To whom it may concern,
Please forward this public record request to the Custodian of Records for your agency. I wish to make a
public records request of the Town of Gulf Stream for public records. I do this pursuant to Florida
Constitution Article 1, Section 24 and Florida Statutes Chapter 119.07.
Please provide all public records that are emails sent, or from, all email accounts used by
Commissioner White since April 1, 2014.
Please include records from all email accounts in the control of all town officials, appointees and
employees and include all records that are responsive to this request. If you contend that any of the
records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the
specific exemption as required by Florida Statute §119.07(1)(e) and state in writing and with
particularity the basis for your conclusions as required by Florida Statute §119.07(1)(f).
Please take note of Florida Statue §119.07(c) and your affirmative obligation to (1) promptly
acknowledge receipt of this public records request and (2) make a good faith effort which "includes
making reasonable efforts to determine from other officers or employees within the agency whether
such a record exists and, if so, the location at which the record can be accessed." I am, therefore,
requesting that you notify every individual in possession of records that may be responsive to this public
records request to preserve all such records on an immediate basis.
If some records that are responsive to my request are obtainable sooner than other responsive records,
I wish to receive those records as soon as they are available and I wish to receive the other records as
soon as they become available. I request that no responsive records be withheld from me while waiting
for other responsive records to be found.
If the records are not available as digital records then please email me with instructions for me to pick
the records up from you. I would prefer the records in electronic or digital form. If the public records
being sought are maintained by your agency in an electronic format please produce the records in the
original electronic format in which they were created or received. See Florida Statute §119.01(2)(f).
If you anticipate the production of some of these public records will require a search of sufficient
duration as to require any deposit payment from me, please notify me of any such required payment
prior to conducting any portion of that search which would require such payment. Please first produce
any responsive records that are readily available and do not require any deposit payment prior to
producing.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of
their production with a written estimate of the total cost. Please be sure to itemize any estimates so as

You have asked that the Town only provide those records that do not require extensive use of
information technologies or extensive staff time or both in excess of 15 minutes and that the
Town provide an estimate of the cost that would be required to fulfill the request as permitted by
the Public Records Act. To that end, the Town has spent at least 15 minutes on your request and
is providing you with a response at the same link above.
The Town estimates to fully respond to your request will require an additional hour of
administrative support at $35.60 per hour, the labor cost of the personnel providing the service,

Dear Neighbor,
You may be aware that the Town of Gulf Stream has appointed a committee to review the
Town's Zoning Code for the purpose of making recommendations back to the commission
regarding the many problems in our Code. One issue I believe is of significant importance to
many of you is the Town's restriction on fence height. I have heard many comments from people
about this issue.
During today's meeting of this committee, the Chairman asked the Town Manager and Clerk
why there is a 4' fence height limit in Place Au Soleil. Clerk Taylor explained that the Town
considers our neighborhood to be "open" with sweeping lawns and broad spatial expanses and
therefore fences over 4' would be inappropriate for Place An Soleil. Town Manager Thrasher
responded that the committee has only received two letters from residents and one public
comment from O'Hare regarding the height restriction. He calculated that since only three
residents out of the hundred households in Place Au Soleil seem to care about fence heights that
this was only three percent of the neighborhood and therefore insignificant and not worth the
committee's consideration.
I am writing you to make you aware that if you have a concern about fence heights in Place An
Soleil, now may be the best time to make your concern known to the Town. Homes with existing
6' fences are considered non -conforming and subject to whatever enforcement Mr. Thrasher may

If this project is allowed
to move forward without
quiet zones, neighbor-
hoods near the tracks will
be severely impacted,

come unsustainable.
Although our elect-
ed officials have been
proactive in searching
for money for the up-
grades, sufficient funds
have not been identi-
fied, and there is a grow-
ing risk that this project
could move forward with
no quiet zones. I believe
that residents support
the All Aboard Florida
venture only if the safety
upgrades are implement-
ed for both safety and for
quiet zones. Our officials
must use every means
available to them to en-
sure that the highest safe-
ty standards are imple-
mented so our neighbor-
hoods are safer and qui-
eter, even if that means
slowing down the project
until the required fund-
ing is identified.

