HomeMy Public PortalAboutr 19-057� of toe �vroug4 of Carteret, N- 1- No. 19-57 Date of Adoptio Mamh 21, 201 RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY DESIGNATING THE AREA IDENTIFIED AS BLOCK 5801, LOT 1, BLOCK 5802, LOTS 10,19, 20, 21, 22, 23, 24, 25 & 30, AND BLOCK 6411, LOTS 7,8,9, 10 & 11 ON THE TAX MAP OF THE BOROUGH AS A CONDEMNATION AREA IN NEED OF REDEVELOPMENT PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW WHEREAS, the Borough of Carteret, a public body corporate and politic of the State of New Jersey (the "Borough ") is authorized pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1 et seq. (the "Redevelopment Law ") to determine whether certain parcels of land within the Borough constitute an area in need of rehabilitation and/or an area in need of redevelopment; and WHEREAS, by Resolution No. 18 -147, adopted on August 2, 2018, the Borough Council authorized and directed the Planning Board to conduct an investigation to determine whether the properties identified as Block 5801, Lot 1, Block 5802, Lots 10, 19, 20, 21, 22, 23, 24, 25 & 30, and Block 6411, Lots 7, 8, 9, 10 & 11 on the Official Tax Map of the Borough (collectively, the "Study Area ") constitute an area in need of redevelopment according to the criteria set forth in the Redevelopment Law; and WHEREAS, the aforesaid resolution authorized the Planning Board to investigate the Study Area as a Condemnation Redevelopment Area (as defined in Section 6(a) of the Redevelopment Law), within which the Borough may use all of those powers provided under the Redevelopment Law for use in a redevelopment area, including the power of eminent domain; and WHEREAS, the Planning Board caused Beacon Planning and Consulting Services, LLC (the "Planning Consultant ") to conduct a preliminary investigation to determine whether the Study Area should be designated as an area in need of redevelopment; and WHEREAS, the Planning Board received a report and map depicting the Study Area prepared by the Planning Consultant, entitled "Hilltop 11 Redevelopment Area Assessment ", dated August 2018 (the "Report"), concerning the determination of the Study Area as an area in need of redevelopment; and WHEREAS, on March 20, 2019, the Planning Board reviewed the Report, heard testimony from a representative of the Planning Consultant, and conducted a public hearing concerning the potential designation of the Study Area as an area in need of redevelopment; and WHEREAS, the Planning Consultant concluded in the Report and testified to the Planning Board on March 20, 2019 that the properties in the Study Area satisfy certain criteria for redevelopment area designation set forth in the Redevelopment Law; and WHEREAS, after the conclusion of the public hearing described above, the Planning Board determined that the Study Area satisfies the criteria set forth in the Redevelopment Law for designation as an area in need of redevelopment and determined that it would recommend that the Borough Council so designate the Study Area; and WHEREAS, on March 20, 2019, the Planning Board adopted a Resolution of Findings and Conclusions setting forth such findings and recommendations; and WHEREAS, the Borough Council agrees with the conclusions of the Planning Board that the Study Area satisfies the criteria for redevelopment area designation set forth in the Redevelopment Law and the Borough Council finds that such conclusion is supported by substantial evidence; and NO. 1 9-57 PAGE _ __ L _ WHEREAS, the Borough Council now desires to designate the Study Area as a Condemnation Redevelopment Area, pursuant to N.J. S.A. 40A: 12A-6. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: Section 1. The foregoing recitals are incorporated herein as if set forth in full Section 2. The Borough Council accepts the recommendations and conclusions of the Planning Board. Section 3. Based upon the findings and recommendations of the Planning Board, and the Borough Council's conclusion that such findings and recommendation are supported by substantial evidence, the Study Area is hereby designated as a Condemnation Redevelopment Area and, thus, the Borough may use all of those powers provided under the Redevelopment Law with respect to the Study Area for use in a redevelopment area, including the power of eminent domain. Section 4. The Borough is authorized to prepare a redevelopment plan for the Condemnation Redevelopment Area described herein, including an amendment to an existing redevelopment plan or a stand -alone redevelopment plan. Section 5. This resolution shall take effect in accordance with applicable law. Adopted this 21s` day of March, 2019 and certified as a true copy of the original on March 22, 2019. KATHLEEN M.
