Eric Hallman. STAFF PRESENT: Town Manager Eric Peterson, Town Clerk Donna F. Armbrister, Planning Director Margaret Hauth, Police Chief Duane Hampton, Finance Director Greg Siler, Public Works Director Ken Hines, and Town Attorney Bob Hornik. CTO: 7:00:26 PM Mayor Tom Stevens called the meeting to order. 1. PUBLIC CHARGE 7:00:58 PM Mayor Stevens did not read the public charge but asked everyone to abide by it. 2. PUBLIC HEARING A. Solicit public comment on potential amendments to the mobile food vendor provisions in Section 8 of the Town Code to allow vendors to locate on private property in the historic overlay district and to operate as late as 9 PM. 7:01:21 PM Margaret Hauth stated the town received a request from a local merchant who is getting ready to open a business to consider some amendments to our mobile food vendor provisions in the ordinance. About a year ago the Board amended the Town Code to accommodate mobile food vendors, also referred to as food trucks, to locate on either a fixed route or a fixed location. This does not refer to special events where these trucks routinely setup for a day to two and move on. This amendment was to allow a weekly lunch route, visit construction sites, etc. At the time the Board adopted those changes, they indicated they would rather not see those businesses locate in the historic district; mainly because they are usually parked in public parking and we don't have enough public parking in downtown to accommodate food trucks during the day. June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 2 of 52 So the ordinance was adopted to allow permits for ten per year but they cannot locate in the historic district. We have received a request from a new downtown business who wants to allow food trucks on the private property that contains his business. The amendment before the Board now is to allow mobile food vendors on these fixed routes or fixed locations to locate on private property in the historic district and to extend the hours to 9:00 p.m. but not allow any one vendor to stay more than eleven hours at one site. The property would still need to be non - residentially zoned. Mark Bateman said they only want food trucks on private property. They want to obey all the rules as they do not want the same food truck there all the time. They will not allow signage out in the streets. They are totally against putting them in public places where they compete with the brick and mortars. He said they are not asking for this to avoid serving from a kitchen; they think this is a good idea. It is new and different. Durham and Raleigh do it and loves it and they would like to get with the rest of the Triangle and offer something to the people to help Hillsborough's downtown nightlife. Commissioner Evelyn Lloyd asked how many hours per day they were asking for. Mr. Bateman replied four. Commissioner Lloyd asked what those hours would be. Mr. Bateman said 5:00 -9:00 PM. Commissioner Lloyd clarified it wouldn't be during the day. Mr. Bateman said the only time it would be during the day would be on Saturdays and Sundays. No weekdays. Commissioner Lloyd asked where he would set them up to park. Mr. Bateman stated they would park inside the fence on his property at 115 W. Margaret Lane. Commissioner Lloyd asked if there was enough space for them to park there. Mr. Bateman replied yes. Commissioner Lloyd asked where the customers would be parking. Mr. Bateman said the customers would use the town parking spaces, mostly the parking deck. They decided not to put a gate up because it was a point of entrance they didn't want to have to control. Mayor Stevens asked if there were any other questions. He clarified that Mr. Bateman had talked to other businesses in the area and that he was planning to provide electricity for the food trucks. Mr. Bateman said yes. They have an RV hookup and there won't even be any generator noise. He also addressed the trash issue that the business owners will be responsible for getting rid of the trash generated at these food trucks. Commissioner Lloyd stated they have been having problems with the dumpster behind King Street. Mr. Bateman said he would not be using that dumpster because he has secured his own dumpster for his business. Mr. Bateman noted that a food truck will not add that much more trash to the amount of trash a bar already generates. Mayor Stevens asked if anyone else had any questions. There were none. He thanked Mr. Bateman for coming. Bob Hornik commented on the ordinance, sub paragraph E of Section 873, which says vendors may operate only from 8:00 AM until 9:00 PM provided that no vendor may remain in one location for more than nine hours. He asked Ms. Hauth if the nine hours was per one business day. Ms. Hauth said it was intended to be nine hours continuously. Commissioner Mike Gering suggested to include the word continuous. Mr. Hornik felt a change was necessary to clarify the ordinance. Mayor Stevens asked if anyone else would like to speak regarding this topic. John Willis asked to speak but said he lived in the county, not in the city and didn't know if he was allowed to speak on this topic. Mayor Stevens said he was a citizen and was welcome to address the Board and speak. Mr. Willis signed in. He stated he did not know Mr. Bateman, but goes to Durham and Raleigh for the food truck rodeos. While he was at the rodeo in Raleigh, he visited four of the restaurants and all four were packed. He noted that the food trucks were definitely helping the businesses, not hurting them. He thinks the food trucks will bring people to downtown Hillsborough and they will stop and patronize other businesses. He feels it is a great idea and that it will not take away from Historic Hillsborough, but it will bring people in. Mayor Stevens thanked Mr. Willis. 