ORDINANCE 3-2006
A SPECIAL ORDINANCE PROVIDING FOR A PLANNED UNIT DEVELOPMENT TO
BE USED FOR RESIDENTIAL PURPOSES
WHEREAS, the Zoning Map designates and describes certain property located at 2100
South US 27 — Elks Country Club as an 0-1 Greenbelt District; and
WHEREAS, it is desirable to change the zoning designation to a Residential P.U.D.
District to allow the real property to be used for condominium housing units
(twelve buildings, each containing two (2) individual condominium units).
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana, that the zoning designation of certain property whose address is 2100
South U.S. Highway 27, and more particularly described below is hereby changed to a
Residential P.U.D. District to allow the property to be used as condominium housing units
(twelve buildings, each containing two (2) individual condominium units). The Concept Plan
is hereby approved and the Concept Plan and Draft Development Plan is attached to this
Ordinance as "Exhibit A."
The subject property is more particularly described as follows:
Being a part of the Southwest Quarter of Section Eight (8), Township
thirteen (13) North, Range One (1) West in the City of Richmond, Indiana,
and a part of the Northwest Quarter and the Northeast Quarter, both being
in Section Seventeen (17), Township Thirteen (13) North, Range One (1)
West in Wayne Township, Wayne County, Indiana, and being more
particularly described as follows:
Beginning at the northwest corner of the northeast quarter of said section
seventeen (17), and running thence from said beginning point, north eighty-
nine (89) degrees and twenty-two (22) minutes east, along the north line of
said northeast quarter, two thousand three hundred forty-three and seventy
hundredths (2343.70) feet to the westwardly right-of-way of United States
Highway Number Twenty-seven (27); thence south fifteen (15) degrees
and fifty-four (54) minutes west, along the chord of a curve to the left in
said right-of-way, a distance of nine hundred ninety-three and eighty-five
hundredths (993.85) feet; thence south eighty four (84) degrees and
twenty-seven (27) minutes west nine hundred ten and seventy-one
hundredths (910.71) feet; thence south sixty-five (65) degrees and twenty-
two (22) minutes west two hundred eighty-six and four hundredths
(286.04) feet; thence south ten (10) degrees and thirty-seven (37) minutes
east seven hundred eight and seventy-five hundredths (708.75) feet; thence
south three hundred seventy-six (376) feet; thence west two thousand
three hundred fifty-six and fifty-seven hundredths (2356.57) feet; thence
north thirteen (13) degrees and twenty-nine (29) minutes east nine hundred
eighty-seven and sixty-three hundredths (987.63) feet; thence south eighty
(80) degrees and three (03) minutes east one hundred eighteen and twenty-
eight hundredths (118.28) feet; thence north fourteen (14) degrees and
eight (08) minutes east two hundred thirty-one and forty hundredths
(231.40) feet; thence south eighty-six (86) degrees and fifty (50) minutes
east one hundred fifty-one and eighty-eight hundredths (151.88) feet;
thence north zero (0) degrees and ten (10) minutes west one thousand
three hundred ninety-four and thirty-nine hundredths (1394.39) feet;
thence south eighty-four (84) degrees and five (05) minutes east one
hundred sixty-two and thirty-three hundredths (162.33) feet; thence north
zero (0) degrees and forty-five (45) minutes west two hundred sixty-three
and ninety-nine hundredths (263.99) feet; thence north eighty-five (85)
degrees and forty-five (45) minutes west one hundred eleven (111) feet;
thence north zero (0) degrees and forty-four (44) minutes west two
hundred forty-eight (248) feet; thence north eight (8) degrees and fifty
(50) minutes east one hundred ninety-eight and five hundredths (198.05)
feet; thence north forty-one (41) degrees and fifty-six (56) minutes east
two hundred seventy-nine and one hundredth (279.01) feet; thence north
fourteen (14) degrees and four (04) minutes west two hundred thirty-two
and two hundredths (232.02) feet; thence south eighty-nine (89) degrees
and forty-two (42) minutes east five hundred fifty-eight and fifty-two
hundredths (558.52) feet to a point in the east line of the southwest quarter
of said section eight (8); thence south, along said east line one thousand
four hundred seventy-four and eighty —seven hundredths (1474.87) feet to
the place of beginning, containing a total area of one hundred fifty (150)
acres, more or less, there being twenty-two and thirty hundredths (22.30)
acres, more or less, in the southwest quarter of said section eight (8) in said
City of Richmond, Indiana, and forty-nine and thirty-six hundredths (49.36)
acres, more or less, in the northwest quarter of said section Seventeen (17)
and seventy-eight and thirty-four hundredths (78.34) acres, more or less, in
the northeast quarter of said section seventeen (17) in said Wayne
Township, Wayne County, Indiana.
SUBJECT to a certain easement to the City of Richmond, dated March 30,
1953, and recorded in Deed Record 254 at page 463 in the records of the
Wayne County Recorder.
ALSO SUBJECT to an easement to the Indiana Bell Telephone Company
dated June 9, 1949, and recorded in Deed Record 323 at page 230 in the
records of the Wayne County Recorder.
ALSO SUBJECT to an easement to the City of Richmond, dated March
30, 1954, and recorded in Deed Record 260 at page 12, in the records of
the Wayne County Recorder.
ALSO subject to a certain lease to the Indiana Department of Conservation
by its Division of Fish and Game dated April 28, 1954, and recorded in
Deed Record 67 at page 476 in the records of the Wayne County
Recorder, provided any penalty for immediate termination of said lease
shall be paid by Grantors.
Passed and adopted this day of 2006 by the Common Council
of the City of Richmond, Indiana.
