OPPOSING ASSEMBLY BILL A -4508
WHEREAS, Assembly Bill A -4508, released by the Senate and General Assembly; and
WHEREAS, A -4508, prohibits sewerage authorities from imposing a connection fee in
certain circumstances, specifically, prohibiting a sewerage authority from imposing a new
connection fee or tapping fee for property that is being redeveloped if the property has
been connected to the sewerage system for 20 or more years; and
WHEREAS, A -4508, provides a blanket exception without any consideration to the type
of development, the bill allows for the exclusion even if the redevelopment project
proposes an addition, alteration or change of use, even if it requires a modification and
relocation of an existing sewerage connection; and
WHEREAS, A -4508 would cause the cost to be borne by the other users of the sewerage
system and not the property owner creating the new demand; and
WHEREAS, the New Jersey League of Municipalities and the Borough agree with the
bill's sponsors that we need to encourage redevelopment of obsolete or vacant property;
but do not support legislation that provides a mechanism for developers to avoid fees at
the expense of taxpayers; and
WHEREAS, the New Jersey League of Municipalities strongly opposes A -4508 as
released and has requested that all of its members go on record similarly opposing the
same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Mayor and Council of the Borough of Carteret
hereby opposes Assembly Bill A -4508 and
recommends the committee reconsider passing A -4508
as not to pass the added expense on to the taxpayers .
2. That a copy of this Resolution be forwarded to the New
Jersey League of Municipalities, Assemblywoman
Eliana Pintor Marin, Assemblyman Raj Mukherji,
Senator Joseph Vitale, Assembly Speaker Craig
Coughlin and Assemblywoman Yvonne Lopez.
