Home My Public Portal AboutOrd. 19-11wrbina U No. ' 19 -11 h� of t e nn ( of II 11 AN ORDINANCE OF THE BOROUGH OF CARTERET AUTHORIZING THE ACQUISITION OF A PORTION OF 52 ORCHARD STREET, BLOCK 2503, LOT 2 FOR REDEVELOPMENT PURPOSES WHEREAS, pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -8, the Borough of Carteret (the "Borough ") is authorized to acquire property located within a designated redevelopment area by negotiation or condemnation; and WHEREAS, pursuant to N.J.S.A. 40A:12A -5, the West Carteret Commercial Redevelopment Area was determined to be an area in need of redevelopment by the Borough; and WHEREAS, pursuant to N.J.S.A. 40A:12A -7, the West Carteret Commercial Redevelopment Plan has been adopted by the Borough; and WHEREAS, the West Carteret Commercial Redevelopment Plan identifies certain properties to be acquired for redevelopment, including Block 2503, Lot 2; and WHEREAS, the Borough has determined that it would serve the purposes of the Borough and the Local Redevelopment and Housing Law for it to acquire a portion of Block 2503, Lot 2 for redevelopment purposes. NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council ofthe Borough of Carteret, Middlesex County, New Jersey, as follows: Section 1. The acquisition by negotiation and/or eminent domain of a portion of 52 Orchard Street, Block 2503, Lot 2 is hereby authorized. Section 2. The Mayor, the Chief Financial Officer and the Director of Law are each hereby authorized to sign any document necessary to effectuate the acquisition of such property. Section 3. Any and all ordinance or resolutions of the Borough, or provision thereof, inconsistent with the provisions of this Ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. Section 4. If any section, subsection, part, clause or phrase of this Ordinance or the West Carteret Redevelopment Plan shall be declared invalid by judgment of any Court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of this Ordinance or the West Carteret Redevelopment Plan, as applicable. Section 5. This Ordinance shall take effect upon final passage and publication in accordance with applicable law. Section 6. Upon the final adoption hereof, the Borough Clerk shall forward certified copies of this Ordinance to Matthew C.
