Changing the diversion would reduce the size of the pipe and free up open space near the ponds. TM Durbin will have theTown Attorney draw up an easement agreement between WPR and the Town of Fraser. c)Resolution 2011-09-03 pursuing implementation of traffic signal at First Street in Grand Park TM Durbin read a letter from Trustee Burford requesting the item be removed from the agenda. The Trustees decided to move forward with the discussion but put off any decision on the signalization at this meeting. TM Durbin briefed the Board on the discussions that have been held with Grand Park, CDOT,Winter Park and Koelbel regarding the signal. Terry Stanford asked the Board to sit down with CDOT, Grand Park, Winter Park and Koelbel to discuss the traffic signalization. James Meyer and Drew Nelson of Winter Park voiced their concerns on the signalization at First Street. Votes in favor: ___BOARD TRUSTEES OF THE Votes opposed: ___TOWN OF FRASER, COLORADO Absent:___ Abstained: ___BY: Mayor ATTEST: (S E A L) Town Clerk Water and Sewer Service Line Replacement Incentive Program Purpose The purpose of the Water and Sewer Service Line Replacement Incentive Program is to create a reasonable and cost effective policy encouraging property owners to replace their private service lines that have been identified to be leaking. Program This program was created to encourage Fraser homeowners to replace private service lines that have been identified to be leaking before the useful life of these lines deteriorates to the point that the line terminally fails. Funding for this program will come from the respective Enterprise Fund and may be terminated at anytime, at the discretion of the Town. Why Should I Replace My Service Line(s)? Leaking water lines waste valuable resources and customer dollars producing water that is never consumed. Leaking sanitary sewer lines can allow excessive groundwater infiltration into the sewer system for unnecessary treatment, again costing utility customers unnecessary expenses and potential rate increases for system upgrades. What is a Private Service Line? It is the portion of pipe (water or sewer) where it is tapped into the respective Town owned main pipe in the public right-of-way and serves the adjoining dwelling. Program Criteria ELIGIBILITY This program applies to any Fraser property owner of a private water or sewer service line that has been identified to be leaking and the utility accounts must not be delinquent. PAYMENT PLAN OPTIONS $500 credit to customers utility account Asphalt and concrete in the public ROW is replaced by the Town at its expense Access Permit fees and surety are waived (completed Access Permit is required) Low interest loan program APPLICATION PROCESS Property owners interested in applying for this incentive program or that would like additional information should contact the Fraser Public Works department at 970-726- 5491 xt___. A completed Access Permit Application needs to be submitted to the PW department to begin the process. Once the application has been reviewed, a Public Works representative will contact the owner to schedule an on-site property survey. stst Service line replacement work needs to be completed between June 1 and October 1. BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO BY: Mayor ATTEST: (S E A L) Town Clerk TOWN OF FRASER ORDINANCE NO. 387 Series 2011 AN ORDINANCE AMENDING CHAPTER 13, ARTICLE 2OF THE FRASER MUNICIPAL CODEBY ADDING LANGUAGE TO ADDRESS WATER USAGE AND EQUIPMENTWITHIN THE TOWN OF FRASER. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: PART 1: AMENDMENT OF MUNICIPAL CODE.Chapter 13, Article 2of the Fraser Municipal Code (herein sometimes referred to as the "Municipal Code") is hereby amendedby adding new subsection to Section 13-2-310and 13-2-330, whichshall read as follows: SECTION 13-2-310(e) Properties experiencing equipment failure will be given until third quarter to grant access to the Town for inspection and maintenance currently prohibited by winter conditions or other unforeseen circumstances. Failure to grant access and/or to repair the problem before this timeframe could cause the assessment of an unmetered water penalty. SECTION 13-2-330(b) Water usage may be estimated from time to time for individual or groups of users due to acts of God, equipment failure or other reasonableand customary reasons. Where adequate historical usage records are available, these may be used to make such estimates. If historical records are inadequate to make such estimates, the Town manager or designee may use typical usage for similar users or any other data to estimate a fair usage. PART 2: REPEAL.Any and all existing ordinances or parts of ordinances of the Town of Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. PART 3: SEVERABILITY.If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Town of Fraser hereby declares that it would have adopted this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases thereof