The following guests were present: Councilman Carlos Graham; Paul Samson and Mike Bates with CMPS; Gilbert Cole with Missouri American Water Company; Eric Landwehr with Cole County Public Works; Representing Frog Hollow Neighborhood: John Howland, Bill Ratliff, Gretta Ratliff, Steve Enloe, Jim Scroggins and Lou Gutman; Representing the JC Hangar Association: Duane Schreimann and Steve Howard; Representing Capital Region Medical Center: Sam Bushman, Ed Farnsworth, Martin Grabanski, Jack Pletz, Tim Luebbering and Jim Wisch; Madeleine Leroux, News Tribune; and Reporter with KMIZ. 1) Introductions Those present introduced themselves. 2) Approval of the July 18, 2013 Committee meeting minutes Councilman Bray moved and Councilman Branch seconded to approve the July 18, 2013 minutes, motion carried. Councilwoman Carroll was absent for this vote. 3) Citizen opportunity to address Council/Staff on Stormwater and Other Public Works Issues 1. John Howland -Edgewood Striping *Carrie Carroll arrived at this time (7:35 a.m.). Minutes/Jefferson City Public Works and Planning Committee August 22, 2013 There was discussion among Committee members, staff and those present regarding safety issues, traffic volumes, speed, and upcoming improvements in the area. 2 Mr. Morasch stated staff would do a thorough study of the traffic and bring this item back to the Committee. Staff would also put in the white stripes for the crosswalk in the area. Councilwoman Carroll requested staff to keep the residents in the neighborhood informed of progress. 4) Consent Items Recommended for Approval 1. Permissive Use of Right-of-Way for Dumpsters on Grey F.ox Terrace (Britt Smith) 2. Permissive Use of Right-of-Way for Signage at 1003 East McCarty Street (SCL Property Management, LLC; Requestor) (Britt Smith) 3. Adopt-A-Spot at the corner of High Street and McCarty Street Warwick Village (East Side Business Association, Requestor) (Britt Smith) 4. Placement of River City Habitat Cottages (Kelly Smith, Requestor) (Janice McMillan/Britt Smith): a) 2284 Hyde Park Road b) Lot 24 off East McCarty Street Councilman Branch moved and Councilwoman Carroll seconded to recommend the Consent Items be forwarded to the City Council with recommendation to approve, motion carried. 5) Old Business 1. Jefferson City Hangar Association Ground Lease Renewal (Britt Smith) Mr. Smith explained the standard lease rate schedule. There was discussion among Committee members, staff and those present regarding the location of the hangar, parking, flooding issues, and other hangar lease rates. Councilman Branch moved and Councilman Bray seconded to accept the proposal from the JC Hangar Association for the lease, motion carried. Councilman Schulte abstained from this vote. 2. Revision to Forestry Article in the City Code (Bill Lockwood/Drew Hilpert) This item was tabled to the September Committee meeting. 6) New Business 1. Fluoride Discussion -Gilbert Cole Mr. Cole explained the latest recommendation of fluoride treatment is 0. 7 milligrams per liter of water from the US Department of Health & Human Services, which is lower than the current City code. Councilwoman Carroll moved and Councilman Bray seconded to refer the changes to the City Council with recommendation to approve. Mr. Hilpert referred to the draft ordinance change in the packet. He explained he will change the language to comply with the US Center for Disease Control & Prevention. Minutes/Jefferson City Public Works and Planning Committee August 22, 2013 Councilwoman Carroll and Councilman Bray removed their motion and second. Committee members requested staff to make the necessary changes and bring the changes to the September Committee meeting for discussion. 2. Capital Mall Development Agreement for CID and Future Subdivision (Janice McMillan) Ms. McMillan referred to the draft agreement included in the Committee's packet. There was discussion among Committee members, staff and those present regarding the tracts within the agreement and the time lines. Mr. Schriemann asked that the rules be suspended at the Council level for the agreement in order to meet time lines. Councilman Schulte moved and Councilman Bray second to forward the agreement to the City Council with recommendation to suspend the rules and approve, motion carried. 3. Stoneridge Village TOO Expansion (Janice McMillan/Drew Hilpert) Mr. Hilpert explained the request is due to changes to the original TOO for Stoneridge Village. 3 Councilman Schulte moved and Councilman Bray seconded to refer the TOO Expansion to the City Council with recommendation to approve, motion carried. 4. Cole County Juvenile Officer Parking (Drew Hilpert) Mr. Hilpert explained Cole County is requesting to use a parking space for the juvenile officer which was originally intended for the Sheriff on Commercial Way. Councilman Branch moved and Councilman Bray seconded to refer the ordinance change to the City Council with recommendation to approve, motion carried. 