HomeMy Public PortalAbout05-02-19 AgendaMAY 2, 2 019 The Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING Carteret, preceding the Regular Meeting May 16, 2019, was held May 2, 2019, 6:00 p.m. in the Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: Mayor Daniel J. Reiman Councilmember Vincent Bellino " Jorge Diaz " Dennis DiMascio " Ajmar Johal " Susan Naples Noted Absent were Councilmember Randy Krum and Municipal Clerk, Kathleen M. Barney. Also noted present were Carmela Pogorzelski, Assistant Municipal Clerk and Robert J. Bergen, Esq., Law Director. ROLL CALL NOTED ABSENT The Assistant Clerk stated that the 2019 Annual Meeting Notice was STATEMENT OF mailed to The Home New Tribune, The Star Ledger and posted on the MEETING NOTICE bulletin board on January 2, 2019. Notice was published in The Home News Tribune and The Star Ledger on January 7, 2019. The meeting was opened with a moment of silent prayer and the PRAYER, PLEDGE Pledge led by Mayor Reiman. OF ALLEGIANCE Upon MMS &C by Councilmembers Bellino and DiMascio and APPROVAL unanimous affirmative vote of the five (5) councilmembers present, OF MINUTES the minutes of April 18, 2019 were approved as transcribed and engrossed by the Clerk. 1 MAY 2, 2019 (continued) PUBLIC HEARING A copy of the 2019 Municipal Budget was placed on the table for 2019 MUNICIPAL public review prior to the meeting in accordance with the Rules of BUDGET Council and upon MMS &C, by Councilmembers Diaz and Naples and unanimous affirmative vote of the five (5) councilmembers present, the Public Hearing on the 2019 Municipal Budget was open. HEARING CLOSED There being no comments or objections to the 2019 Municipal Budget, upon MMS &C, by Councilmembers Diaz and Johal and unanimous affirmative vote of the five (5) councilmembers present, the Public Hearing was closed. ORDINANCE #19 -11 ORDINANCE #19 -11 was introduced and adopted on First Reading AUTHORIZING and the Assistant Clerk authorized and directed to advertise same for ACQUISITION OF Public Hearing, upon MMS &C, by Councilmembers Diaz and Bellino. PROPERTY Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. Councilmember Krum was noted absent. "AN ORDINANCE OF THE BOROUGH OF CARTERET AUTHORIZING THE ACQUISITION OF A PORTION OF 52 ORCHARD STREET, BLOCK 2503, LOT 2 FOR REDEVELOPMENT PURPOSES" ORDINANCE #19 -7 The Assistant Clerk stated that Ordinance #19 -7 was introduced and VARIOUS SEWER adopted on First Reading at a meeting of the Mayor and Council held IMPROVEMENTS on April 4, 2019. It was duly published in The Star Ledger on April 18, 2019, with notice that it will be considered for final passage after Public Hearing to be held on May 2, 2019 at approximately 6:00 p.m. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. PUBLIC HEARING Upon MMS &C, by Councilmembers Diaz and Bellino and unanimous affirmative vote of the five (5) councilmembers present, Mayor Reiman declared the Public Hearing to be open. MAY 2, 2019 (continued) There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed. Upon MMS &C, by Councilmembers Diaz and Bellino and unanimous affirmative vote of the five (5) councilmembers present. Upon MMS &C, by Councilmembers Diaz and DiMascio ORDINANCE #19 -7 "ORDINANCE PROVIDING FOR VARIOUS SEWER IMPROVEMENTS IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $4,800,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $4,800,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" was finally Adopted. Upon individual Roll Call Vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. Councilmember Krum was noted absent. REIMAN Advertised as Finally Adopted: May 8, 2019 PUBLIC PORTION A copy of each Resolution was placed on the table for public review RESOLUTIONS/ and prior to the meeting in accordance with the Rules of Council and AGENDA ITEMS & upon MMS &C, by Councilmembers Bellino and DiMascio and NEW BUSINESS unanimous affirmative vote of the five (5) councilmembers present, the meeting was opened for public input on all Resolutions /Agenda items and new business. Mayor Reiman asked if anyone had anything to say with regard to any of the Resolutions or anything around town they would like to ask about. 