7:12:19 PM Commissioner Frances Dancy moved to close the public hearing. Commissioner Brian Lowen seconded. Upon a unanimous vote of 4 -0 the motion was declared passed. 3. AUDIENCE COMMENTS REGARDING MATTERS NOT ON THE PRINTED AGENDA 7:12:56 PM None 4. AGENDA CHANGES & AGENDA APPROVAL 7:13:01 PM Commissioner Gering added a Closed Session discussion on legal matters regarding Colonial Inn. 7:13:06 PM Commissioner Lloyd added a discussion regarding the possible closing of the Orange County Correctional Center. 7:13:30 PM Mr. Hornik noted 9.1-1 on the Consent Agenda and said there was a section in that contract regarding dispute resolution that they usually modify. In 9.G it is modified but it is not modified in 9.1-1, though it is intended to be modified. He does not want the contract approved on the Consent Agenda without that modification. He does not want a contract approved that has a dispute resolution provision in it that we don't want to have in the contract. We want the one that is in 9.G but we don't want the one that is in 9.1-1. 7:14:59 PM Mayor Stevens moved Item 9.G and 9.1-1 from the Consent Agenda to the Regular Agenda. 7:15:17 PM Commissioner Lowen moved to approve the agenda as amended. Commissioner Dancy seconded. Upon a unanimous vote of 4 -0 the agenda was approved as amended. 5. PRESENTATION A. Citizens Police Academy Graduation Recognition June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 4 of 52 7:15:31 PM Duane Hampton recognized several people who had given a lot of their time and energy. Corporal Tereasa King really did a lot of legwork to design the Citizens Police Academy Program. They started their first program nine weeks ago. This program was two to three hours per day where lots of topics were covered, such as law, use of force with Police Officers, patrol procedures and how things work. Canine Officers came in and did demonstrations for them and talked about their jobs. Investigators came in and talked about the investigations process. Narcotics Officers came in and gave presentations about illegal narcotics and what is going on in the community. The talked about crime reporting and accident investigations. They tried to give the students a good taste of all aspects of Hillsborough Law Enforcement. In addition to the classroom, they came in on their own time outside of classes to do ride alongs. They were asked to do three hours of riding along to complete the program. The students present tonight have completed all aspects of this program. There are a few students that were not able to complete everything but they are also present to be recognized for participating and are welcome to come back and complete the portions of the program they missed. He called the following students forward for recognition: Clifford Nicholson, Evonna Sampedro, Sarah Velasco, Jayne Hanzak, Jeffrey Bartch, Jessica Parker, Michael Whitfield, Henry Spear, Carley Swiggett, Don Charland, Kathleen Ferguson, and Anthony Marshall Mr. Hampton commented this was a great opportunity for him as well. They got a chance to talk and these folks are interested in the Town of Hillsborough and some are interested in future careers. Michael Whitfield said, as the first class of the Citizen's Police Academy, they would like to thank Chief Hampton and Corporal King for their hard work and organizing this program. They also thanked all the members of the Hillsborough Police Department and the Orange County District Attorney's Office for giving their time, efforts and participation in this program. He said each one of the students are leaving this program with a better understanding and better appreciation for the Police Department, their duties and responsibilities. They have seen, first hand, the hard work and dedication of these professionals in making Hillsborough a better place to live and work. They hope this program will continue so that others may experience some of the same things they have experienced in the last nine weeks. They were asked in this program to vote on their favorite class and instructor. The first vote was a tie. It was between the Drug Investigations: Search and Seizure class with Detective Burwell and the Canine Class with Corporal Foster and Corporal Foushee. They had a second vote and the vote went to the Canine Class with Corporal Foster and Corporal Foushee, with Honorable Mention and a special thanks to Detective Burwell for his excellent presentation. Mr. Hampton said they are planning to do a departmental recognition for both Corporal Foster and Corporal Foushee and Detective Burwell because they did put on a great presentation for everyone. The Hillsborough Police Department would also like to thank the friends and family 4 June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 5 of 52 members who supported these students and let them come spend some evenings with the Police Dept. Mayor Stevens thanked them all on behalf of the entire Board for their involvement. B. Receive presentation regarding the Safe Routes to School Strategic Action Plan by Abigaile Pittman with the Orange County Planning Department 7:23:18 PM Ms. Hauth introduced Abigale Pittman, who is the Transportation Planner with Orange County. She will be speaking to the Board about the Safe Routes to School Plan that the county prepared and that Hillsborough is partnering with them on. Abigale Pittman said Orange County received