5. Frog Hollow Road Project Update: a) Jefferson City School District Development Agreement (Matt Morasch) Mr. Morasch explained the agreement. The District will pay one-half of the building permit fee and build to City Code. There was discussion among Committee members and staff regarding riparian corridor, easement for a greenway trail, and security issues. Chairman Scrivner felt the greenway trail issue needs to have resolution. b) Contract Amendment with Bartlett & West for Frog Hollow Greenway Bridge (Bill Lockwood) Mr. Lockwood explained the amendment will be on the next Council consent agenda. The Parks Commission has authorized the contract amendment. c) Ratliff Property Mr. Ratliff stated he is opposed to the Frog Hollow Road project. He felt the City would be destroying the last tree covered roadway within the City and the project would be moving the Minutes/Jefferson City Public Works and Planning Committee 4 August 22, 2013 roadway onto his property and putting a sidewalk in, which he would be responsible for maintaining. He feels the project is too costly and does not need to be done in this area. There was discussion among Committee members, staff and those present regarding the need for the bridge replacement, the project being already designed, public meetings held on the project, the City Masterplan, and the project being a cooperative City/County project. 6. Development Agreement with Capital Region Medical Center Expansion (Matt Morasch) Mr. Morasch explained the agreement, including comments regarding sanitary and storm sewer and right-of-way donation to the City. Councilman Bray moved and Councilman Schulte seconded to refer the development agreement to the City Council with recommendation to approve, motion carried. 7. Old Town Incentive Programs (Janice McMillan) Ms. McMillan explained this is consolidating all old Town Incentive Programs into Chapter 25 of the City Code. Councilman Schulte moved and Councilman Branch seconded to refer the code changes to the City Council with recommendation to approve, motion carried. 8. Update of CDBG Policy and Procedures Manual (Janice McMillan) Ms. McMcMillan explained Ms. Abbott will work with the law department on what changes are needed in the code and what can be referenced. 9. Ash Street CDBG Project (Janice McMillan) Ms. McMillan explained the area is identified as low/moderate income and very much in need of improvements. Mr. Bange stated, once the bids were received for the project, staff would like to have the project move forward within the current building season. Staff requested the rules be suspended when sent to the Council in order for the project to begin during the current construction season. Councilman Schulte moved and Councilman Bray seconded to refer the project to the City Council with recommendation to suspend the rules and approve, motion carried. 10. City/County Sales Tax Project Update (Matt Morasch) Mr. Morasch referred Committee members to the updated project list included in the Committee packet. 7) Adjourn Councilman Bray moved and Councilman Branch seconded to adjourn the meeting at this time (9:37 a.m.), motion carried. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 15 (Health & Sanitation) Section 1 (Fluoridation of Water Supply) is amended as follows: Sec. 15-1. Fluoridation of water supply. A. Passed: --------------------------Approved: _______ _ Presiding Officer Mayor ATTEST: APPROVED AS TO FORM: City Clerk City Counselor Development Agreement THIS AGREEMENT (hereinafter '"Agreement") entered into this __ day of __ _ 2013 by and between the City of Jefferson, Missouri, 320 East McCarty, Jefferson City Missouri, 65101, a municipal corporation, hereinafter referred to as ""City." and Jefferson City School District, hereinafter referred to as the ""School.'' WITNESSETH: WHEREAS, the City may enter into agreements from time to time to ensure the orderly development of property in and around the City; and WHEREAS, the City and School have entered into a series of meetings and negotiations in order to advance their mutual interest; and WHEREAS, the School is the owner of the real property identified on exhibit A (hereafter "the property") and School desires to plan for future infrastructure upon said property; and NOW THEREFORE, in consideration of the mutual promises and covenants hereinafter set forth, and other good and valuable consideration, the City and School do hereby covenant and agree as follows: I. SCHOOL OBLIGATIONS School agrees to: a. Construct all of the development according to City standards and codes (including all building codes adopted by the City and the Storm Water code) and pay one-half (~) the cost of all applicable inspection and construction permit fees which would be applicable to commercial construction. b. Dedicate sufficient right of way for the completion of the Frog Hollow Road alignment as proposed in Exhibit B. The actual location of the dedication shall be determined by the final roadway design approved by the City Engineer and agreed to by the School. c. Dedicate sufficient right of way, at no cost to the City, for the future construction of Stoneridge Parkway as proposed on Exhibit C. attached herewith and made a part of this agreement. Provide inspection of all roadway improvements. b. Provide inspection for con1pliance with city code and all building codes adopted by the City including but not limited to the Storm Water Code. c. Waive any requirement of the School to construct Stoneridge Parkway or any other connection to Schepkers Blvd (as identified on Exhibit C) or Stadium Blvd. d. Vacate existing Frog Hollow Road which is not needed for alignment. e. The City Council shall give consideration to the construction ofStoneridge Parkway out of available Sales Tax E funds and/or inclusion as a proposed project in Sales Tax G. f. Allow reasonable access to the School's property from Mission Drive. 