THIS AMENDMENT is made and entered into this � 4 day of
2012, by and between the City of Richmond, Indiana, a municipal
corporation acting through its Board of Sanitary Commissioners, (hereinafter referred to
as the "City"), and Pyramid Equipment, Inc., (hereinafter referred to as the
"Contractor").
WHEREAS, City and Contractor entered into Contract Number 68-2012 on or
about May 22, 2012 to provide one thousand (1,000) Cascade ninety-six °(96) gallon trash
containers (Rosie Rollers) for the Richmond Sanitary District; and
WHEREAS, City now has an unanticipated need for an additional one thousand
(1,000) Rosie Rollers, which Contractor can provide at the same per -unit price quoted
initially in its response to City's Request for Quotes referenced in Contract No. 68-2012,
and
WHEREAS, City and Contractor now desire to amend Contract Number 68-
2012, pursuant to its terms, to revise the scope of services to be provided by Contractor
under this Agreement, and to further alter the compensation payable to Contractor for
such revised services.
NOW, THEREFORE, in consideration of the mutual promises and covenants
herein contained, including the above stated recitals, City and Contractor hereby agree as
follows:
SECTION I. STATEMENT AND SUBJECT OF WORK of Contract 68-
2012 will be revised as follows:
City hereby retains Contractor to provide and deliver a total of two
thousand (2,000) Cascade ninety-six (96) gallon trash containers for the
Richmond Sanitary District.

2. SECTION III. COMPENSATION of Contract 68-2012 will be revised as
follows:
City shall pay Contractor a total suin not to exceed Ninety -Nine Thousand
Five Hundred Dollars and Zero Cents ($99,500.00), for complete and
satisfactory performance of the work required hereunder.
3. City and Contractor expressly agree that all other terms,
conditions and covenants contained in Contract Number 68-2012 shall be
applicable to the work performed pursuant to this Amendment, unless such
term, condition or covenant conflicts with this Amendment, in which case
this Amendment shall be controlling.
IN WITNESS WHEREOF, the parties execute this Agreement effective the day and year
first above written, although signatures may be affixed at different times.