a Safe Routes to School Action Plan (SRTS) Service Award in July, 2008. The plan development process included visioning, goals and map working sessions with the project Staff and the Steering Committee. The Town of Hillsborough was represented in this process by Stephanie Trueblood. In 2009, NCDOT contracted with Greenway's Inc. and Green Transportation Solutions to work with County Staff, local agency representatives and Orange School Team Leaders to develop the final draft of the SRTS plan, which was completed in December, 2012. A link to this plan is provided in the Board's agenda packets. Ms. Pittman continued that the Safe Routes to School Program is a federally funded grant reimbursement program providing an opportunity for communities to improve conditions for bicycling and walking to school. The Safe Routes to School Program works with schools, local governments and agencies, advocacy and non -profit organizations, and public health officials at a grassroots level to identify improvements that can help make bicycling and walking to and from school a safe and healthy transportation alternative. Some of the primary goals of the Safe Routes to School Program are, when it is safe it gets kids walking and biking and when it's not safe, make changes. The primary reason for this is to promote and improve pedestrian and bicycle travels for supported schools. Some of the benefits of the program include improving safety for pedestrians and bicycles, reduce traffic congestion around schools, reduce emissions and improve children's health. The program's primary project funding source is SAFETEA -LU funds, which is a transportation acronyms that stands for Safe Accountable Flexible Efficient Transportation Equity Act — a Legacy for Users. It is a non - competitive, rolling grant cycle. It is 100% grants and no local match is required. However, it is on a reimbursement basis so you are required to pay for the improvement and then get reimbursed. At least 70% of the funds must be spent on infrastructure and at least 10% must be spent on non - infrastructure activities, such as programs and education. There are three chosen county school sites: C.W. Stanford Middle School, Cameron Park Elementary, and Grady Brown Elementary. All the schools are K -8 schools and are located inside or adjacent to the Town of Hillsborough. A thorough inventory of existing conditions June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 6 of 52 demonstrated a high measure of possible results and outcomes of the SRTS Program and goals and projects for these three schools. Ms. Pittman provided a visual presentation of some examples of SRTS projects. All of the projects are within two miles of the K -8 school. Both infrastructure and non - infrastructure projects are included in the plan. There are a lot of sidewalks and paths, crossing improvement projects, traffic calming measures, on- campus improvements, bicycle racks, and curb ramps are some of the projects on campus. Off - campus improvements would include bike racks, crossing guards, left turn restrictions alleviating conflicts with parking areas. The program would fund pedestrian signals at signalized intersections and training volunteers. The immediate future steps would be for the Staff's final review of the plan and assessment of policy linkages to existing adopted plans; Staff is referring to Town of Hillsborough Staff, County Staff and Orange County Schools Staff In late summer to early fall, their goal is to be able to adopt the plan in all three places; Orange County School, the Town of Hillsborough and the Orange County Board of County Commissioners. From there they would establish a SRTS Action Plan Advisory Committee that would be responsible in the future for advocating plan implementation and assist with programming and grant writing, evaluating plan progress and assessing plan priorities. At this point, this is all they are asking the Town of Hillsborough to endorse. They just want to move forward and get it adopted and have an Advisory Committee. In the future, when they have recommendations on any projects, they will be back for the Board's review and input. Multiple subsequent implementation action steps are outlined and prioritized in the plan, all of which will be subject to the recommendations of the Advisory Committee, the BOCC, School Board and the Town of Hillsborough. 7:30:17 PM Ms. Pittman stated she wanted to know if the Board had any concerns. 7:30:25 PM Mayor Stevens said all three of the said schools really could benefit from these improvements and the Board is supportive of that, as well as being able to get funding from another source to do the improvements. 7:30:36 PM Ms. Pittman commented they had some communications with the Public Health Division and there's a Community Transformation Grant (CTG) that has been funded and for Division 5 they are going to hire an active school person and fund that position. For their pilot program they are interested in interacting with us in the implementation of this plan and they have some money available because it is public health goals. They are going to be interacting directly with the SRTS administrative people at DOT as well. Mayor Stevens thanked Ms. Pittman for her presentation. 