3. GENERAL PROVISIONS: a. The parties acknowledge and agree that the School's agreement to perform and abide by the covenants and obligations of School set forth herein is material consideration for City's agreement to perform and abide by the covenants and obligations of the City set forth herein. b. This agreement shall not be binding on either party until after the agreement has been approved by passage of an ordinance by the City Council and the signature of the Mayor has been affixed and the School Board has approved the agreement and has been signed by the Superintendent. 4. CONTINUATION OF OBLIGATIONS.! The provisions of this agreement shall be binding on the parties' agents, assigns, and successors in interest, provided however that nothing in this paragraph shall be construed as requiring a successor in interest to less than the full property to perform any work or fulfill any obligation except those which apply to the parcel that such successor owns. 5. MODIFICATION OF AGREEMENT This Agreement shall not be modi tied or amended except by a written instrument approved and signed by the parties hereto. 6. SEVERABILITY. Any illegal or unenforceable provision of this Agreement will be severed here from and will not render invalid the ren1aining provisions of this Agreement. 7. LAWTOGOVERN. This agreement shall be construed according to laws of the State of Missouri. The School shall comply with all local. state, and federal laws and regulations relating to the performance of the agreement. 8. NOTICES. Any communications between the City and the School, payments and notices provided herein to the given or made, may be given or made by mailing the same to the City at 320 East McCarty, Jefferson City, Missouri 65101 and to the School at 315 East Dunklin Street Jefferson City, Missouri 65109, or to such other addresses as either party may in writing hereafter indicate. At that time we were discussing whether to include the entirety of this manual in the code, or to authorize the Department Director to promulgate the policies and procedures. The City Counselor has recommended the latter approach. The attached draft ordinance now includes the reference to the CDBG program in Chapter 25, Article IV, and authorizes the Department Director to promulgate the CDBG policies and procedures. The previously distributed Chapter 25 included all of the adopted Old Town and Neighborhood Reinvestment Act ordinances and codes. With the addition of the CDBG program language, Chapter 25 is now ready to referral to the full Council. Staff does propose future updates to the Neighborhood Reinvestment programs, after consultation the Old Town Revitalization Company. Chapter 1 (General Provisions) Section 1-18 (Old Town District Established) is hereby deleted. Section 2. Chapter 17 (Licenses, Taxation and Miscellaneous Business Regulations) Article XV (Fa<;ade Improvement Tax Reimbursement Program), is hereby deleted. Section 3. Chapter 25 (Planning and Development), Article IV (Housing Rehabilitation Grant Guidelines) is hereby deleted and a new Article IV enacted as follows: ARTICLE IV. CDBG POLICY AND PROCEDURE MANUAL The Director of Planning and Protective service is authorized to promulgate and adopt a Community Development Block Grant Policy and Procedure Manual which shall govern the terms and conditions for participation in the Community Development Block Grant program. Section 4. Chapter 25 (Planning and Development), Article V (Neighborhood Redevelopment) is hereby deleted and a new Article V enacted as follows: ARTICLE V. NEIGHBORHOOD REDEVELOPMENT 25-130. Old Town District Established. An area is established within the corporate boundaries of the City of Jefferson to be named "Old Town District" that includes primarily the older neighborhoods and commercial areas within the City; the specific area is described as follows: Beginning at the intersection of Southwest Blvd and Stadium Blvd, thence east along Stadium Blvd., to Leslie Blvd, thence east along Leslie Blvd to Moreau Drive, thence north following Moreau Drive to Clark Ave, thence north continuing on Clark Ave to East McCarty Street, thence east on East McCarty to Benton Street. thence north on Benton to East High Street, thence east on East High Street to Riverside Drive, thence north west following Riverside Drive and continuing in the same direction to the City Limits. Thence following the City Limits and the Missouri River to a point in the Missouri River and along the City Limit line to a point where a line North 55° 30' 25" East from the intersection of Livingston Street and Booneville Road intersects the mid-point of the Missouri River. The purpose of the programs established in this Article are to enhance, encourage and support reinvestment in the City's core, and to consolidate the City's incentive programs into a single Article. The Term "Parts" as used herein after refers to the language in the original enacting ordinance pertaining to "Part xx of the Nbd Reinvestment Act .. " including Ordinances 14296, 14774, 14507 and Ord 14773. Sec. 25-131 through 25-140 reserved. Sec. 25-141. Part One-Residential Tax Reimbursment Program. A. Title and Purpose. !: The title of this ordinance shall be "Part One of the City of Jefferson City Neighborhood Reinvestment Act, the Residential Tax Reimbursment Program." 