AWARDING BID FOR ARTS DISTRICT STREETSCAPE
IMPROVEMENTSPHASEICONTRACT
WHEREAS, the Borough has publicly advertised for the receipt of bids for the Arts District Streetscape
Improvements Project Phase I Contract; and
WHEREAS, the Borough has solicited and received five (5) bid proposals for the Arts District Streetscape
Improvements Project Phase I as follows:
WHEREAS, S. Brothers General Contracts has submitted the lowest bid for said contract as evidenced by
the response on file with the Borough's Purchasing Department and with the Borough Engineer; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award
of a contract to S. Brothers General Contractors, in a total amount not to exceed $483,457.27, per attached
award letter; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose.

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as
follows:
That the appropriate Borough Officials are hereby authorized to enter into a contract
with S. Brothers General Contractors of South River, N.J. for the Arts District
Streetscape Improvements Project Phase I as described above for the sum of
$483,457.27 for the Base Bid and Addition Item A in accordance in all respects with
the request for proposals and bid on same.
2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department, CME Associates and Borough Director of Engineering.
3. That the aforementioned award of bid is contingent upon formal approval from the
New Jersey Department of Labor, Division of Wage and Hour Compliance.

Dear Mayor and Borough Council:
Enclosed herewith please find a summary of bids received on April 25, 2019, for the above
referenced project. A total of five (5) bids were submitted, ranging from an apparent low base bid of
$409,323.15 by Zenith Construction Services, Inc. to a high base bid of $488,590.00 by S. Batata
Construction. Please find enclosed a complete Summary of Bids for the Council's review.
Upon analysis of solely the base bid, Zenith Construction Services is the low bidder; however, S.
Brothers is the low bidder considering award of the Addition Item. It should be noted that there were
irregularities present in several of the bids submitted, including those of the low bidders. We believe
that these irregularities are minor in nature and not a mandatory cause for rejection; therefore, the
outcome of the bid is unaffected.
As a matter of procedure, our office has contacted S. Brothers, Inc. to discuss their bid. The
representatives we spoke to indicated they are comfortable with the bid as submitted and there is no
objection to completing the project based on the bid prices submitted and the contract time.
Based on this information, we recommend the following actions:
1. Award of the contract to the low bidder, S. Brothers Inc., PO Box 317, South River, NJ 08882
within 60 calendar days, on a unit price basis in the total amount of $483,457.27 for Base Bid
Items 1 through 37, inclusive, and Addition Items A -1 through A -14, inclusive, as available
funding permits. The award should be subject to review and approval by the NJDOT Local Aid

Office and the Borough Attorney, including concurrence to waive the minor Irregularities, the
review of the bid bond and surety from the low bidder, and submission of the required bonds and
insurance certificates for the project.
2. Bid and bid security of the second and third low bidder be retained and held open, pending
execution of the contract agreement by S. Brothers, Inc.
By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of
Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded
to my office for further execution.