6. COMMITTEE REPORTS (Critical) 7:31:47 PM None June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 7 of 52 7. REPORT FROM THE TOWN MANAGER 7:32:03 PM Eric Peterson stated he was contacted about six weeks ago by a Boy Scout Troop leader in Lewisburg and they were interested in camping overnight and doing some work at Kings Hwy. Park, such as litter cleanup and cleaning some trails. There are several different merit badges they can earn and the troop leader said it was difficult for them to find areas to do the work. As part of earning one of the badges, they were planning to get Tom Magnuson from Training Path is tour them and tell them about the history of the area and such. The town ordinance does not allow overnight stays at Kings Hwy. Park but, in writing the ordinance, it does allow the Town Manager to make exceptions for hours and certain events. He made an exception and allowed them to stay the weekend of June I st. He thanked the Planning Director for her help in contacting the area neighbors to let them know what was going on so there wouldn't be any surprises in all the excellent work they did. He received a letter from the troop leader and it was signed by all the members of the troop. It included a copy of the badges they earned and thanked the Town for allowing them to do this. They asked in the letter if the Town would consider doing an Adopt a Trail program so their troop and other troops could adopt sections of the trail and maintain them going forward. He said they would look into it. 8. DEPARTMENTAL REPORTS 7:34:21 PM Ms. Hauth thanked the Board for allowing them to bring Aspen Price back on board part -time. She started last Monday and is working four hours per day. It is great to have her energy and skills back as long as they can keep her. She also said the Tourism Board has supported their application to replace the benches downtown and that is being funded out of a separate pot of money so it did not impact the applications from other tourism based operations. They will be installing those benches throughout the summer. 7:35:31 PM Mr. Hampton said earlier this year the Governor's Fund Commission is awarding some grant processes for a couple of things. We put in a request for them to upgrade the fingerprint system which would allow them to do fingerprint analysis in -house instead of being at the mercy of other agencies. He received the letter saying they were approved for that grant and they have received the funding for that in the amount of $8,000. Mayor Stevens asked if that was fully funded. Mr. Hampton said yes. Mr. Hampton commented on the high school graduations this past weekend and in conjunction with Orange Partnership for Alcohol and Drug Free Youth and the agency, they did a lot of work Thursday, Friday and Saturday with partying, traffic issues and alcohol issues. They did a compliance check on Thursday with about thirteen or fourteen local establishments and found four locations that sold to underage buyers. They were in the forefront of the storekeepers minds in keeping alcohol out of the hands of kids. They did several license checks on Friday and Saturday nights which resulted in some underage possession of alcohol charges and child safety violations, as well as several revoked licenses. It was a busy weekend trying to stay visible. Mayor Stevens said he appreciated the partnership with the agency. Mr. Hampton said the agency assisted with the funding through their grants and ABC grants so much of the funding for the officers' time spent out on the streets this weekend did not come out of the public funds. Commissioner Lowen seconded. Upon a unanimous vote of 4 -0, the motion was declared passed. 10. ITEMS FOR DECISION — REGULAR AGENDA A. Consideration of FY14 Budget /Financial Plan 7:38:45 PM Mr. Peterson said there was nothing new other than what is in the agenda document, which is a couple of updates. They had a budget workshop in regards to non - profits. The non- June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 9 of 52 profit funding and the map included was basically the same. He clarified the intention of the Board was to continue funding all the non - profits at the same level as the current year. 7:39:37 PM Commissioner Dancy moved to approve the FY14 Budget /Financial Plan as presented. Commissioner Lowen seconded. Upon a unanimous vote of 4 -0, the motion was declared passed. B. Discuss and consider (a) a Resolution Amending the Assessment Roll for the Waterstone Special Assessment District (to authorize the sale of bonds up to a par value of $5,100,000) and (b) a Resolution Approving and Authorizing the Mayor and /or Town Manager to sign the Implementation Agreement for the Waterstone Special Assessment District 7:40:14 PM Mr. Hornik said the first item is a proposed resolution amending the assessment roll for the Waterstone SAD. The Board may remember back on May 13, 2013, they adopted a resolution confirming the assessment roll for a maximum amount of up to $6.211 million. The next day he received an updated appraisal for the Waterstone property and the appraised value of the property has increased. Using our 3:1 ratio, up to $5.1 million in par value of bonds could be sold and the assessments, if that were the case, would be $6,837,920 including interest and other charges that would pay back what we owed for ten and one half years. Mr. Hornik stated at the Board's Workshop meeting later in May, the Board adopted a resolution indicating they would consider modifying the confirmation of the assessment roll in light of new information. He is asking the Board to propose a motion that would amend or modify the previous approval of the confirmation of the assessment roll to increase the total amount of the assessments from the $6.211 million to the $6.837 million. The par value of the bonds that would have supported the $6.2 million assessment roll is $4.66 million, which is based on one third of the