be declared invalid or unconstitutional. PART 4: EFFECTIVE DATE; PUBLICATION. This Ordinance shall take effect thirty (30) days after passage, adoptionand publication thereof as provided by law. I am still awaiting background checks from the police department so I have not released the license to the applicants. th I will be attendinga “Mail Ballot Election” class on Friday, September 30. Due to the large number of people who have requested mail-in ballots the Board may want to consider holding a Mail-In ballot election in April. We can revisit this idea in early 2012. rd On Thursday November 3from 11:30-1:30 p.m. CML will be offering a webinar on “The Do’s and Don’ts of Quasi-Judicial Proceedings given by Tami Tanoue of CIRSA. Lu PLANNINGUPDATE (October 5th,2011) Planning Commission: Continue to workon code updates. On 9/28/11, the Planning Commission recommended approval of the draft sign code and the draft business zone regulations with a few final edits. We will scheduleaTown Board public hearing for 11/16/2011. Thanks to the PC for lots of hard work on the code amendments! We have also scheduled a joint PC/TB public hearing for 11/2/11 to review amendments to the subdivision regulations.Philip Naill will be vacating his seat as PC Chair to take Joyce’s seat on TB. We will have two vacancies on Planning Commission. Spend the word and let me know of anyonethat might be interested in serving on the Planning Commission! Town of Fraser PO Box 370, Fraser, CO 80442 office 970-726-5491fax 970-726-5518 www.frasercolorado.com  PUBLIC WORKS BRIEFING (As of 9/29 for 10/5/2011 meeting) WATER~ There will be a discussion regarding the proposed Water and Sewer Service Line Replacement Incentive Program that was presented at the last W-WWC meeting. I have included an outline of the general program/policy. SANITARY SEWER~ Preparing for a manhole repair project in US40 in front of the Conoco mini mart just south th of Eisenhower. Work on this project has been postponed until Oct. 5th or 10. It will now be a two day project with an overnight lane closure. STREETS~ There will be a presentation at the workshop by the Town Engineer and myself regarding proposed drainage improvement projects that we are pursuing for 2012 as a result of this years snowmelt issues. There is a map attached identifying these areas. The items we touch on are as follows: Recap what work has been completed by TOF and GC upstream and in town Jones property swale improvement Leonard/Mill UPRR swale improvements (reshaping) Mill/Doc (Divide) swale improvements St. Louis breach update (USACE) UPDATE: The Army Corps NWP13 permit application for the St. Louis creek bank stabilization project was withdrawn last week from the USACE as the landowner did not concur with our design plans. USACE requires that the applicant obtain landowner approval of the design prior to the Corps issuing a permit. We are working with a hydrologist and a river restoration firm as well as the landowner to come up with a design that will work for all parties. The Divide condos HOA have withdrawn their request to construct a private improvement in a Town ROW at this time. PW completed the removal of willow wads along CR73 and the drainage ditch on the east side of the UPRR tracks upstream of the Divide condos. We still have some ditch clearing work to complete in the Clayton trailer court area. GC R&B has completed ditch maintenance work along GCR73. They have a few places that will need to be asphalt patched Chip & Seal Project status- we are processing a progress pay application for the work that has been completed to date. The FR-WP trail (paved trail) will be undergoing realignment as a part of the Bowl & Cinema construction project at the south end of Town. The trail will be closed and rerouted for a short time frame, up to two weeks. Signage will be placed in advance of the construction area warning trail users of the work. Airpiping is scheduled tobe installed to keep the ice from being a problem to the liner. The DRAFT discharge permit has been written and is available for public comments for a period of thirtydays. There are a number of changes both minor andmajor, the most important is the compliance schedule forremoval of the following items arsenic, hexavalent chromium, dissolved copper, mercury and dissolved zinc. The requirements for E.Coli and ammonia the plant should have no problemsmeeting the imposed standards. RMI is also reviewing permit so comments can be formulated and forwarded to the health dept. Digester#2 mixerrepairs are still on going with some parts still in the shop and staff fabricating the parts and support frame in-house, all is going well. Staff has be working with the Fraser Valley Rec Center in assisting them in dumpingthe swimming pools, the discharge last year caused some operational challengesthat we are trying to avoid. The treatment plant is working very well with removals at 99%. If you have any questions please give me call.