4 MAY 2, 2019 (continued) Joe Czajkowski, 14 Matthew Avenue said the Rite Aid property has a lot of garbage; someone threw cement at his house when he complained. He said there are rats behind the building and the shrubs are overgrown. He said he stopped in to complain at the Mayor's Office last November but nothing was done. Mayor Reiman said that wasn't true, inspectors were sent out to write violations and the Streets and Roads employees were also sent there to clean up the mess. Joe Czajkowski said school buses go through the parking lot very fast to avoid the light and kids are smashing the rat traps and throwing them around. Mayor Reiman said the garbage has been picked up and the shrubs have been cut. He said there was a contractor there and agreed with Mr. Czajkowski that the area is a mess, but that we are limited to what we can do because someone else owns the property. Joe Czajkowski said he takes care of the property in the back and other people take care of the other side. Mayor Reiman said if you clean it, property maintenance sees nothing when they go there and no violation will be issued. If an inspector writes a violation the property owners have thirty (30) days to clean it up or they will have to appear in court, they will get a fine and we can put a lien on their taxes. Joe Czajkowski said the garbage has been there since November, there is no dumpster, the police were called out there four times and nothing is being done. Councilmember DiMascio said he saw doors behind the building and said people must be dumping there. Joe Czajkowski said there are rats. Mayor Reiman said he will check with the Construction Department and the Court to see what violations have been issued. He said it may be getting lost in the corporate structure, the Borough tried to buy and/or condemn the property but there was no response from the owners. Joe Czajkowski said it has been six months and there is no change. Clerk's Note: Mr. Czajkowski & Ms. Dhanie signed the Speaker Sign -in Book for the Public Portion but did not state their name before speaking. 5 MAY 2, 2019 (continued) JOE CZAJKOWSKI Mayor Reiman said he agreed and sympathized with him and said he wants them to clean up the property. Joe Czajkowski said the neighbors need a light on Heald Street. Mayor Reiman said four requests have been made to PSE &G. He said some poles are Verizon and some are PSE &G, only the PSE &G poles get lights, but not all of them, it has to be done by PSE &G. Joe Czajkowski said the high school flag pole is rusty and should be fixed because it is almost 4 of July and he felt it doesn't look right. ELIZABETH DHANIE Elizabeth Dhanie, 182 Washington Avenue said her mother is elderly and she cleans up the mess and trims the grass and shrubs all the time, she said her mom had permission from the people at Rite Aid. Mayor Reiman said the inspector will check the dumpster area. Joe Czajkowski said garbage is behind the shrubs and concrete has been there since November. Mayor Reiman said he will send the inspectors over to the area in the morning and will personally check it out after the meeting tonight. There being no further comments or objections to the PUBLIC PORTION Resolutions /Agenda items or new business, upon MMS &C, by CLOSED Councilmembers Diaz and Bellino and unanimous affirmative vote of the five (5) councilmembers present, the public portion of the meeting was closed. Mayor Reiman asked for a motion on the Consent Agenda. Resolutions #19 -72 through #19 -82 were introduced by Mayor Reiman and referred to the Council for action. Councilmembers Bellino and Diaz voted yes on all resolutions but abstained on #6 because both of their wives work for the Board of Education. Councilmember Krum was noted Absent. Upon MMS &C, by Councilmembers Diaz and DiMascio, all bills PAYMENT OF BILLS appearing on the prepared list, properly audited and signed were ordered to be paid. Upon individual Roll Call Vote, Councilmembers Bellino, Diaz, Johal, DiMascio and Naples voted in the affirmative. Councilmember Krum was noted absent. Mayor Reiman said he was appointing Nick Scutari to part-time BUSINESS ADDED Municipal Prosecutor finishing the unexpired term held by Raj MUNICIPAL Mukher then asked for a motion on his appointment. PROSECUTOR APPOINTMENT Upon MMS &C, by Councilmembers Diaz and DiMascio and unanimous affirmative vote of the five (5) councilmembers present, Nick Scutari was appointed to the position of Municipal Prosecutor.