appraised value of the property from the appraisal that was done about a year ago. The $6.837 million assessment roll is based on the higher appraisal value of the property. Mr. Hornik had a second item, which was a proposed resolution authorizing the Mayor and /or the Town Manager to execute and sign the implementation agreement they have been working on. They have come to an agreement, in principle, with Stratford. The last remaining item to be resolved is, if there are excess funds available after paying the initial cost of issuance, some other costs and the cost to build the infrastructure, how does that money get spent. They agreed there would be a schedule attached to the implementation agreement and there's about $400,000 in up- front cost that would get paid and then there's an estimated $200,000 that remain that is not paid up front. Assuming there is enough money at the end, and if all projections are correct there will be, Stratford would be reimbursed that $200,000 and anything that is left after that belongs to the Town to spend for purposes related to and benefitting the property and the district. It is the simplest and fairest way to resolve the issue. He has prepared an implementation agreement that includes that modification and there will, no doubt, be some further tweaks in the language, but no material changes in the implementation agreement. So he is asking the Board to adopt the resolution he prepared that is part of the agenda packet authorizing the Mayor and the Town Manager to sign at the appropriate time. June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 10 of 52 He also stated they have a meeting scheduled with the LGC on Wednesday, June 12th at 1:00. He has prepared an LGC application, which is a notebook about six inches thick of materials, which did not include all of the actual documents, which is another six inches of materials that have been circulated. They will review these documents at the scheduled meeting. The schedule as of now is for the LGC to conduct a special meeting to consider this and other items on June 25, 2013. He hopes the LGC will approve and authorize the financing at said meeting. 7:46:01 PM Commissioner Gering asked about the Sunset Clause ending June 30th. Mr. Hornik said the legislation to extend the Sunset Clause is still in committee. There's no guarantee it will be extended. We are making progress under the assumption that we've got to have the bonds authorized and the sale approved by June 30, 2013. The sale doesn't have to occur by June 30th but it must be approved and authorized by that date. Mr. Hornik stated there would need to be some action by the Town Board between June 25th and June 30th to approve the sale of the bonds, assuming the LGC approves and authorizes the financing on June 25th. Mr. Peterson suggested moving the Town Board Workshop meeting from June 24th to later in that same week, which would also give the Finance Director more time to do the end of year budget items. 7:50:25 PM Commissioner Lowen moved to adopt a resolution amending the assessment roll for the Waterstone Special Assessment District. Commissioner Gering seconded. Upon a unanimous vote of 4 -0 the motion was declared passed. 7:50:42 PM Commissioner Lowen moved to approve the resolution that qualifies the Mayor and Town Manager to sign the Implementation Agreement. Commissioner Gering seconded. Upon a unanimous vote of 4 -0, the motion carried. C. Consideration of a resolution regarding the Special Use Permit application request of Mt. Bright Baptist Church to create a faith -based cemetery on 1.44 acres at the southeast intersection of Cedar Grove Road and Cedar Street 7:51:16 PM Ms. Hauth prepared resolutions for the Board's packets for both scenarios of whether the Board approves or denies the resolution, as well as the Planning Board minutes from last month where they deliberated and recommended some conditions. Some of the application materials are included in their packets and some they received at the April Public Hearing. The Planning Board did recommend approval; however, it was not a unanimous vote. They did ask for a few more conditions on the application including some landscaping and details on how the applicant will get water to the site to maintain the landscaping. 7:53:09 PM Commissioner Lloyd asked about adding trees to improve the buffer between the cemetery site and the neighbor's property. Ms. Hauth confirmed it was added as a condition that the trees being added in that buffer were to be evergreen trees. 7:53:48 PM Commissioner Gering said he was satisfied with the conditions added. 10 June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 11 of 52 7:53:59 PM Commissioner Lloyd stated the Planning Board really gave this a lot of thought and, although she agreed with the Planning Board member that was opposed, she knows that they, as Board members, must vote according to the ordinances that have been set and put their personal feelings aside. Mayor Stevens said there are many sides to this but that is the point of due process and all sides have been given opportunity to speak. 