AN ORDINANCE OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, AMENDING CHAPTER 14, ELECTIONS, BY
INCLUDING A NEW SECTION 14 -6 EXEMPTING THE
TOWN FROM THE PROVISIONS OF SECTION 101.657,
FLORIDA STATUTES, SPECIFICALLY RELATED TO
EARLY VOTING; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF ORDINANCES IN
CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Florida Legislature has adopted revisions to Section 101.657 of
the Florida Statutes, said section relating to Early Voting; and
WHEREAS, state law allows the Town of Gulf Stream to "opt out" of the
provisions of Section 101.657, the Early Voting requirements, by adopting an ordinance
stating such intent; and
WHEREAS, the Town of Gulf Stream finds that it is in the best interests of its
citizens to opt out of the early voting provisions contained in Section 101.657, Florida
Statutes.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Chapter 14, Elections, is hereby amended by including a new
Section 14 -6 to provide as follows:
"Sec. 14 -6. Exemption from State Law for Municipal Elections.
The Town of Gulf Stream hereby exercises its right to exempt itself
from the provisions of Section 101.657, Florida Statutes, and shall not
conduct early voting for Town of Gulf Stream municipal elections."
Section 2. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.

Section 4. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Gulf Stream.
Section 5. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law.
PASSED AND ADOPTED in a regular, adjourned session on first reading this
