CALL TO ORDER Mayor Kelley called the meeting to order at 7:05 p.m. in the Council Chambers of the Richland Hills City Hall, 3200 Diana Drive, Richland Hills, Texas. Councilmembers Present: Pat Watkins, Reta P. Kaastad and LaRue Wall. Councilmembers Absent: Horace Hamilton and Larry Wilson City Staff Present: City Manager James W. Quin, City Secretary Terri Willis and City Attorney Paul Wieneskie. 2. CONSIDERATION OF ITEMS RELATED TO THE NOVEMBER 7, 1995 SPECIAL ELECTION A. Canvass Results of Election Ms. Jean Spieker, Alternate Judge, canvassed the results of the November 7, 1995 election as follows: EARLY ELECTION PROPOSITION NO. 1 VOTES DAY VOTES TOTAL FOR THE RESOLUTION 104 448 552 AGAINST THE RESOLUTION 112 368 480 PROPOSITION NO. 2 FOR THE ISSUANCE 69 315 384 OF BONDS AGAINST THE ISSUANCE 146 503 649 OF BONDS TOTAL VOTES CAST 224 844 1,068 B. Consideration of Adoption of an Ordinance Declaring the Results of Said Election • At this time, the City Council considered adoption of the ordinance declaring the results of the election as follows: MINUTES OF THE RICHLAND HILLS CITY COUNCIL • SPECIAL MEETING NOVEMBER 9, 1995 PAGE 2 B. Consideration of Adoption of an Ordinance Declaring the Results of Said Election (Cont'd.) PROPOSITION NO. 1 PROPOSED RESOLUTION NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richland Hills, that the City Council hereby states its intent to honor the Interlocal Agreement with the State of Texas and the Texas Department of Transportation, dated March 28, 1994, and agrees to participate in street and drainage improvements to that portion of Handley-Ederville Road, north of Texas Highway 121, and south of Texas Highway Business 183, in the city limits of Richland Hills, Texas; and, BE IT FURTHER RESOLVED, that the City Council hereby commits such funds as are required to satisfy the City's twenty percent (20~) share of the estimated expenditure for . completion of said project. 552 VOTES: FOR THE RESOLUTION ) 480 VOTES: AGAINST THE RESOLUTION ) PROPOSITION NO. 2 384 VOTES: FOR ) THE ISSUANCE OF $865,000 STREET IMPROVEMENT TAX BONDS FOR HANDLEY-EDERVILLE ROAD 649 VOTES: AGAINST ) MOTION: A motion was made by Councilmember Kaastad, and seconded by Councilmember Watkins, to adopt the ordinance declaring the results of the November 7, 1995 Special Election. The motion unanimously carried. (Ordinance No. 769-95) Mayor Kelley recessed the Special Meeting at 7:10 p.m., in order to enter into Executive Session. • MINUTES OF THE RICHLAND HILLS CITY COUNCIL • SPECIAL MEETING NOVEMBER 9, 1995 PAGE 3 3. EXECUTIVE SESSION - Consideration of Entering into Executive Session in Accord with Chapter 551, Section 551.071, of the Texas Government Code to Discuss the Following Matters: A. Discuss with City Attorneys and Special Contract Engineers the EPA Administrative Order, Docket No. VI-95- 2520; and, B. Discuss Pending Litigation - David Ainslie vs. City of Richland Bills. Mayor Kelley convened the City Council into Executive Session at 7:12 p.m. in the Council Conference Room. The Executive Session adjourned at 8:49 p.m. 4. RECONVENE INTO OPEN SESSION - Consideration of Action to be Taken on the Matters Discussed in Executive Session in Accord • with Chapter 551 of the Texas Government Code. Mayor Kelley reconvened the Special Meeting at 8:50 p.m. in the Council Chambers. MOTION: A motion was made by Councilmember Kaastad, and seconded by Councilmember Watkins, to approve the draft report submitted by Carter & Burgess to be submitted to the Environmental Protection Agency (EPA) in response to the Administrative Order, which includes a draft expenditure of $200,000 for a study to be done in order for the City to comply with the EPA Administrative Order.
