To whom it may concern,
Please forward this public record request to the Custodian of Records for your agency. I wish to make a
public records request of the Town of Gulf Stream for public records. I do this pursuant to Florida
Constitution Article 1, Section 24 and Florida Statutes Chapter 119.07.
Please provide all public records that are emails sent, or from, all email accounts used by Commissioner
Orthwein since April 1, 2014.
Please include records from all email accounts in the control of all town officials, appointees and
employees and include all records that are responsive to this request. If you contend that any of the
records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the
specific exemption as required by Florida Statute §119.07(1)(e) and state in writing and with
particularity the basis for your conclusions as required by Florida Statute §119.07(1)(f).
Please take note of Florida Statue §119.07(c) and your affirmative obligation to (1) promptly
acknowledge receipt of this public records request and (2) make a good faith effort which "includes
making reasonable efforts to determine from other officers or employees within the agency whether
such a record exists and, if so, the location at which the record can be accessed." I am, therefore,
requesting that you notify every individual in possession of records that may be responsive to this public
records request to preserve all such records on an immediate basis.
If some records that are responsive to my request are obtainable sooner than other responsive records,
I wish to receive those records as soon as they are available and I wish to receive the other records as
soon as they become available. I request that no responsive records be withheld from me while waiting
for other responsive records to be found.
If the records are not available as digital records then please email me with instructions for me to pick
the records up from you. I would prefer the records in electronic or digital form. If the public records
being sought are maintained by your agency in an electronic format please produce the records in the
original electronic format in which they were created or received. see Florida Statute §119.01(2)(f).
If you anticipate the production of some of these public records will require a search of sufficient
duration as to require any deposit payment from me, please notify me of any such required payment
prior to conducting any portion of that search which would require such payment. Please first produce
any responsive records that are readily available and do not require any deposit payment prior to
producing.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of
their production with a written estimate of the total cost. Please be sure to itemize any estimates so as
to indicate the total number of pages and /or records, as well as to distinguish the cost of labor and
materials prior to you expending any resources that would require payment from me.

commission regarding the many problems in our Code. One issue I believe is of
significant importance to many of you is the Town's restriction on fence height. I have
heard many comments from people about this issue.
During today's meeting of this committee, the Chairman asked the Town Manager and
Clerk why there is a 4' fence height limit in Place Au Soleil. Clerk Taylor explained that
the Town considers our neighborhood to be "open" with sweeping lawns and broad
spatial expanses and therefore fences over 4' would be inappropriate for Place Au
Soleil. Town Manager Thrasher responded that the committee has only received two
letters from residents and one public comment from O'Hare regarding the height
restriction. He calculated that since only three residents out of the hundred households
in Place Au Soleil seem to care about fence heights that this was only three percent of
the neighborhood and therefore insignificant and not worth the committee's
consideration.
I am writing you to make you aware that if you have a concern about fence heights in
Place Au Soleil, now may be the best time to make your concern known to the Town.
Homes with existing 6' fences are considered non -conforming and subject to whatever
enforcement Mr. Thrasher may someday deem appropriate. If you care to contact the

You may be aware that the Town of Gulf Stream has appointed a committee to review the Town's Zoning Code
for the purpose of making recommendations back to the commission regarding the many problems in our Code.
One issue I believe is of significant importance to many of you is the Town's restriction on fence height. I have
heard many comments from people about this issue.
During today's meeting of this committee, the Chairman asked the Town Manager and Clerk why there is a 4'
fence height limit in Place An Soleil. Clerk Taylor explained that the Town considers our neighborhood to be
"open" with sweeping lawns and broad spatial expanses and therefore fences over 4' would be inappropriate for
Place Au Soleil. Town Manager Thrasher responded that the committee has only received two letters from
residents and one public comment from O'Hare regarding the height restriction. He calculated that since only
three residents out of the hundred households in Place An Soleil seem to care about fence heights that this was
only three percent of the neighborhood and therefore insignificant and not worth the committee's consideration.
I am writing you to make you aware that if you have a concern about fence heights in Place Au Soleil, now may
be the best time to make your concern known to the Town. Homes with existing 6' fences are considered non-
conforming and subject to whatever enforcement Mr. Thrasher may someday deem appropriate. If you care to