7:55:02 PM Commissioner Gering moved to grant the Special Use Permit as specified. Commissioner Dancy seconded. Upon a unanimous vote of 4 -0, the motion carried. D. Consideration of a resolution regarding the Special Use Permit application request of EGL Concepts to construct an addition to the existing Leland Little Auction house adding 13,819 sf to the existing building and construct 124 parking spaces to bring the total site development to approximately 30,000 sf building and 165 parking spaces 7:55:34 PM Ms. Hauth noted the rezoning portion of this application was handled on the Consent Agenda. Mr. Little and his company acquired some additional property, which needed to be rezoned to the Entranceway Special Use district. Here we are approving a new SUP or modifying the existing one to address the addition. The Planning Board spent a significant amount of time talking through this application. There were a number of waiver requests because the original site had been approved under the zoning ordinance and a number of those development standards have changed. In trying to meet the new standards there were some that posed some real difficulty for the applicant. The Planning Board recommended approval granting most of the waivers and asking for two additional conditions to be applied to the site, including additional landscaping and additional landscaping around the building itself. She included in their packets the minutes from the Planning Board meeting and two draft resolutions detailing the proposed conditions if they care to approve it and some guidance if they wish to deny it. There were two Planning Board members that recused themselves from this application; one had a family member that was employed at the property and the other had a family member who was employed by the design firm. They still had a quorum present. 7:57:21 PM Commissioner Gering asked if the additional conditions were acceptable to the applicant. Ms. Hauth asked Mr. Jay Fulkerson, the Architect for the project who was present, to confirm that. Mr. Fulkerson said yes. 7:58:15 PM Commissioner Lowen moved to approve the SUP application request. Commissioner Dancy seconded. Upon a unanimous vote of 4 -0, the motion carried. E. Consideration of an ordinance amending Section 8 of the Hillsborough Town Code to allow mobile food vendors to locate on private property in the historic overlay district and operate as late as 9 PM. 7:58:53 PM Ms. Hauth told Mr. Hornik to reword section 2 of the amending ordinance to be more specific about exactly how long a food truck should be allowed at any particular site. 7:59:03 PM Mr. Hornik said the nine hours could be read in different ways. He feels it should be more specific. He said one of the suggestions was for it to read "no vendor may remain in one II June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 12 of 52 location for more than nine consecutive hours ". Mayor Stevens said he felt like that was the intent. Ms. Hauth stated that was, in fact, the intent when it was written. Her intent was not to allow them to come in the evening and stay until morning where they could say it was within the same 24 hour period, even though it was not the same calendar day. She was trying to avoid putting "24 hours" in it. 8:00:22 PM Commissioner Gering said there is actually thirteen hours in a business day. Instead of getting into what happens with the other four hours if they state "business day ", he feels they should just state it as "nine consecutive hours ". Mr. Hornik suggested it say "nine consecutive hours in any business day ". Ms. Hauth said she was happy to accept that. So "nine consecutive hours in any business day" would be the amendment to section 2 of the ordinance. 8:01:21 PM Commissioner Lloyd asked for clarification about the ten permits allowed in the Historic District. Ms. Hauth clarified there could be ten permits issued town -wide. It is not restricted to the Historic District. Those are the ten permits for trucks that are running a regular route or sitting at one location. This has nothing to do with special event trucks. 8:03:38 PM Commissioner Gering moved to adopt the resolution as amended. Commissioner Lowen seconded. Upon a unanimous vote of 4 -0, the motion carried. Items 9.G and 9.H which were removed from the Consent Agenda 8:04:38 PM Mr. Hornik said the form contracts for 9.G and 9.H are almost identical. The 9.G subparagraph 2E, Dispute Resolution, was stricken. But in 9.H it was not stricken, due to oversight. Ms. Hauth said it was two different Staff members that sent the contracts. Mr. Hornik said, otherwise, the text of the contracts is identical and their preference has been to strike paragraph 2E from the contracts. If the contract in 9.H for Phase III services were modified to strike that paragraph regarding Dispute Resolution, he has no problem recommending it at all. 9.GConsider approving the contract for construction administration and materials testing to Summit Engineering and Design Services for Riverwalk Phase II 8:05:49 PM Commissioner Gering moved to approve the contract. Consider awarding the construction contract for Riverwalk Phase II to DH Griffin for $1,250,000. 12 June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 13 of 52 8:06:23 PM Ms. Hauth said this project was advertised twice because they did not receive three bids the first time. D.H. Griffin did qualify as the lowest responsive bidder. She provided the Board with a website that links to the various projects they are doing right now, which just happens to be building other portions of the Mountains to Sea Trail in Raleigh and Wake County involving many more bridges than they will be requesting. This project is within the budget that was established for Riverwalk Phase II and it is only 6% higher than the engineer's estimate that was prepared before the bid. Staff and the Consulting Engineer both recommend authorizing Staff to get a contract together and award the bid. 8:07:23 PM Commissioner Lowen moved to award the construction contract for Riverwalk Phase IL Commissioner Dancy