HomeMy Public PortalAboutOrdinance 01:48Councilman Presents th~ following Ordinanc~ Seconded by Councilman AN O~INANCE TO AMEND AND SUPPLEMENT CHAPTER 55, ENTITLED "ZONE DEVELOPMENT CO~ORATION", OF THE CODE OF THE BOROUGH OF CARTE~T BE IT ORDAINED by the Governing Body of the Borough of Carteret (the "Borough") as follows: Section 1. Section 55-2 of Chapter 55 ("Zone Development Corporation") of the Code of the Borough of Carteret is hereby revised to read as follows: 55-2. Membership. A. The Board of Trustees shall be composed of seven (7) Regular Members who, except as provided for herein, shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of four (4) years. Only Regular Members shall be authorized to vote upon matters requiring formal action by the Board. The Regular Members shall consist of the following: I. The Mayor 2. One (1) member of the Borough Council appointed mmually by the Council 3. One (1) other Borough official, officer or employee 4. Four (4) residents of the Borough and/or members of the business community thereof, who shall be appointed so as to ensure that the total membership of the Board shall be broadly representative of businesses and communities within the Borough. Thc initial appointments of the resident/business members to the Board of Trustecs as reconstituted pursuant to this Ordinance shall be as follows: 1. One (1) person shall be appointed for one (1) year 2. One (1) person shall be appointed for two (2) years 3. One (1) person shall be appointed for three (3) years 4. One (1) person shall be appointed for four (4) years B. In addition to the Regular Members, the Board of Trustees shall have twelve (12) Advisory Members who shall not have a vote on matters requiring formal action by the Board. Advisory Members shall be residents of the Borough and/or members of the business community thereof, and shall, collectively, be broadly representative of the businesses ' and community organizations xvithin the Borough. Advisory Members shall be appointed by the Mayor with the advice and consent of the Borough Council, for a term of four (4) years. NO. 61.~48 PAGE2 of 2 The initial appointments of the Advisory Members to the Board of Trustees as reconstituted pursuant to this Ordinance shall be as follows: 1. Three (3) members shall be appointed for one (1) year 2. Three (3) members shall be appointed for two (2) years 3. Three (3) members shall be appointed for three (3) years 4. Three (3) members shall be appointed for four (4) years C. All members of the Board of Trustees shall serve on a non-salaried basis. Section 2. Subsection 55-3(A) of Chapter 55 ("Zone Development Corporation") of the Code of the Borough of Carteret is hereby revised to read as follows: 55-3. Meetings; submission of plans to borough. A. The Board of Trustees shall, at a minimum, hold regularly scheduled monthly meetings. Section 3. Section 55-4 of Chapter 55 ("Zone Development Corporation") is hereby revised to read as follows: 55-4. Responsibilities. It shall be the responsibility of the Zone Development Officer, who shall be appointed annually by the Mayor with the advice and consent of the Borough Council, with review by and comments of the Board of Trustees, to ensure that all provisions of the Urban Enterprise Zones Act (N.J.S.A. 52:27H-60, et seq.) are adhered to during the life of a zone designation. Section 4. The Board of Trustees as reconfigured pursuant to this Ordinance, shall be established effective January 1, 2002. The terms of the present members of the Board of Trustees and the Zone Development Officer shall expire on December 31, 2001. Said individuals shall continue in office until their successor shall have been appointed and qualified. Section 5. Any provision of Chapter 55 ("Zone Development Corporation") not amended or revised by this Ordinance shall remain in full force and effect. Section 6. All ordinances or parts thereof inconsistent with the provision of this Ordinance arc hereby repealed limited to the extent of any such inconsistency. Section 7. If any section, paragraph, sub-division, clause, or phrase of this Ordinance shall be declared invalid by any Court of competent jurisdiction, the section, paragraph, sub-division, clause or phrase shall be deemed severable from the remainder of this Ordinance. Section 8. This Ordinance shall take effect immediately upon final passage and publication according to applicable law.