1.: Its primary purpose is to improve existing neighborhoods in greatest need within the City of Jefferson. by encouraging owner occupation of homes which have been vacant for a year or more, or which have been used for purposes other than single family owner occupied residences. The acts other purposes include: increasing the value of properties eligible to participate in the programs offered by this ordinance. increasing the value of other properties in the neighborhoods where participating properties are located; improving the residential real estate market within the City of Jefferson; and providing housing opportunities for young families, retired citizens and people of modest means. B. Definitions. !: The term "Eligible Real Estate" as used in this ordinance shall be defined to mean real estate situated entirely within the corporate limits of the City and which meets all of the following qualifications: !:. The residential structure is located on the real property built before December 31. 1950; b. The real property was purchased from a third party in a good faith, arms-length transaction after December 31, 2006; £: The residential structure on the real property is occupied by the owner as the owners primary residence after December 31, 2006 and the owner makes application for any reimbursement authorized under this ordinance within thirty (30) calendar days following the end of the calendar year during which the property was purchased; d. The residential structure on the real property is occupied by no more than "a single family" as that term is defined in Chapter 35 of the City Code; ~ The residential structure on the real property has either been vacant or used for some other purpose other than an exclusively owner-occupied single family residence during the twelve months preceding the date of purchase; L The real property including the residential structure has a fair market value of $50,000.00 or Drafter's Note: Deleted text is shown tffil.s. The term "Eligible Real Estate Taxes", as used in this ordinance shall mean all property tax paid on real property for a parcel of Eligible Real Estate. imposed or collected by the City of Jefferson. Cole County. Jefferson City Public Schools, or any other taxing authority but shall not include taxes which became delinquent before being paid. 3. The term residential structure shall include; a. A portion of a non-residential structure which is solely used for residential purposes and which has toilet facilities as well as ingress/egress which are separate from the non-residential use; or b. A residential unit of a condominium building. even if such building includes non-residential units. C. Upon receipt of a property application and certification by the Director of Finance of eligibility, the Director of Finance shall pay the owner of a parcel of Eligible Real Estate an amount equal to all Eligible Real Estate Taxes paid by the owner on such Eligible Real Estate for the previous tax year • .L The Director of Finance shall establish procedures for certifying properties eligible for tax reimbursement under this Section. including procedures for establishing the period of vacancy or prior use of any property being considered for participation in programs under this Act. 2. The Director of Finance may conditionally certify properties eligible for tax reimbursement under this Section in advance of a prospective owner purchasing the property. 3. The owner(s) may receive reimbursement for no more than five (5) tax years and no more than Two Thousand and no/1 00 dollars ($2,000.00) for any one tax year. D. Dates relevant to this ordinance • .L The effective date of this ordinance shall be the day that it is passed; 2. The real estate tax reimbursement authorized by this ordinance shall apply with respect to Eligible Real Estate Taxes assessed in years 2007 and thereafter; 3. The first year an owner may be eligible for real estate tax reimbursement authorized by this ordinance shall be either the year in which the owner purchases and occupies the property as the owners primary residence, or the following year. at the owners election; 4. For purposes of this ordinance. real estate shall be deemed to have been purchased on the date title was conveyed to the buyer from the seller, and 5. This ordinance shall apply only to property purchased after December 31. 2006. E. Title and Purpose. !.:. The title of this ordinance shall be ''Part Two of the City of Jefferson City Neighborhood Reinvestment Act-Residential Down payment Incentive 2. Its primary purpose is to improve existing neighborhoods in greatest need within the City of Jefferson. by encouraging owner occupation of homes which have been vacant for a year or more, or which have been used for purposes other than single family owner occupied residences. The Acts other purposes include: increasing the value of properties eligible to participate in the programs offered by this ordinance, and increasing the value of other properties in the neighborhoods where participating properties are located; improving the residential areas estate market within the City of Jefferson; and providing housing opportunities for young families. retired citizens. and