I do this pursuant to Florida Constitution Article 1, Section 24 and Florida Statutes Chapter 119.07. Any emails correspondence, letters, notes, communications, minutes, reports, notices, memos, digital ,files or any other documents in the public record regarding Craig or Mary Earnhart or regarding any property owned by Craig or Mary Earnhart which is located in the Town of Gulf Stream. Said records having been created or received by the Town during the period of time starting Jan. 1, 2013 to the moment when you received this record request. Any photo in the Town's public record of the property known as PC7V 2043460422000076o If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by Florida Statute fir1o.07(r)(e) and state in writing and with particularity the basis for your conclusions as required by Florida Statute §114.o7(1)(fl. Please take note of Florida Statue tit1o.o7(c) and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If the records are not available as digital records then please email me with instructions for me to pick the records up from you. I would prefer the records in electronic or digital form. If the public records being sought are maintained by your agency in an electronic format please produce the records in the original electronic format in which they were created or received. See Florida Statute §119.01(2)(f). If you anticipate the production of these public records will require a search of sufficient duration as to require any deposit payment from me, please notify my of any such required payment prior to conducting any portion of that search which would require such payment. If you anticipate the production of these public records to exceed $l.00 please notify me in advance of their production with a written estimate of the total cost. Please be sure to itemize any estimates so as to indicate the total number of pages and /or records, as well as to distinguish the cost of labor and materials prior to you expending any resources that would require payment from me. I am forwarding back to you the email you sent me on April 17. As you can see there is only one attachment. In that attachment is a letter from you which partially states: This letter is attached to an email that provides you with the full responsive Production of the public records requested in your email dated April 10, 2014 that we acknowledged on April 14, 2014. This correspondence is reproduced below for your convenience. Please open the attached files, which includes the documents that are responsive to your request. In addition, there are 4, 8'/ x 11 one -sided documents available for pick up at Town Hall. You say the full responsive records are attached but as you can see the only attachment is your letter telling me about another attachment that just isn't there. You also say that in addition there are 4 records to be picked up. Are these records to be picked up copies of the responsive records you claim to be attached or are they additional records. I don't know what you mean. Can you please send the "full responsive production of public records" you say were attached and tell me if the records to be picked up are the same records as these or different records. In your response you state: The Town will use its very best efforts to respond to you in a reasonable amount of time with the appropriate response or an estimated cost to respond. Please respond as soon as possible with whatever responsive records are conditioned such that they are easily obtained. I request you provide these "easily available" responsive records without delay and produce the "less easily available" records as time allows, within the parameters of compliance defined by State Statute. Please consider this email to be a clarification of my previous email public records request and not a new request. Please refer to the terms referenced in my original request.