Once again, I am writing in regards to the fence height restrictions placed on PAS in 2010. 1 would really appreciate a
response with answers as to how this code change came about and why.
It is my understanding that when Ad Hoc questioned returning the code to 6', the town clerk's response was that PAS is
considered "open" with sweeping lawns and that Mr. Thrasher indicated that with only two letters and one public
comment, this did not warrant consideration.
I am not sure how much thought really went into changing this code back in 2010. Maybe the code does not need to be
so broad and could allow 6' fencing around pools and be restricted to the rear property, still allowing the "open" front
lawns.
Please let me know how many letters and how many public comments it took to change the code to 4' in 2010

It has been brought to my attention that the Town of Gulf Stream does not plan on reversing the fence height restriction in
PAS that was changed to 4' in 2010. It seems that only three homeowners communicated with AdHoc regarding this
matter, therefore, not enough concern to change the code. I have written an e-mail to Mr. Thrasher stating that many
homes in PAS already have 5-6 foot fences that were installed prior to the change and that most likely they didn't feel the
need to write a letter regarding this matter.
Perhaps instead of waiting for residents to write to the town, the town might send out a questionnaire asking residents to
vote in favor of keeping the code at 4' or returning it to 6'.
If the above suggestion is not agreeable to your method of change, perhaps you could respond to my e-mail with what
measures prompted the change in 2010, so that we could proceed with the same measures in getting this code reversed.

Dear Neighbors,
Today at the public meeting of the Ad Hoc Committee, authorized by the Town Commission to review our
code, I was joined by Mr. Edward Slominski as the only members of the public in attendance. The agenda for
this meeting provided for public comment prior to discussion of the other items. However, at the beginning of
the meeting the chairman moved the public comment portion to be heard at the end of the meeting.
Unfortunately, this shuffling of agenda items prevented me and Ed from commenting on the issue of 6' fences
before the Committee discussed and voted on this item. When we finally got the opportunity to speak, did try to
convey to the Committee what we felt was the general consensus of the residents on Place Au Soleil on the
issue but it as only after the Committee had already voted.
Here is a summary of some of the actions by the Committee:
• It was commented that my (O'Hare's) email to neighbors of April 9th about the 6' fence issue was
misleading because it did not mention that 6' fences are allowed in the rear yard. (I know that is news to
many of you who have been told by Mr. Thrasher they could not have a 6' fence anywhere on their
property).
• Mr. Thrasher commented that even though the Town has received some emails in support of 6' fences in
Place Au Soleil, it was not enough to convince him that 6' fences are desired by the majority of the 100
homeowners in our neighborhood. It was suggested that a letter from the HOA in that regard would
make for a more convincing.
• Mr. Thrasher stated he knew of only one fence in Place Au Soleil made from PVC and it has been taken
down for lack of a permit. The general consensus among the Committee appeared to be that PVC was
too shiny, subject to early failure (brittle) and not to be allowed.
• Mr. Thrasher stated that the majority of properties in Place Au Soleil were "open" and he appeared to
advocate that it stays that way. Mr. Thrasher has previously defined "open" as a home's entry door must
be visible from the street.
• Mr. Thrasher proposed increasing the landscape regulations to require a permit for certain modifications
to an existing garden with penalties for changing any approved landscaping. Mr. Thrasher suggested he
should be able to review modifications to existing landscaping to determine that the plant type and
planting layout conforms to the "character" of the neighborhood. Discussion will continue as to what
degree of change will trigger the permit requirement either by dollar value, percent of change etc.
I encourage anyone who has an interest in these issues to attend these meetings or at the least, continue to share
your opinion with the Town via phone call or email.

