AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING
SECTION 25- 80- 3(B)(1) OF THE LYNWOOD MUNICIPAL CODE RELATED TO
APPROVAL OF WIRELESS ANTENNA FACILITIES
WHEREAS, the City has determined that the development of
telecommunications systems may provide significant benefits for, and have substantial
impacts upon, the residents and the business community of the City; and
WHEREAS, the City seeks to encourage the profitable deployment of advanced
telecommunications infrastructures that satisfy local needs, and deliver enhanced
government services to the City; and
WHEREAS, on February 10, 2015, the Planning Commission held a duly noticed
public hearing regarding the proposed change to the Chapter 25 of the Lynwood
Municipal Code involving zoning and wireless antennas and unanimously
recommended denial of the amendment to the City Council; and
WHEREAS, on March 3, 2015, the City Council held a duly noticed public
hearing regarding the proposed change to the Chapter 25 of the Lynwood Municipal
Code involving zoning and wireless antennas; and
WHEREAS, the Lynwood City Council has carefully considered all oral and written
testimony offered at the public hearing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
ORDAIN AS FOLLOWS:
Section 1. That all of the facts set forth in the Recitals above are true and
correct.
Section 2. Based upon substantial evidence presented to this City Council
during the public hearing conducted with regard to the application, including written staff! -
reports, verbal testimony, and pursuant to Lynwood Municipal Code Section 25- 114 -4,
this City Council hereby finds and determines as follows:
A. That the proposed amendment is consistent with the goals, policies, and
objectives of the general plan; and the proposed amendment allows for the
continued development of telecommunications systems which may provide
significant benefits for, and have substantial impacts upon, the residents and the
business community of the City, thereby advancing the goal of the General Plan
Goal 4.7.6; TEL -1 to provide sufficient telephone services to support existing and
future demand. �
Section 5. This Ordinance shall go into effect and be in full force and operation
from and after thirty (30) days from the date of its final passage and adoption. However,
nothing prohibits the City from extending a grace period prior to enforcement of the
Ordinance.
Section 6. The City Council finds that this Ordinance is exempt from the
requirements of the California Environmental Quality Act ( "CEQA "). The Ordinance is
exempt from CEQA in its entirety pursuant to Section 15061(b)(3) of Title 14 of the
California Code of Regulations because it can be seen with certainty that there is no
possibility that"the Ordinance may have a significant effect on the environment.
Section 7. If any chapter, section, subsection, subdivision, paragraph,
sentence, clause or phrase, or portion of this Ordinance, or the application thereof to
any person, is for any reason held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance or its application to other persons. The City
Council hereby declares that it would have adopted this Ordinance and each chapter,
section, subsection, subdivision, paragraph, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, subsections,
subdivisions, sentences, clauses, phrases, or portions of the application thereof to any
person, be declared invalid or unconstitutional.
First read at a regular meeting of the City Council held on the 3rd day of. March, 2015
and adopted and ordered published at a regular meeting of said Council on the 17th day
of March, 2015.