people of modest incomes. B. Definitions. !.:. The term "Eligible Real Estate" as used in this ordinance shall be defined to mean real property situated entirely within the Old Town District of the City and which meets all of the following qualifications; !:. Includes one residential structure completed in 1950 or before; b. Is being purchased by a third party in a good faith, arms-length transaction after the effective date of this ordinance; ~ Is being acquired by the owner as the owner's primary residence after the effective date of this ordinance and such owner has not previously owned and occupied a residential structure as a primary residence within the Old Town District for three (3) years prior to the proposed acquisition; d. Is to be occupied by no more than a single family as that term is defined in Chapter 25 of the Citv Code; £: Shall have been either vacant or used for some purpose other than an exclusively owner occupied single family residence during the twelve (12) months preceding the date on purchase and; .t. The term ••Residential Structure" shall include: a. A portion of a non-residential structure which is solely used for residential purposes and which has toilet facilities as well as ingress/egress which are separate from the non-residential use; or b. A residential unit of a condominium building, even if such building includes non-residential units. C. Upon the receipt of a proper application, and certification by the Director of Finance of eligibility, the Director of Finance shall pay to the owner of a parcel of Eligible Real Estate up to the amount of $5,000.00 to be applied to the down payment for purchase of the Eligible Real Estate . .L The Director of Finance shall establish the procedure for certifying properties eligible for down payment assistance under this Section, including the procedures for establishing the period of vacancy or prior use of any property being considered for participation in programs under this Act. 2. The Director of Finance may conditionally certify properties eligible for down payment assistance under this Section in advance of a prospective owner purchasing the Eligible Real Estate. 3. The owner or owners may receive an incentive of no more than Five Thousand and no/100 Dollars ($5.000.00>. The amount provided will be determined based on the owners' cash contribution towards purchase at closing. D. As a further condition to participating in the program authorized by this ordinance, an owner of Eligible Real Estate, by accepting the down payment assistance, shall be conclusively deemed to agree that: (i) the City may recapture the full amount of incentive made under this ordinance if the owner ceases occupying the Eligible Real Estate as the owners primary residence within five years of the date when the owner receives the down payment assistance; and (ii) the City may assess, impose, and levy the full amount of the down payment incentive as a lien upon the Eligible Real Estate. The title of this ordinance shall be "Part Three of the City of Jefferson City Neighborhood Reinvestment Act-Commercial Facade Tax Reimbursement Program. b Purpose. The main objective of this Article is to enhance the aesthetics of the City by improving the facades of older commercial buildings in Jefferson City so that after completion of work, citizens will recognize improvement in the appearance of the buildings. A secondary objective is to promote mixed use (residential/commercial) in the older commercial areas of the city. B. Eligibility. To be eligible for this Program, properties eligible must meet the following criteria: .L The property must be in a commercial zone and the building to be improved must be used, at the time the application is made, for a purpose which would require a commercial zone (hereinafter referred to as "commercial use"); 2. The structure must have been constructed before 1951; ~ The property must have a fair market value of $70,000 or more at the time the application for improvements is approved; ~ The property, and its owner or owners. must not be delinquent in payment of any State, County, or City taxes; ~ Property must remain in commercial use over the reimbursement period and must re-gualify annually. 6. Exterior improvements must be significant, exceeding $10,000, and be completed prior to reimbursement eligibility. 7. Exterior improvement projects must meet appearance guidelines to be approved for tax reimbursement. The City Administrator, in consultation with the Historic Preservation Commission and the Environmental Quality Commission shall publish specific guidelines, which shall provide, at a minimum, that the improvements be: !: Consistent with the appearance of the building as originally constructed; b. Consistent with the appearance of other buildings in the vicinity as originally constructed in Jefferson City at the same time or prior to 1951; £: Consistent with the present appearance of other buildings on the same block which were constructed at approximately the same time. ~ Any work done prior to approval of Facade Improvement Application is not eligible. 9. The Committee may approve a variance to the age and market value requirements if the building at issue is abutted by one or more buildings constructed before 1951 and the building is determined by the Director of Planning and Protective Services to be structurally sound. !!.: The total number of active properties which can participate in this program shall not exceed twenty-five (25). (Ord. No. 14731, §I, 10-18-2010). 