HomeMy Public PortalAboutr 19-101Ywoolutt of fhe orongh of Earttxet, �K- J_ No, 19-101 Date of Adoption Jive 6 2019 FORWARDING REQUEST FOR AN INVESTIGATION BY THE NEW JERSEY ATTORNEY GENERAL'S OFFICE INTO THE MIDDLESEX COUNTY PROSECUTOR OFFICE'S CONDUCT TOWARD THE BOROUGH OF CARTERET AND ITS OFFICERS AND OFFICIALS WHEREAS, Mayor Reiman has formally requested that the New Jersey Attorney General's Office investigate the Middlesex County Prosecutor's Office's asserted malicious abuse of power directed at the Mayor and the Carteret Police Department; a copy of Mayor Reiman's letter is attached hereto detailing the basis for this request; and WHEREAS, as noted in the Mayor's correspondence, this request follows the May 24, 2019 determination by a Middlesex County jury, following a month long trial, to acquit Borough of Carteret Police Officer Joseph Reiman on all charges brought against him by the Middlesex County Prosecutor's Office in the matter of State v. Reiman; and WHEREAS, the Prosecutor's Office leveled these charges against Officer Reiman related to his arrest of a suspect following the suspect's high -speed efforts to evade detection and apprehension by the Carteret Police while out driving underage, in a vehicle being operated without the permission of its owner, and while on probation for other delinquent conduct; and WHEREAS, Mayor Reiman has requested this review by the Attorney General's Office due to Middlesex County Prosecutor Andrew Carey's Office's conduct in this and other Carteret police related matters; and WHEREAS, the Governing Body supports a full and complete investigation by the New Jersey Attorney General's Office into these allegations as they relate to the Carteret Police Department; and specifically into any role by the Prosecutor's Office to suppress the charges filed against the suspect ultimately apprehended by Officer Reiman; and WHEREAS, the Borough's residents, under New Jersey law, are now facing a claim for hundreds of thousands of dollars in legal fees on behalf of Officer Reiman as a result of the jury's acquittal of Officer Reiman on all of the charges brought against him by the Middlesex County Prosecutor's Office. NOW, THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Carteret as follows: 1. That the New Jersey Attorney General's Office conduct a full investigation into the allegations presented in Mayor Reiman's letter of May 30, 2019, to include a review of any action undertaken by the Middlesex County Prosecutor's Office to suppress any of the multiple charges that had been filed against the suspect apprehended by the Carteret Police Department on the early morning of May 31, 2017. 2. That a copy of this Resolution be forwarded to the New Jersey Attorney General's Office. Adopted this 6'` day of June, 2019 and certified as a true copy of the original on June 7, 2019. KATHLEEN M.