Nothing grabs headlines like a good old-fashioned
murder charge. And that's what prosecutors got last
J year when they threw the book at an alleged pill -mill
doctor, charging him with two counts of first-degree
murder after patients died from overdoses. As if that
weren't splashy enough, they announced less than two
months later that they would seek the death penalty,
an unprecedented move vastly out of proportion with
the facts of the case.
This may not be good lawyering, but it certainly
made good politics. State Attorney Dave Aronberg had
campaigned for office on a tough record of fighting
painkiller -selling pill mills.
Thankfully, though, these out -of -whack moves hav-
en't stood up to scrutiny. Prosecutors quickly backed
off the announcement last year that they would seek
the death penalty. Now they have sheepishly dropped
both murder charges against the ex -doctor, John Chris-
tensen, choosing to go after him on manslaughter
charges instead.
The new charges are less sensational but much more
sensible. Given the accusations against Christensen,
authorities certainly

Typically, first-degree murder requires premedita-
tion. But there are two exceptions: when a person is
killed while the defendant is committing a felony, and
when a person dies from consuming a controlled nar-
cotic that the defendant illegally provided.
This last variant does not require premeditation.
But it was put into law to combat drug dealers, not li-
censed doctors who prescribe legal, controlled sub-
stances. In Christensen's case, his lawyer says prosecu-
tors were forced to drop the murder charges because
of legal technicalities surrounding the statute and the
discovery that Christensen didn't prescribe the final
set of painkillers to one patient.
Trying to convict a doctor of murder for overpre-
scribing painkillers has never succeeded in Flori-
da. Since people who overdose often die with multi-

The Land Development Regulations of the City of Delray Beach requires that notice be
given to an adjacent municipality whenever a development application involves land use
review or implements a development activity proposed within the Comprehensive Plan, and
is located within one-quarter (1/4) mile of the boundary of the adjacent unit of government.
The City Commission will consider Ordinance 16-14 correcting a scriveners error in the
legal description of Ordinance No.19-94 for properties located at 2001 North Federal
Highway. On May 17, 1994, the City Commission approved the City -initiated annexation of
the subject property via Ordinance No. 19-94. The subject property herein referenced
contains three parcels.
The parcel described in Ordinance No. 19-94 excluded a sliver of land which was
technically outside of the City's jurisdiction. Upon review of the supporting documentation
for Ordinance No. 19-94, it is clear from the text and maps contained in the staff report that
it was the intent of the City to annex the entire property.
The City Commission will consider second reading and adoption of the enacting ordinance
on Tuesday, June 3, 2014 at 7:00 p.m. in the City Commission Chambers at City Hall,

contained two parcels which had property control numbers of 00-43-46-04-00-000-5040
and 00-43-46-04-00-000-5041 (your property) prior to the annexation.
The property described in Section 1 of Ordinance No. 18-94 omits a 0.09 acre area
adjacent to US Highway No.1 (shaded area on attached map) whereas it is clear from the
supporting documentation and map exhibits that it was the intent of the City to annex the
entire property.

Dear Mr. Thrasher:
The Land Development Regulations of the City of Delray Beach requires that notice
be given to an adjacent municipality whenever a development application involves
land use review or implements a development activity proposed within the
Comprehensive Plan, and is located within one-quarter (1/4) mile of the boundary of

Previously you were notified of the proposed actions pertaining to the property
located at 2001 and 2101 North Federal Highway which is located on the east side
of North Federal Highway immediately north of Kokomo Key Lane (former Delray
Swap Shop). The proposal includes the following actions:
Privately -initiated amendments to the Future Land Use Element of the
Comprehensive Plan pertaining to the description of the General Commercial
Land Use designation and Policy A-7.2 to allow an increase in the maximum
density to 24 units per acre and establishing a maximum Floor Area Ratio (FAR)
of 0.75 for lands located within the Infill Workforce Housing Overlay District.

housing development containing 205 units within the GC (General Commercial)
zoning district at a density above 12 units per acre (23.9 du/acre proposed) on
the 8.57 acre site.

Once again, I am writing in regards to the fence height restrictions placed on PAS in 2010. 1 would
really appreciate a response with answers as to how this code change came about and why.
It is my understanding that when Ad Hoc questioned returning the code to 6', the town clerk's response
was that PAS is considered "open" with sweeping lawns and that Mr. Thrasher indicated that with only
two letters and one public comment, this did not warrant consideration.
I am not sure how much thought really went into changing this code back in 2010. Maybe the code does
not need to be so broad and could allow 6' fencing around pools and be restricted to the rear property,
still allowing the "open" front lawns.
Please let me know how many letters and how many public comments it took to change the code to 4' in
2010.

Dear Gulf Stream Commissioners
It has been brought to my attention that the Town of Gulf Stream does not plan on reversing the fence
height restriction in PAS that was changed to 4' in 2010. It seems that only three homeowners
communicated with AdHoc regarding this matter, therefore, not enough concern to change the code. I
have written an e-mail to Mr. Thrasher stating that many homes in PAS already have 5-6 foot fences that
were installed prior to the change and that most likely they didn't feel the need to write a letter regarding
this matter.
Perhaps instead of waiting for residents to write to the town, the town might send out a questionnaire
asking residents to vote in favor of keeping the code at 4' or returning it to 6'.
If the above suggestion is not agreeable to your method of change, perhaps you could respond to my e-
mail with what measures prompted the change in 2010, so that we could proceed with the same
measures in getting this code reversed.