12. A property may be eligible for the Tax Reimbursement Program one time only. 13. Properties shall only be eligible to the extent that funds are available and appropriated for this purpose by the Council. 14. Total annual reimbursement may not exceed the property taxes assessed or Thousand Dollars ($3,000.00), whichever is less. 15. Eligible owners may receive reimbursement for not more than three years starting January 1. 2006. Eligibility must be certified each year. 16. If the upper floors of the building are also in use as residential living space after completion of the facade improvements, the owner may apply for and receive tax reimbursement for an additional 2 years. To be eligible for the 2 additional years of tax reimbursement. the living space must: !b be inspected by city code inspection and certified as meeting basic livability housing standards. b. be occupied for at least 9 months each year of the reimbursement. !1: the upper floors of the building are also occupied for some use other than a residential living space. the owner may apply to the Facade Improvement Committee to receive up to 2 additional years of tax reimbursement which shall be granted provided that the applicant meets the following requirements set forth herein. !b For a property to be eligible for the 2 additional years of tax reimbursement, the Committee must find: i. To qualify as an ~~active commercial use" the second floor must be used for retail purposes. professional offices, financial services, entertainment, religious services, or food or beverage sales. The term "active commercial use" does not include storage of items used in conjunction with another business or residence on or off of the premises. The term "second floor" shall not include any floor which is at or below grade at any point. Sec. 25-144. Part Four-Adaptive Reuse Incentives. A. Title and Purpose. !.: The title of this ordinance shall be ~~Part Four of the City of Jefferson City Neighborhood Reinvestment Act: Adaptive Reuse Incentives" 1: The purpose of this section is to bring vacant buildings which have outlived their original purpose back into productive commercial use while retaining their historic features. B. Definitions. !.: The term "Eligible Project" as used in this ordinance shall be defined to mean real estate situated entirely within the corporate limits of the City and which meets all of the following qualifications: a. The residential structure is located on the real property built before December 31. 1950; and b. The primary structure on the real property is vacant. and has been continuously vacant for a period of at least 120 days; and ~ The property is included in one of the following plans and the proposed use of the property is in compliance with such plan: d. I list plans here! ~ The real property including the structure has a fair market value of $50.000.00 or more. 2. The term "Eligible Real Estate Taxes", as used in this ordinance, shall mean all property tax which has been paid on the real property for a parcel of an Eligible Project, imposed or collected by the City of Jefferson, Cole County. Jefferson City Public Schools. or any other taxing authority but shall not include taxes which became delinquent before being paid. 3. "Owner" or "Owners" may be an individual holding title as sole owner. a joint tenancy. tenancy by the entireties, tenants in common, or a trust. 4. The term "occupied" as used in this section shall mean that the property is being used for the purpose or purposes as set forth in the original application of the owner. To be eligible to participate in the program, the owners of the property must: .L Successfully complete the "Call Before You Start" program as proscribed by the City Administrator prior to commencing construction, and; 2. Not have any delinquent taxes or other fees due to the City . D. Construction . .L All construction and or remodeling shall be done in compliance with City Codes. 2. All construction and/or remodeling shall preserve or restore, to the maximum extent practicable, the historic appearance of the exterior of the building. E. Property to be Occupied. The property shall be continuously occupied during the tax abatement period. In the event that the property is not occupied continuously, the tax refund provided herein shall be pro-rated. F. Tax Refund. Upon receipt of a property application and certification by the Director of Planning and Protective Services that the project and the owners have met all eligibility requirements, the Director of Finance shall pay the owners of the Eligible Project an amount equal to all property taxes paid on the property for the previous tax year. The owner(s) may receive reimbursement for no more than two (2) tax years and no more than Two Thousand and no/1 00 dollars ($2,000.00) for any one tax year. G. Administration. The Director of Planning and Protective Services shall establish procedures for certifying properties eligible for tax reimbursement under this Section, including procedures for establishing the period of vacancy or prior use of any property being considered for participation in programs under this Act. The Director of Planning