seconded. Upon a unanimous vote of 4 -0, the motion carried. G. Discussion of inquiry for valet parking services in downtown 8:07:51 PM Ms. Hauth said they received a request by phone from a local business for a local contract provider of parking services. They did some research on what it would take to manage such a service. She found that everyone does it differently. Most locations that have this type of service has a Parking Department, someone who is responsible for the parking because they have paid public parking that needs to be managed. Everyone seemed to manage it differently and charge different amounts. She came up with some basic ideas of how the town could pursue this if they were so inclined, but they didn't have to. Ms. Hauth said there is loading space on W. King Street in front of Howard, Perry and Walston. It is not a designated parking space. It is striped off as yellow. That is a potential location to allow a vendor to setup, receive the cars in and bring the cars back. She would not recommend putting it anywhere on Churton Street or taking an actual parking space for this. It is not a lot of space. She has no way of knowing what the appetite for this service would be. She expects that if a business hired a firm to do this rather than having their own employees out there, the firm, in order to be successful, would go to the other businesses downtown and solicit. The way downtown Chapel Hill has it setup is that the merchants pay the valet parking and they validate parking so the customer never actually pays anything, which would be more attractive to the customer. If someone manages it, they would bill each of the restaurants at the end of the month based on how many tickets they got back. She is not suggesting they get into that business. The private market can probably handle that their own way. Just because one company asks to do this, they want to think about whether they want one company, multiple companies, or whether they want to allow it at all. 8:11:08 PM Mayor Stevens asked how this came up; if there were only inquiries or a specific proposal. Ms. Hauth said there was an inquiry by a local business owner followed up quickly by a request from a company provider. Mr. Peterson said the restaurant who contacted the Planning Department also contacted Finance and asked if they would lease out the spaces at the Town Hall Annex. He said they have not been able to pursue that yet. 8:12:14 PM Commissioner Lowen asked, if they get into leasing the spaces out, what does that mean from an insurance standpoint if someone's car gets broken into or a window gets broken. If they are going to consider this they need to really do some investigating before jumping into it. 13 June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 14 of 52 Mr. Peterson said, in regards to leasing the spots at the Town Hall Annex, there are lots of other businesses in the area, such as churches and museums and funeral home, that rely on those spaces. Ms. Hauth said she didn't think they would want to make any town - controlled spaces available to them. Commissioner Gering noted the places where they are leasing spaces are places where there is no other available parking. That is not the case in downtown Hillsborough. There is plenty of parking and they have the parking deck. He thinks the leasing approach is a bad way to go. They have to be careful about where they allow loading and unloading, which poses a problem. If there is more than one company, the town has to decide who gets to use it. 8:14:00 PM Ms. Hauth said the primary concern is safety and where will they be allowed to load and unload. The next concern is where do they park the cars. Commissioner Gering said it doesn't sound workable to have two different operators in that same space. Mr. Peterson said it would be similar to the solid waste collection. They could have an exclusive franchise or a non- exclusive franchise and the town could design the parameters and guidelines of where they can and cannot park. Then they put it out for bid. He feels that having more than one provider downtown would be confusing and would not make sense. 8:15:23 PM Mayor Stevens said there are a few principles that they clearly agree on. They are not interested in leasing space that the town controls and also, they are not interested if all the businesses want the valet right in front of their business unless the town restaurants can work it out together and come to an agreement of one spot for loading /unloading and they can figure out how to get cars down to the deck or some other place. Knowing those are the limitations the town could facilitate that but they don't want to be in the business of managing it. Commissioner Gering said they would need to specify where they are allowed to park so they don't occupy the prime spots. Ms. Hauth said they should have to seek private parking and prove to the town who they have permission from for that privately owned parking. If they wanted to talk to First Baptist Church, one of the funeral homes or Orange County, who owns the parking deck, they need to prove to them where they will park the cars. Otherwise the police will be chasing valets all the time. 8:17:43 PM Ms. Hauth clarified with the Board they do not want to hire a valet and take any responsibility with this. Mayor Stevens said if the valet company and one business owner asks to do this, that will not work. If the downtown group, as a whole, comes to the Board and says they want to consider it, they will sit down and problem -solve and come up with some parameters. H. Consideration of Tourism Grant Awards 8:20:03 PM Commissioner Dancy moved to approve the Tourism Grant Applications as recommended by the Tourism Board. Commissioner Gering seconded. Mayor Stevens suggested to move the Workshop to Wednesday, June 26th at 7:00 pm. 8:24:19 PM Added Item: Resolution on the Closing of the Orange County Correctional Center on October 1, 2013. 