Never know when you're out of town, and I know that makes communication more
difficult. However, I think it is important to follow up on the Ad Hoc Committee's report
regarding issues in PAS. I sent out an e-mail on May 12 regarding this issue, wherein the
minutes of the May 8th Ad Hoc meeting are published on the Town's website (www.eulf-
stream.or . The Committee makes numerous references to PAS and the HOA's role in supplying
the majority opinion of the PAS residents to the Town and ARPB on the fence issues and the
front lawn planting (open vista) issues. I don't know if you have had the opportunity to speak to
the Town since our last HOA meeting, but the next Commission meeting is on June 13 and I
would like to have some input or state of information to present to the Town.

That should be enough indication that residents prefer 6 -foot fencing.
I also think that white vinyl fences, of which we have many in PAS, are attractive, need
minimal maintenance, provide consistency and should be allowed again."
Please be proactive! Even if you already HAVE a 6 -foot fence, simply jot a
brief note to have the original 6 -foot height reinstated and do it now.
Someday this may affect your home improvements

Dear Neighbors,
Today at the public meeting of the Ad Hoc Committee, authorized by the Town Commission to
review our code, I was joined by Mr. Edward Slominski as the only members of the public in
attendance. The agenda for this meeting provided for public comment prior to discussion of the
other items. However, at the beginning of the meeting the chairman moved the public
comment portion to be heard at the end of the meeting. Unfortunately, this shuffling of agenda
items prevented me and Ed from commenting on the issue of 6' fences before the Committee
discussed and voted on this item. When we finally got the opportunity to speak, did try to convey
to the Committee what we felt was the general consensus of the residents on Place Au Soleil on
the issue but it as only after the Committee had already voted.
Here is a summary of some of the actions by the Committee:
• It was commented that my (O'Hare's) email to neighbors of April 9th about the 6' fence
issue was misleading because it did not mention that 6' fences are allowed in the rear
yard. (I know that is news to many of you who have been told by Mr. Thrasher they could
not have a 6' fence anywhere on their property).
• Mr. Thrasher commented that even though the Town has received some emails in support
of 6' fences in Place Au Soleil, it was not enough to convince him that 6' fences are
desired by the majority of the 100 homeowners in our neighborhood. It was suggested
that a letter from the HOA in that regard would make for a more convincing.
• Mr. Thrasher stated he knew of only one fence in Place Au Soleil made from PVC and it
has been taken down for lack of a permit. The general consensus among the Committee
appeared to be that PVC was too shiny, subject to early failure (brittle) and not to be
allowed.
• Mr. Thrasher stated that the majority of properties in Place Au Soleil were "open" and he
appeared to advocate that it stays that way. Mr. Thrasher has previously defined "open"
as a home's entry door must be visible from the street.
• Mr. Thrasher proposed increasing the landscape regulations to require a permit for certain
modifications to an existing garden with penalties for changing any approved
landscaping. Mr. Thrasher suggested he should be able to review modifications to
existing landscaping to determine that the plant type and planting layout conforms to the
"character" of the neighborhood. Discussion will continue as to what degree of change
will trigger the permit requirement either by dollar value, percent of change etc.
I encourage anyone who has an interest in these issues to attend these meetings or at the least,
continue to share your opinion with the Town via phone call or email.

I want to also mention that after thinking further and discussing it, my Husband and I also agree
that chain link with beautiful hedging, as is also used in Palm Beach and Manalapan and in many
homes here is also a great suggestion by Robert Dudley. As someone who has lived through
many Hurricanes I can also attest to their holding up the best during these strong storms. So,
therefore we are requesting 6 foot chain link be considered as well.
Charles Carlino pointed out a very important thought regarding our deteriorating barrier fences.
This is something people see as a reflection of our beautiful PAS and very importantly, it is a
barrier! If it is weak, Charles is correct, it is an open invitation for uninvited strangers.
I want to reiterate, that we are in agreement of 6 foot fences in PAS, I would also have to agree
with another email, that we should be very considerate in color choice and type in accordance
with our homes.

According to the architect this is a "clean" application and there are no requests for special
concession or a variance. Mr. Hartung at 2740 Cardinal Circle asked for a few considerations
such as a specific species of tree to be located on the east side of the lot, moving exterior pole
lighting to the east further away from his property and for the dumpster to be relocated to the
north side of the lot which would be away from their home.
I just spoke with the architect and he informed me that the developer was open to changing his
plans consistent with Mr. Hartung requests except the relocation of the dumpster. The PAS
neighbor, Mr. Hartung, feels that the waste hauler will constantly be making early morning
noise. The owner/developer feels that there is a restriction in the hours of pickup and therefore
will not disturb Mr. Hartung.
This development application will be discussed at the Wednesday meeting. I will make sure
that the Mr. Hartung knows about the meeting.