and Protective Services may conditionally certify properties eligible for tax reimbursement under this Section in advance of a prospective owner purchasing the property. H. Permit to demolish. A. Permit Required. It shall be unlawful to demolish or remove without first filing an application with the Director of Planning and Protective Services or his or her designee in writing and obtaining a demolition permit. Demolition shall be construed to include an act or process which destroys, in part or in whole, a structure or which threatens to destroy a structure by failure to maintain it in a condition of good repair and maintenance. A permit to demolish or remove shall not be issued until a release is obtained from the utilities having service connections with the building. The release shall state that service connections and appurtenant equipment, such as meters and regulators, have been removed or sealed and plugged in a safe manner. Any application for demolition or removal shall be subject to a sixty (60) day review period by the CJHPC, except any application made to demolish or remove any building, structure or humanly constructed object built less than fifty (50) years prior to the date of application, which shall have been determined to have no historic or architectural significance by the Department of Planning and Protective Services under the criteria set out in paragraph C. Any recommendation by the CJHPC shall be advisory only. Nothing in this section shall be construed so as to prohibit the building commissioner from acting under any emergency provisions of Chapter 8 ofthe Code ofthe City of Jefferson, Missouri. B. Review Process. I. Department. All applications for permission to demolish a building or structure shall be made to the Department of Planning and Protective Services. For any structure that is fifty (50) years old or older, the application must contain the following: ll photographs, either in hard copy or as digital files. of all exterior sides, interior rooms, and stairwells, taken within the last ninety (90) days; and 2) a statement from the owner addressing why the property cannot be rehabilitated or restored with a reasonable economic return to the owner. After examining an application and finding that it is in proper form. contains all necessary information, and complies with all applicable provisions of city ordinances, the department shall forward a copy of the application to CJHPC. 2. CJHPC. The CJHPC may have a sixty (60) day period for review of every application for a demolition permit subject to this section. If, by a majority vote, the CJHPC requests additional documentation or information beyond what is contained in the application. the sixty (60) dav review period is suspended at the time of that action, then resumes after the documentation or information is submitted to the department. Staff from both Cities have negotiated a mutually beneficial amendment that allows the following: • Holts Summit will divert all their sewage flow to Jefferson City when pump stations are complete. • Starting in 2017, Holts Summit would pay a flat monthly rate for treatment availability. • Holts Summit commits to performing infiltration and inflow reduction to be complete by 2022 with a cost penalty if they exceed an allowable peak daily flow. • A territory agreement will be on the Council agenda contemporaneous to this agreement that sets a demarcation between Holts Summit and Jefferson City for annexation limits. Attachment lntermunicipal Agreement An1endment THIS AGREEMENT is made and entered into by and between the City of Holts Summit, a municipal corporation, hereinafter referred to as "Holts Summit", and the City of Jefferson, Missouri, a municipal corporation. hereafter referred to as the Jefferson City; this Agreement is to be deemed effective as ofthe 241 h day of May, 2016. WITNESSETH: WHEREAS, Holts Sumtnit and Jefferson City entered into an Intermunicipal Agreement on May 23rd, 1996 (the ••1996 Agreement"') which addressed the construction of wastewater infrastructure, the provision of sewer services and the rates to be charged for such services; and WHEREAS, the parties desire a long term extension of the Agreement for wastewater services. NOW, THEREFORE. for and in consideration of the covenants contained herein, the 1996 Agreement between Holts Sumn1it and Jefferson City is amended as follows: 1. Prior agreement. Any term of the I 996 agreement not modified herein shall continue in full force and effect. 2. Rates. A. For treatment of Holts Sumn1it wastewater sent to Jefferson City, Holts Summit agrees to pay on or before the 241h day of May, of each year the amounts identified on Schedule A, attached herewith and a made a part of this Agreement. For each day the maximun1 daily flow is exceeded. Holts Summit agrees to pay for the excess flow at a rate equal to seventy one percent (71 o/o} of Jefferson City's volume charge (Sec. 29-141 A). C. Rates may be modified after May 24, 2022, if the Federal or State government imposes new treatment regulations of the City of Jefferson for the treatment (but not collection) of wastewater. The Rates may be increased by use of the following formula: The percentage of the total wastewater treated by Jefferson City attributable to Holts Summit multiplied by the cost of the improvement required by the new regulation (attributable to treatment and not collection). This cost shall be amortized over ten years or the ren1aining years of the contract, whichever is longer, but not exceeding the tern1 of this Agreement. D. The City of Holts Summit rnay elect to pay the next higher or lower corresponding tlow ·~tier" and rate identified on Schedule A to adjust for Allowable and Maxin1um Daily Flow and to accommodate growth or the lack of growth for future custon1ers. 3. Allowable Flow. Jefferson City agrees to have available for Holts Summit flow of wastewater into the Jefferson City system, in the an1ounts identified in column "Allowable Flow" identified on Schedule A, attached herewith and a made a part of this Agreement. 