8:25:44 PM Mr. Peterson said he sent an email out to the Board showing the financial impact on the town if it closes, which includes $140,000 in water /sewer revenue, replacement cost of the inmates is $250,000. They would not replace the inmates but that is the cost equivalent. It would end up costing more from an operations standpoint8:27:08 PMMayor Stevens said that was a mutually beneficial relationship to be able to spend that much money for services and get lots of job training and recommendations and shows a good partnership. 8:27:38 PM Commissioner Gering that aren't the only place where they can get that opportunity. He wonders what would be the best long term best use for that property for Hillsborough. The state has only used that as a prison and they don't have any other use for it. It will probably go back into private property and be more productive. It would be a better thing for Hillsborough's entranceway to be something other than a prison. 8:28:15 PM Commissioner Lowen said he thought about the same thing. The county has already had some discussion about building a facility just north of the prison. He wonders what they think about this because if it closes it is a perfect opportunity for them to just lease it from the state. They will still get the water, but they wouldn't have the prison and prisoners. Those prisoners are not sentenced so they don't have the flexibility that the state prisoners do. They will still get the water /sewer money. He wonders what the county thinks about it and if they are aware of it. 8:29:02 PM Commissioner Gering said his problem with this is the surprise factor. If Hillsborough had time to plan for a transition, and they had time to plan for what would come after then Orange County would have time to figure out what their options are and everyone would end up in a better spot. The fact that there's no time to plan or react is his biggest problem. If they are really bent on doing this the Board should ask them to consider the prospect of postponing it for a period of time to allow them to do some planning. 8:29:49 PM Commissioner Lloyd said the Senate wants to close it and the House is trying to keep it open. The County is very well aware of it but they didn't think about Hillsborough. She called Barry Jacobs and he said he hasn't even thought about the town. She sent him Mr. Peterson's email and he sent that to the County Commissioners. Each person on the Committee asked that the Board consider a resolution asking the House to work with the Senate to keep this unit open since the Governor did not want Orange County's unit closed. It was the Senate. The Special Appropriations Committee has to meet and decide by October 1, 2013, if not this coming 15 June 10, 2013 Town Board Regular Meeting Approved: September 9, 2013 Page 16 of 52 week. Mr. Peterson talked with Hank Elkins with the volunteer group. They have church groups go out there and it is really a good facility. If this facility closes, it would also take away the holding unit for the county. There is a $6 million unit in the prison that opened in 2010 that is not known about for placement of the mentally challenged or high risk inmates. She asked why the state would want to close a $6 million unit that taxpayers have paid for. The county is not interested in buying the prison because the prison is not designed as a jail. It is minimum security. The committee was concerned about the amount of money they received from the water /sewer fund. They were also concerned about the labor that the inmates bring to lay the water /sewer lines. The town estimates that the use of the resident inmate could save $250,000 per year. The town water and sanitary sewer services account for $130,000 to the town's water and sewer enterprise fund. She thinks it would be crazy for them not to fight to save it. She said Senator Kinard recommended it would be helpful if the town did this. Each member on the advisory committee took down two or three names and called them. They have worked hard and for the Board not to support this would be a slap in the face. Commissioner Gering said he understood everything she told him before. Commissioner Lloyd said they didn't have much time to do that. Commissioner Gering said if they were not going to entertain a modification to the resolution he cannot support it. Mayor Stevens asked what the modification would be. Commissioner Gering said to consider postponing the closure at least two years. Commissioner Lloyd said he must be dreaming. The Senate already has the first proposal done. Commissioner Gering said he feels it is in the long term interest of Hillsborough to keep it open. Commissioner Lloyd said they are being pushed at the moment and they can think about that later. Commissioner Gering said he feels he made himself clear. Commissioner Lloyd said she knew she wasn't going to convince him anyways. Mayor Stevens asked if it weakens it if they say to either to hold it open or hold it open for two years. 8:35:06 PM Commissioner Gering made a motion to amend the Resolution. The motion died for a lack of a second. 8:35:40 PM Commissioner Lloyd moved to accept the resolution as presented. Commissioner Dancy seconded. Upon a vote of 3 -lthe motion passed.
