HomeMy Public PortalAbout2007-34 Adopting the Comprehensive Plan Evaluation and Appraisal Report _EAR_RESOLUTION NO. 2007-34 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, ADOPTING THE REVISED COMPREHENSIVE PLAN EVALUATION AND APPRAISAL REPORT (EAR) PURSUANT TO SECTION 163.3191, FLORIDA STATUTES; PROVIDING FOR ADOPTION AND TRANSMITTAL TO THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL; PROVIDING FOR CONFLICTS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Local Planning Agency of the Village of Key Biscayne (the "Village") prepared the Comprehensive Plan Evaluation and Appraisal Report (EAR) as required by Section 163.3191, Florida Statutes; and WHEREAS, a duly advertised public hearing was held on June 13, 2006, before the Village Council, sitting as the Local Planning Agency, resulting in a recommendation of adoption, and another public hearing was held on June 13, 2006, before the Village Council, authorizing transmittal of the EAR to the Department of Community Affairs ("DCA") for sufficiency review; and WHEREAS, pursuant to Section 163.3191(8), Florida Statutes, the South Florida Regional Planning Council, on the behalf of the DCA, informed the Village that, with certain specified changes, the EAR will be found to be sufficient; and WHEREAS, another duly advertised public hearing was held on July 10, 2007, before the Village Council, sitting as the Local Planning Agency, resulting in a recommendation of adoption of the revised EAR, and another public hearing was held on July 10, 2007, before the Village Council, adopting the revised EAR, attached as Exhibit "A," which incorporated the South Florida Regional Planning Council's comments; and WHEREAS, the Village Council finds that it is in the best interest of the Village to adopt this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted and confirmed. Section 2. Adoption of Revised Evaluation and Appraisal Report. The Village of Key Biscayne hereby adopts the revised Comprehensive Plan Evaluation and Appraisal Report (EAR), which is attached as Exhibit "A" to this Resolution. Section 3. Transmittal to the South Florida Regional Planning Council. The Village Clerk is hereby authorized to transmit the adopted EAR to the South Florida Regional Planning Council, pursuant to the requirements of Chapter 163.3191, Florida Statutes. Section 4. Effective Date. This Resolution shall be effective immediately upon adoption hereof. PASSED AND ADOPTED this 31st day of July , 2007. CONCHITA H.