4. Term of Agreement. A. Section I 0 ""Tern1 of Contract" of the 1996 Agreement is hereby deleted in its entirety and replaced with section 4B and 4C below. B. This contract shall be in effect from January I, 2017 through December 31, 2051. C. By mutual agreement this Agreement may extended an additional term which shall be from January I. 205I through December 3I, 2055. If either party desires to terminate this Agreen1ent prior to renewal it must send written notice to the party of its desire not to renew prior to January I, 2052. 5. Cancelation. Section IS ""Cancelation'' of the I996 Agreement is hereby modified by deleting the phrase "The City of Holts Summit shall have the right to terminate this Contract for any reason upon giving no less than two (2) years' prior notice to the City of Jefferson"'. 6. Inflow and Infiltration. Holts Sun1mit shall make every reasonable effort to limit inflow and infiltration into their system in order to avoid sending storm water into the Jefferson City treatment facility. 7. Annexation agreement. As part of the inducement for both sides to enter into this Agreement, the parties shall, contemporaneous to this agreement, enter into a written agreement pertaining to limits on annexation of the property between the two cities. 8. Miscellaneous. That the construction of the sewer collection and lift station system by Holts Summit is being financed by a loan made or insured by. and/or a grant from. the United States of America, acting through Rural Development of the United Stated Department of Agriculture. and the provisions hereof pertaining to the undertakings of Holts Summit are conditioned upon approval, in writing. of the State Director of Rural Development. Since said loan will be repaid from system revenues, this contract is hereby pledged to the United States of America as part of the security for said loan in accordance with the requirements of 7 C .F.R § I780.62 (0. 9. Successor to the Purchaser. That in the event of any occurrence rendering Holts Summit incapable of performing under this contract. any successor of Holts Summit. whether the result of legal process, assignment. or otherwise. shall succeed to the rights of Holts Summit hereunder. 10. Choice of Law. This Agreen1ent has been entered into and shall be construed in accordance with the laws of the State of Missouri and proper venue shall be Cole County, Missouri. 11. Notices. In addition, you will likely begin seeing an increase in use of consultants to perform the designs of improvements that were once conducted by City staff. These changes are a result of several vacancies in the Engineering Division . For approximately the last five years or more the Engineering Division was fully staffed. This allowed the division to perform at a very high level. It provided a certain response level to the Council and public (mostly in terms of turnaround time) to which they have become accustomed. The effect of the reduced staffing may not be apparent at this time but I believe in the coming months you w ill beg in to notice a change. The most recent staff change is the resignation of Micah Taylor (last day Oct 41h), a staff engineer in the Engineering Division . His resignation prompted me to notify you of the issue . The staffing level changes started in 2012 when City's plan reviewer retired after 40 years of service. Then the resignation of the Public Works Director (Roger Schwartze ) came in early 2013 . The director resignation shifted the duties of both David Bange and myself to be more heavily involved in administrative tasks and thereby less focused on engineering tasks . All of the vacancies (three positions ) directly affect the CIP workflow and as well as the ability of the div ision to quickly produce various planning studies such as long range planning documents, traffic studies, etc. The attached diagram indicates how the division is structured and the location of the vacancies within the division . The City Administrator has released Public Works to fill a staff eng ineer posi tion and we are starting that process now. However, based on my past experience , it will likely take considerable time to find a replacement and get that individual trained at a high level. Also considering the current state of the City 's budget it will likely be a much longer period of time before the other two vacant positions are filled . I felt it was best to notify the Public Works Committee of the issue since much of the Engineering Division 's interaction with the Council flows through the Committee . I would be glad to discuss the issue further at the upcoming Committee meeting Thanks .
