal offices
at 61 Cooke Avenue, in the Borough of Carteret, New Jersey (hereinafter known as
"Borough ") and the Central Jersey Arts Council, Inc. having its principal offices at 63
Carteret Avenue, in the Borough of Carteret (hereinafter known as "CJAC "),
WITNESSETH:
WHEREAS the Borough Council has determined it to be an important priority to
establish and promote the conduct of educational, cultural, performing and visual art
programs within the Borough of Carteret, and
WHEREAS, the Borough by Resolution # 18 -225, authorized funding to support
arts, cultural and historical programing to be provided by the Central Jersey Arts Council
and the Carteret Historical Committee at the Blazing Star Cultural Arts Center and
throughout the Borough of Carteret; and
WHEREAS, CJAC is a New Jersey Nonprofit Corporation, established under
N.J.S.A. 15A:1 -1 et seq. ( commonly known as New Jersey Nonprofit Corporation Act)
having as its principal purpose the conducting of educational, cultural, performing and
visual arts programs inclusive of presentations to groups of students, public
discussions, publication of literature, public education, and public relations in support of
the arts; and

WHEREAS, CJAC has submitted a proposal to the Borough to conduct an

WHEREAS, the Borough has evaluated said proposal and finds that it meets the
purposes for which the Borough of Carteret Arts Funding Program and the monies
appropriated therefor may be utilized; and
WHEREAS, Resolution 18 -225 approved on November 8, 2018 authorized
funding for calendar years 2018, 2019 and 2020 to support continued programing at
the Borough's Blazing Star Cultural Arts Center and throughout the Borough by CJAC
and the Carteret Historical Committee in the amount of $65,000.00 including
educational, cultural, performing and visual arts programs.; and
Whereas, the Borough and CJAC are desirous of effectuating and implementing
an agreement for same;
Now, THEREFORE, in consideration of the mutual promises and covenants
between the parties herein and contained herein, the Borough and CJAC hereby agree
as follows:
1. The BOROUGH shall provide funding to CJAC in the amount of $65,000.00 to
be utilized for the program set forth above and more fully described in the
attached Exhibit "A." It is agreed and understood that the funding shall be
used to offset the cost of the programing and for no other purpose.
2. The Borough shall make payment to CJAC upon authorization by the
municipal governing body.
3. CJAC acknowledges that the funds provided by the BOROUGH hereunder
are to be used for the purposes described herein. Should any of the
BOROUGH funds be utilized for any other purpose, then CJAC shall be
required to return the equivalent amount of funds utilized for that purpose to
the BOROUGH.
4. CJAC shall, no later than April 15 of each year, provide to the BOROUGH a
written summary of the activities conducted under the program in the calendar
year immediately preceding along with an accounting of any monies
expended.
5. CJAC shall defend , indemnify and otherwise save harmless the BOROUGH,
its agencies, departments, bureaus, boards, officials and employees from any
and all claims or actions at law, whether personal injury, property damage or
liabilities, including the cost of defense which either arise from acts or
omissions, whether negligent or not of CJAC, its employees, officials
contractors, subcontractors and /or agents in the planning, development
operation or conduct of the program, or which arise from any failure to
perform the obligation under this Contract or any improper performance.
6. CJAC acknowledges that the BOROUGH's sole obligation hereunder an in
connection with the Program is the provision of the aforesaid funding.
7. The parties agree to undertake all necessary actions which are required in
order to effectuate the terms of this Agreement, including the adoption of all
necessary instruments and the execution of all necessary documents.
8. This agreement represents the entire Agreement between the parties, and it
shall only be modified through a subsequent written amendment approved by
the respective governing bodies of both parties.
9. This Agreement shall be interpreted and shall be governed by the laws of the
State of New Jersey.
10. This Agreement shall be binding upon the parties and their legal
representatives, successors and assigns.
IN WITNESS WHEREOF, the parties have caused this Agreement to be
executed by the proper corporate officers and have their proper corporate seals
affixed hereto, the day and year first above written.