After reading the responses I have to say it is absolutely wonderful that we all are positively participating
together to move toward a possible change in PAS! I don't think we are asking for anything unreasonable and
I'm very hopeful that these requests will be heard and dealt with fairly and respectfully.
I want to also mention that after thinking further and discussing it, my Husband and I also agree that chain link
with beautiful hedging, as is also used in Palm Beach and Manalapan and in many homes here is also a great
suggestion by Robert Dudley. As someone who has lived through many Hurricanes I can also attest to their
holding up the best during these strong storms. So, therefore we are requesting 6 foot chain link be considered
as well.
Charles Carlino pointed out a very important thought regarding our deteriorating barrier fences. This is
something people see as a reflection of our beautiful PAS and very importantly, it is a barrier! If it is weak,
Charles is correct, it is an open invitation for uninvited strangers.
I want to reiterate, that we are in agreement of 6 foot fences in PAS, I would also have to agree with another
email, that we should be very considerate in color choice and type in accordance with our homes.

I don't believe only 3 people care! I've had more than that respond to me
and you know who you are. We're all busy, it's easier to let this slide and
not write the Town....
but we need to stick together.
Here is an excerpt of my letter of 1/27 to the Ad -Hoc Committee:
"4 -foot fences do not address privacy nor safety. They look like Daycare Centers!
They are just too short. The original fences in PAS are 6 feet by choice, not mandate.
That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive,
need minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.

I agree with Robert. A properly installed six foot high chain link fence with an accompanying hedge is virtually
indestructible. It also provides security, and a great visual screen for the recreational toys that young families

QUESTION --- Why not chain-link. I lived through Hurricane Andrew in Cutler Ridge. The wooden and PVC
fence became flying missiles knocking out unprotected car and home windows. Our risk is low but PVC and
plastic fence owners should know that their fences will be gone when they return home. Pre -arrangements
should be made to keep their dogs and children inside for a few months until their fence can be replaced. The
chain link fence will not be blown away.
I also believe that neighbors who have these high fences should be allowed to keep small camper vans with

neighborhood more desirable for families who love camping, boating, and jet skiing. Home values would soar

I don't believe only 3 people care! I've had more than that respond to me and
you know who you are.We're all busy, it's easier to let this slide and not write
the Town....
but we need to stick together.
Here is an excerpt of my letter of 1/27 to the Ad -Hoc Committee:
"4 -foot fences do not address privacy nor safety. They look like Daycare Centers!
They are just too short. The original fences in PAS are 6 feet by choice, not mandate.
That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need
minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.!

I was ordered by Mr. Thrasher to take down my 6' PVC fence. I had it installed a few months ago. In fairness to
the Town the contractor never pulled a permit after he assured me that he did. It took weeks to have the
contactor take it down and more weeks to get my money back. Now it is an open area and looks terrible. The
PVC fence gave a positive look and gave my household some privacy.
I truly hope that in time that this can be reversed.

Chain link fences are currently allowed if they are screened from view. Aluminum rail fences are allowed

These regulations govern the five residential zoning districts but apparently not the Outdoor Recreational
district which is where the property with the continuous wood fence across the street from Walmart is located.
This property is regulated by Sec. 66-262 which can be seen at:

Other properties in Town with tall chain link fences are the two properties owned by the Florida Inland
Navigation District located to the north and to the south of Place Au Soleil. The Town's code exempts these
properties from any Town regulation. As well the lots located in the Conservation district are fenced with
exposed chain link but these properties belong to the Town and the Town apparently has chosen not to
follow its own chain link regulation at this location.
The objection to 6' fences made by Mr. Thrasher at the Ad Hoc meeting was that our neighborhood is
characterized by the Town as having open lawns and wide views. He interprets the code to mean fences and
landscaping must comply with that characterization. Apparently the government's aesthetic purpose is served
by limiting each property owners privacy.
The next Ad Hoc Committee meeting should be very interesting given all the comments the Town has received
about this issue.

There seems to be substantial Support for a 6' height limit at PAS
I personally, as an individual resident, also have no objection, as long as the appearance is in line with aesthetic
standards of the community.
I just want to remind all that the adoption of this new height may require us to put forward reasonable additional
standards to ensure a harmonious look. I mention this because we are having enough trouble having residents
keep up the perimeter walls of our neighborhood, which is explicitly the responsibility of individual owners.
This has caused some issues not only with aesthetics but with the security of our beloved PAS. I would not like
to see, as a resident, the extension of this problem to 6' high fences within the community.
I have not heard any dissension at this point so we'll take the matter to the board meeting and decide on the best
way to convey the will of the majority to the town.

