Pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119.07 of the Florida Statutes I wish to
make a public records request of your agency for the following records:
Copies of all compact discs (CDs) magnetic tape or other recording material used to record the audio portion of
the entire public meeting of the ARPB held in Town Hall on Thursday, February 27, 2014. Record copy to be
identical to the original record in format, size, duration, quality and all other characteristics.
If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or
disclosure please cite the specific exemption as required by § 119.07(1)(e) of the Florida Statutes and state in
writing and with particularity the basis for your conclusions as required by § 119.07(1)(f) of the Florida Statutes.
Please take note of §I19.07(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge
receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts
to determine from other officers or employees within the agency whether such a record exists and, if so, the
location at which the record can be accessed." I am, therefore, requesting that you notify every individual in
possession of records that may be responsive to this public records request to preserve all such records on an
immediate basis.
If the public records being sought are maintained by your agency in an electronic format please produce the
records in the original electronic format in which they were created or received. See § 119.01(2)(0, Florida
Statutes.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of their
production with a written estimate of the total cost. Please be sure to itemize any estimates so as to indicate the
total number of pages and/or records, as well as to distinguish the cost of labor and materials.

Dear Mr. O'Hare [ chrisoharegulfstream @gmail.com],
The Town of Gulf Stream ( "the Town ") has received, since January 23, 2014, your public records requests as
listed on the attached Exhibit "A ".
You or others acting or purporting to act on your behalf have now made hundreds of public records requests to
the Town during the past six months. The breadth of your requests necessitates significant manpower and use of
information technology by the Town.
The Town has requested that you provide a deposit to cover the staff expenses associated with identifying,
gathering and producing the documents in accordance with Fla. Stat. § 119.07(4)(d). You have not arranged for
payment of the advance deposit on any such requests.
The chart attached as Exhibit `B" is a representative, but not inclusive, list of those requests for which a cost
estimate has been provided to you and/or an advance deposit has been requested. The chart does not include, for
example, another 146 public records requests for which the Town requires an advance deposit of $792.54 as
explained in the Town's correspondence to you dated January 23, 2013.
The Town will not process this new public records request, or any future public records requests filed by you,
until the aforementioned costs have been paid or otherwise resolved. See Lozman v. City of Riviera Beach, 995
So.2d 1027 (Fla. 4th DCA 2008) (denying petition for writ of mandamus to compel city to respond to second
public records request when citizen refused to pay for copies gathered in response to first request). Once the
Town has received your payments and deposits, the Town staff will proceed with processing your requests. Please
note that should you elect to withdraw your public records requests, the Town will still be entitled to bill you for
any work completed to date in order to respond to said request.
We are making every effort to provide additional public records on our website, www.gulf - stream.org. We will
be including the recordings of public meetings as soon as we are able.

The Town of Gulf Stream received your public records requests dated February 28, 2014. You

You will find an audio recording of each meeting by going to www.eulf- stream.org click on "I

0697.01.
If you should still desire other versions of the meeting, the Town may incur expenses for the
production of documents. You are responsible for the costs of duplication, as allowed by Chapter
119, Florida Statutes, and you may also incur a special service charge for the labor needed to
respond to this request.
To produce the documents that you have requested, the Town of Gulf Stream estimates the need
for 172 minutes of administrative support at $36.39 per hour, the labor cost of the personnel
providing the service, per Fla. Stat. § 119.07(4)(d). There will also be a charge of $3.98 for 2
CD's and 2 cassette tapes. If the costs of producing these documents will exceed your deposit,
the Town will provide you with an initial production of responsive records and an estimate for
the production of any additional responsive records. If the costs of production are less than the
deposit, the Town will provide you with the responsive records and a refund. If you would like to
narrow the scope of your request, for example, by identifying a particular document type or date
range, the Town may be able to provide these records at a lower cost.

The Town of Gulf Stream is currently working on a large number of incoming public records
requests. Upon receipt of your deposit, the Town will use its very best efforts to further respond
to your public records request in a reasonable amount of time.