Hi All,
After reading the responses I have to say it is absolutely wonderful that we all are positively participating
together to move toward a possible change in PAS! I don't think we are asking for anything unreasonable and
I'm very hopeful that these requests will be heard and dealt with fairly and respectfully.
I want to also mention that after thinking further and discussing it, my Husband and I also agree that chain link
with beautiful hedging, as is also used in Palm Beach and Manalapan and in many homes here is also a great
suggestion by Robert Dudley. As someone who has lived through many Hurricanes I can also attest to their
holding up the best during these strong storms. So, therefore we are requesting 6 foot chain link be considered
as well.
Charles Carlin pointed out a very important thought regarding our deteriorating barrier fences. This is
something people see as a reflection of our beautiful PAS and very importantly, it is a barrier! If it is weak,
Charles is correct, it is an open invitation for uninvited strangers.
I want to reiterate, that we are in agreement of 6 foot fences in PAS, I would also have to agree with another
email, that we should be very considerate in color choice and type in accordance with our homes.

They are just too short. The original fences in PAS are 6 feet by choice, not mandate.

minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.

Attention Dear Neighbors,
Please write a few sentences to vote to have the original 6- foot height
allowance reinstated in PAS, because as Chris O'Hare's recent e-mail to us all states:
"Town Manager Thrasher responded that the committee has only received two letters from
residents and one public comment from O'Hare regarding the height restriction. He calculated
that since only three residents out of the hundred households in Place Au Soleil seem to care
about fence heights that this was only three percent of the neighborhood and, therefore,
insignificant and not worth the committee's consideration."
I don't believe only 3 people care! I've had more than that respond to me and you know
who you are. We're all busy, it's easier to let this slide and not write the Town....
but we need to stick together.
Here is an excerpt of my letter of 1/27 to the Ad -Hoc Committee:
"4 -foot fences do not address privacy nor safety. They look like Daycare Centers! They are just
too short. The original fences in PAS are 6 feet by choice, not mandate. That should
be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need minimal
maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply jot a brief
note to have the original 6 -foot height reinstated and do it now. Someday this may
affect your home improvement!
Just reply to all above, and include BThrasher( gulf -stream orr .

Attention Dear Neighbors,
Please write a few sentences to vote to have the original 6- foot height
allowance reinstated in PAS, because as Chris O'Hare's recent e-mail to us all
states:
"Town Manager Thrasher responded that the committee has only received two
letters from residents and one public comment from O'Hare regarding the height
restriction. He calculated that since only three residents out of the hundred
households in Place Au Soleil seem to care about fence heights that this was
only three percent of the neighborhood and, therefore, insignificant and not
worth the committee's consideration."
I don't believe only 3 people care! I've had more than that respond to me and
you know who you are. We're all busy, it's easier to let this slide and not write
the Town....
but we need to stick together.
Here is an excerpt of my letter of 1/27 to the Ad -Hoc Committee:
"4 -foot fences do not address privacy nor safety. They look like Daycare Centers!
They are just too short. The original fences in PAS are 6 feet by choice, not mandate.
That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need
minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.)

Privacy in 6 foot fences, absolutely.
Safety, not so much.
Plain wood looks ugly after a while, and even when new they are an eyesore. (Just look
at the new fence along Federal).
If wood, then painted. PVC should be white.

jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.)

We are in agreement to reinstate the 6ft height fences, PVC included in PAS. Safety and Privacy
are of the most importance for all of us. As well as maintenance free.

"4 -foot fences do not address privacy nor safety. They look like Daycare Centers!
They are just too short. The original fences in PAS are 6 feet by choice, not mandate.
That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need
minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement.
Just reply to all above, and include BThrasher@gulf-stream.org.

That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need
minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply
jot a brief note to have the original 6 -foot height reinstated and do it
now. Someday this may affect your home improvement!
